Even MORE Of The Kinds Of Things That Would Have Been On A Full-Time Impeachment News And Commentary Blog…

1 . You know I can’t let this pass: New Age guru and cool Democratic Presidential candidate Marianne Williamson tweeted out both fake news and, given her number of followers and <cough> far more effective disinformation for the kind of idiots who believe Russian bots than any foreign mischief-maker on Facebook:

She only could believe this absurd “report” if  a) she was so ready to believe anything bad about this President that literally nothing could be too absurd to swallow, and b) if she was so irresponsible that she would tweet it to her gazillion followers without checking.  It seems that she read a phony article published on Nov. 16 by MoronMajority.com. by the light of her lava lamp, after itwas then picked up by  the Daily Kos, which could easily use the name “MoronMajority.” After pulling down the tweet, Williamson had the chutzpa to write she wrote that we had to be vigilant against “big lies” in the coming campaign….you know, like hers.

2. Then there is this from Rep. Al Green, who was calling for Trump’s impeachment, and entered resolutions to that effect, long, long before there was any Ukraaine phone call:

Rep. Al Green (D-TX) said on Saturday during an interview on MSNBC that President Donald Trump needed to be impeached “to deal with slavery.”Green, who has previously stated that Trump must be impeached or else “he will get reelected,” said this week that there is “no limit” to the number of times that Democrats can try to impeach the president.

In other words, he is just like every other House Democrat, just not as subtle. And perhaps a little bit more stupid. Asked to explain what slavery has to do with impeachment, Green replied,

I do believe, ma’am, that we have to deal with the original sin. We have to deal with slavery. Slavery was the thing that put all of what President Trump has done lately into motion.We cannot overlook what happened when he came down the escalator and just demeaned people of color when he talked about the s-hole countries. It’s insidious … racism, the president has played on racism and he’s used that as a weapon to galvanize a base of support to mobilize people.So, I appreciate whatever we will do, but until we deal with the issue of invidious discrimination as a relates to [the] LGBTQ community, the anti-Semitism, the racism, the Islamophobia, the transphobia, and also the misogyny that he has exemplified, I don’t think our work is done.

Ah! Now he sounds more typical. This is, of course, Big Lie #4, “Trump is a racist.” John Hinderaker correctly notes on his blog:

Green’s rant is valuable, not because it makes any sense, but because it gives us a window into the Democrats’ real motive for wanting to impeach the president–sheer hatred over political differences. Combined, of course, with the realization that in all probability, he will be re-elected next year if they do not succeed in evicting him from office.

A Cautionary Tale: The Corruption Of Post Columnist Colbert King, Part II

King refused to apply his usual ethics alarms to Obama, but continued to be a credible and objective analyst where the D.C. government was involved. He was an instant Donald Trump-hater, however. the second the 2016 results were known. I can understand reaction to the two-time runaway winner of the Ethics Alarms “Asshole of the Year” award. But King concluded Trump was a racist—his embrace of  birther accusations against his beloved Obama was enough to guarantee that—and once Trump was elected, King became the Post’s counterpart to Trump-deranged Times columnist Charles M. Blow, except that King at his worst is usually more endurable than Blow at his best.

King’s latest anti-Trump screed, however, shows how far a smart pundit can fall when the cognitive dissonance scale and confirmation bias work in tandem, especially when old age marches on and one is mired in both work and personal bubbles where a single bias dominates.

The column begins with one of my least varieties of fake news, future news, when a journalist sets out to push a negative view of a politician based on what he will do.  The headline is “It’s a good bet Trump pardons his felon allies. Here’s when that’s most likely.”

I don’t think it is a good bet, though it is certainly possible. King assumes it is a good bet, as his column makes clear (along with all of his previous columns relating to Trump) because he thinks of the President as a corrupt racketeer. King’s once nimble mind  is now incapable of imagining a justification for pardoning the “allies” in question, Roger Stone, Mike Flynn, and Paul Manafort. I can: arguably all three of them were indicted and convicted because of the “resistance”effort to try to drive Donald Trump from office, and to send a message to anyone who might be of value to his administration that they would instantly be in cross-hairs if they dared to try to support the President. President  Trump might feel responsible for their plight, and use his absolute clemency power to relieve their burdens. If so, it would not be an unprecedented political or personal use of the pardon and clemency power. Colbert King is 80 now, but he is still a regular columnist with the Washington Post. As a recent column demonstrated, he has finally fallen prey to the Post culture and no longer is what he once was: the rare pundit, in his case, a liberal one, who could be counted upon for fairness and integrity regardless of the topic. The one-two punches of Barack Obama and Donald Trump showed how cognitive dissonance and confirmation bias can corrupt the best of us, and make no mistake about it, King was once one of the best.

Although he is an African-American, he stood out for decades among his corruption- enabling black colleagues in consistently calling out the D.C. government’s corrupt leadership—notably Marion Barry but many others—on their arrogantly dishonest, venal and untrustworthy practices and attitudes.

Then Barack Obama happened. I listened in surprise on a local Sunday talking head show as King defended Barack Obama’s quiet, decades long assent to the black liberation (that is, anti-white, anti-American rantings of Reverend Wright, Obama’s “spiritual mentor.” Were these rationalizations I heard Colbert King uttering? King reliably mocked rationalizations, and yet here he was using them, notably “Everybody does it,” to defend  a black Presidential candidate’s approval and association with a black racist and demagogue.

Once Obama was elected, King got worse. Not only could Obama do no wrong, but those who criticized were enemies in his eyes; worse, King treated Obama’s appointees and cronies with similar reverence, a complete reversal from his approach to the  parade of incompetent or criminal black politicians in D.C.  Notably, he defended Obama “wing man” Eric Holder, the racialist Attorney General, when he was refusing to comply with a legitimate Congressional inquiry into the Justice Department’s Fast and Furious fiasco. 1.  Here’s that “violating democratic norms” Big Lie again. This one was flagged by Ann Althouse (Thanks, Ann!)

U.S. District Judge Paul Friedman,  an appointee of President Bill Clinton,  said in a speech at  the annual Thomas A. Flannery Lecture in Washington, D.C. last week, “We are in unchartered territory. We are witnessing a chief executive who criticizes virtually every judicial decision that doesn’t go his way and denigrates judges who rule against him, sometimes in very personal terms. He seems to view the courts and the justice system as obstacles to be attacked and undermined, not as a coequal branch to be respected even when he disagrees with its decisions.'”

Althouse comments,

How do you get to be a federal judge and think the expression is “unchartered territory”? That’s a written speech too (presumably). Did he visualize some entity that issues charters authorizing people to speak about the courts in a particular way? You don’t need a license to speak in the United States, and to require one would, ironically, violate our norms. The expression is “uncharted territory,” which would simply mean that Trump is venturing into a new area of speech that we haven’t previously explored and therefore have not mapped…Now, I agree with the idea that Trump’s speech about law is unconventional, but what determines that he has violated all recognized democratic norms? It’s often said that the judiciary is the least democratic part of the government, that it’s countermajoritarian. So what are the norms of democracy that say a President should not criticize the courts?! You might just as well call this purported norm a norm of anti-democracy.

Anyway… the weasel word is “recognized.” It takes all the oomph out of “all.” Trump’s speech about judges violates “all recognized democratic norms.” Who are the recognizers? The judges? Judges certainly have a role talking about democratic norms, which are often part of the determination of the scope of the judicial role: Judges refrain from doing what is left to the processes of democracy. But part of democracy is speech about government — which includes the judges — and that speech is not limited to flattering and deferring to them. It does not violate the norms of democracy to criticize and attack judges.

Bingo. And it is because of judges whot say these sorts of things that the President is not unreasonable to accuse the judiciary of  bias. Ann chose not to mention that this was also a “norm” breached by Barack Obama, more than once, but I will, the point not being “everybody does it,” but that to this judge and others, what Obama did was apparently only objectionable when Trump did it too—a common theme in the anti-Trump propaganda of the last three years. “I’m Baaaack….” Ethics Catch-Up, 11/1/2019: And Answer, A Rebuke, And A Shock

Rolled back into Alexandria last night, having had an uproarious response from the New Jersey Bar to the special Halloween edition of “Ethics Rock Extreme in Asbury Park seven hours earlier.  The group of lawyers demolished all previous groups for sing-along enthusiasm and prowess in the finale, “The Ethics Man,” a parody of Billy Joel’s “Piano Man.” (My colleague, collaborator and friend Mike Messer gets credit for their verve, I think, for he was in top form, delivering the various songs in hilarious impressions of Joel, Paul Simon, Bob Dylan, Johnny Cash, John Fogarty, and Bobby Pickett imitating Boris Karloff. among others.

I couldn’t get up the energy after the four-hour drive to get a post up last night, so the Ethics Alarms commentariat ended up holding down the metaphorical fort here for all of Halloween. I haven’t had a chance to read all of the comments, but thank-you, everyone. There were even some baseball ethics posts!

Still, there are a lot of ethics issues languishing in my absence. I’m fried, and there are also paying ethics jobs to do and promised to keep, so be patient with me, please.

1. An ethics answer to an ethics question. One Forum comment I did see was this one, from Sarah B.

I have an ethics question. The set up is a bit long, so please bear with me.

Imagine a small town where one out of every nine people works for the same company. Now, this company hires predominantly men, not because it is sexist, but because the work and positions available are more likely to be applied for by men. 9 out of every ten employees are male. In addition, it pays well enough that if a married man were to work in a salaried position, he could make enough money that his wife could stay home with the children if the couple displayed only a modicum of frugality. Thus, most stay-at-home mothers in the community have a husband who works for the same employer, usually in different stages of the chain of command.

Now, imagine that there was a low level supervisor and one of his subordinates. They are of similar ages and have similar values. Their wives are of similar ages and find each other to be enjoyable company. Their children are of similar ages and like to play together. Also, no one else in the supervisor’s area is of a similar age, value system, or time in their families. (No kids or college age kids)

Is it unethical for these two families to hang out socially? What if it is just the wives and kids, not the husbands? What about kids birthday parties, as the kids are friends?

I have heard both sides of this argument played out in my town, but often with both sides using some set of rationalizations from our host’s list. I’d like to hear a more educated opinion here.

Anti-Trump Hate Porn

I’ve written my quota of “resistance” ethics articles today I know, but I can’t help posting this one.

I was stuck in the DMV, and read a New York Times book review titled “Which Came First, Trump or TV?” The reviewer is Gary Shteyngart, who is described in biographies as a writer of satire. The book he reviews is “Donald Trump, Television, and the Fracturing of America” by James Poniewozik, the Times TV critic.

Both the positive review and the book it describes cannot be justified except as salacious efforts to slake the hate of the most Trump-Deranged among Americans. Poniewozik‘s book, described as non-fiction, is full of negative characterizations of the President, his thinking and his personality that are not justified by the author’s education, background, research or expertise. Poniewozik is a TV critic, and that’s pretty much all he has ever been. He has no special expertise or experience in politics or history; he is not a biographer; he isn’t a psychologist. This is his only book, and he is obviously using Trump hate to attract readers and sales, as well as positive reviews by writers who also have no qualifications to justify their getting the assignment. Both the book and the review are the product of bias, designed to foster bias.

Early in the review, we get this:

But Poniewozik, the chief television critic of this newspaper, uses his ample comedic gifts in the service of describing a slow-boil tragedy. If humor is the rocket of his ICBM, the last three years of our lives are the destructive payload.

Everything is terrible! Where have I heard that Big Lie before? I would have stopped reading right there, but you know: Department of Motor Vehicles.

The New York Times Reveals That It Will Move On From Its Three-Year “Trump Stole The Presidency By Colluding With Russia” Strategy For Undermining Him To A “Trump And Republicans Are Racists” Strategy For Defeating Him In 2020

How else can we interpret the opening statement by Times editor Dean Baquet in a recent staff meeting? Someone surreptitiously recorded the 75 minute question and answer session and leaked it to Slate, which put it all online. It begins with this (emphasis mine):

Dean Baquet: If we’re really going to be a transparent newsroom that debates these issues among ourselves and not on Twitter, I figured I should talk to the whole newsroom, and hear from the whole newsroom. We had a couple of significant missteps, and I know you’re concerned about them, and I am, too. But there’s something larger at play here. This is a really hard story, newsrooms haven’t confronted one like this since the 1960s. It got trickier after [inaudible] … went from being a story about whether the Trump campaign had colluded with Russia and obstruction of justice to being a more head-on story about the president’s character. We built our newsroom to cover one story, and we did it truly well. Now we have to regroup, and shift resources and emphasis to take on a different story. I’d love your help with that. As Audra Burch said when I talked to her this weekend, this one is a story about what it means to be an American in 2019. It is a story that requires deep investigation into people who peddle hatred, but it is also a story that requires imaginative use of all our muscles to write about race and class in a deeper way than we have in years. In the coming weeks, we’ll be assigning some new people to politics who can offer different ways of looking at the world. We’ll also ask reporters to write more deeply about the country, race, and other divisions. I really want your help in navigating this story.

But I also want to [inaudible] this as a forum to say something about who we are and what we stand for. We are an independent news organization, one of the few remaining. And that means there will be stories and journalism of all kinds that will upset our readers and even some of you. I’m not talking about true errors. In those cases, we should listen, own up to them, admit them, show some humility—but not wallow in them—and move on. What I’m saying is that our readers and some of our staff cheer us when we take on Donald Trump, but they jeer at us when we take on Joe Biden. They sometimes want us to pretend that he was not elected president, but he was elected president. And our job is to figure out why, and how, and to hold the administration to account. If you’re independent, that’s what you do. The same newspaper that this week will publish the 1619 Project, the most ambitious examination of the legacy of slavery ever undertaken in [inaudible] newspaper, to try to understand the forces that led to the election of Donald Trump. And that means trying to understand the segment of America that probably does not read us. The same newspaper that can publish a major story on Fox News, and how some of its commentators purvey anti-immigrant conspiracies, also has to talk to people who think immigration may cost them jobs and who oppose abortion on religious grounds. Being independent also means not editing the New York Times for Twitter, which can be unforgiving and toxic. And actually, as Amanda Cox reminds me, doesn’t really represent the left or the right. [inaudible] who care deeply about the Times and who want us to do better, we should listen to those people. But it is also filled with people who flat out don’t like us or who, as Jack Shafer put it, want us to be something we are not going to be.

The transcript is long, and while I recommend reading the whole thing,  not everyone has sock drawers they can neglect. The unavoidable take-away is that the Times and its staff, mirroring the American Left of which it is bulwark, is obsessed with race as well enamored of the tactical advantages race-baiting it confers in the ideological struggle for control over the levers of government power.

WAKE UP!

Oh, great: started this post at 7 am, hell broke lose at ProEthics, and now it’s after noon. Well, the hell with it: I’m not going back to change the headline or the intro, and I like Lenny’s version of the Stars and Stripes at any time of day.

So there.

1. Unprofessional and dangerous stuff from  Above the Law….as usual. The legal gossip and snark online tabloid is run and written by lawyers who are not practicing law, so they feel free to engage in conduct that lawyers are forbidden from engaging in, like misrepresentation.  Lately the cyber rag has been cyber-ragging on Jones Day, a long-time, distinguished D.C. mega firm. Why are they doing that? Come on, it should be obvious.

ATL takes the position—and it has company— that Jones Day is eeeevil and must be shunned because it represents the Trump campaign. Hence you get headlines like “IF YOU HAD TO GUESS WHICH FIRM WOULD DO THIS:New allegations claim Jones Day lightened the skin and narrowed the nose on the picture of one of their lawyers.” Continue reading →

Afternoon Ethics Purge, 7/25/2019: Snopes, Maddow, Gratuitous Disrespect For POTUS…Yuck.

Prepping for a colonoscopy, thanks…ethically, of course…

1. Great Moments in Confirmation Bias. Believe it or not, this is what Rachel Maddow said about the Mueller testimony:

“I will tell you, I was not quite sure what to expect from today’s testimony by Robert Mueller. If you had told me that today, we would get from Robert Mueller over the course of these seven hours such a blunt accounting from him… of who in the president’s campaign was compromised by Russia, and how, specifically how they were compromised by Russia, including the President…All in all, just look at today as a whole, it was a remarkable day, not just for this presidency but for the presidency. I know the Trump White House and conservative media are trying to, like, chin up tonight, make it seem like they had a great day today… they did not have a great day today.”

How in the world could anyone watching the hearings say that? How can anyone, realizing that this the way she translates reality into her commentary every night, continue to waste their time and brain cells watching her? How could responsible executives at a news network hear that and not take remedial action, if they have any regard for journalism as all? This is literally fiction, or delusion, or the perception of someone from a parallel universe who somehow crossed over (in that universe, Mueller didn’t answer questions almost exclusively with “yes,” “no,” “repeat the question,” “that’s outside my purview” and “bvuh?!”) Wrote Jonathan Turley about Maddow’s rhetoric, ”

“That is like calling the Hindenburg disaster a rough landing. Gone is any notion of informing viewers of what actually occurred and its implications for impeachment calls. Instead, viewers heard what they expect from echo journalists: assurance that Trump remains on the ropes and the Democrats are laying a trap.”

The Great “Les Miz” Bait-And-Switch

“Les Misérables,” the bloated faux opera based on the Victor Hugo novel, has been running continuously in London’s West End, the theater district, since December 1985.  It holds the Guinness World Record for the longest run of a musical in London. In the U.S., the musical held on for a somewhat less embarrassing  16 years, running from 1987 into  2003, closing after 6,680 performances.

It was always a cynical project, as so many Broadway musicals have become since the genre became a nostalgic invalid in the 1970s. The show itself is derivative crap, and obviously so to anyone who has a passing familiarity with its superior sources. The translated from French lyrics have the resonance of Hallmark cards; there literally isn’t a clever or memorable pack of words in the whole three hour extravaganza. What “Les Miz” has, or rather had, is spectacular stagecraft, thanks to the original staging by Trevor Nunn that mounted the series of scenes on a massive raked turntable that allowed quick transition and the illusion of excitement. The musical didn’t exactly disprove the old Broadway saw that “Nobody leaves the theater humming the scenery”—the TV ad jingle-like earworms in the score assured that—but it came close.

When I saw the touring company version of the show, I realized immediately that the production could never have a life in high school, college, community theater or even in regional professional theaters, because the turntable, and the special effects it permitted, were essential to the production. Not only are stage turntables extremely expensive, they are notoriously risky, since a mechanical breakdown means the performance must be cancelled. Sure enough, after the Broadway production closed in 2003, there were no productions of the show other than the three professional touring companies owned by the Broadway producers.
