The Ethics Incompleteness Theory, The Bigot Doctor,”The Hader Gotcha,” And The Apology Scale

Yes, she actually has both arms. She’s also photogenic: the Democrats should nominate her for Congress.

I christened the Hader Gotcha last year after several athletes were forced to apologize for youthful social media comments that suggested a bigoted or insensitive state of mind. The ethics Alarms position on people looking through old social media posts to embarrass public figures and force them to grovel apologies to which ever group their comments offended was summarized in this post in the moderate, calm manner for which I am justly praised:

As I have written here before, searching for lingering social media idiocy that an athlete authored before he could drink or vote is despicable conduct, as is anyone making an issue of  what the deep Twitter dives expose. First, what a baseball player said or thought—they are often not the same thing—in the past has nothing to do with his job, which is playing baseball and not making social policy, and second, nothing anybody says or even does before their brain has matured should be held against them in adulthood, unless it is criminal, and even then the law urges us to be forgiving. I know that a lot of social justice warriors think that any racist, sexist or homophobic comments made post birth should be treated a crimes, but they are anti-democratic nuts, and hostile to free thought and speech, so to hell with them.

That post was largely ignored, because too many readers here still fail to grasp that ethics issues arising in baseball often, indeed usually, have broader wisdom to convey. Since I wrote it, the employment of the Hader Gotcha has been expanded outside the realm of sports, most notably the recent example of Kevin Hart, the popular comic who was attacked the very day he was designated as the host of the upcoming Oscars. Ethics Quiz: Pronouns

 

(Why am I up writing at this hour? All I will say is that its is unwise to frustrate a Jack Russell Terrier. That’s all.)

Peter Vlaming, a high school teacher in West Point Virginia, refused to use the pronouns demanded by 9th grade student who had announced that she was a female transitioning to male, was fired this week.  The West Point School Board fired him after a four-hour hearing, and its position was that Vlaming was fired for insubordination.

Some news reports on the matter fail to note that there was no allegation that the  West Point High School French teacher insisted on referring to the student using female pronouns in class. Apparently he used her name only. No, he apparently slipped when when the student was about to run into a wall, and Vlaming told others to stop “her.” When discussing the incident with administrators, Vlaming said he would not use male pronouns, because  his Christian faith prevented him from doing so.

Principal Jonathan Hochman testified that he ordered  Vlaming to use male pronouns in accordance with the student’s wishes. Vlaming’s attorney, Shawn Voyles, says his client offered to use the student’s name and to avoid feminine pronouns, but Voyles says the school was unwilling to accept the compromise.

“That discrimination then leads to creating a hostile learning environment. And the student had expressed that. The parent had expressed that,” said West Point schools Superintendent Laura Abel. “They felt disrespected.” Although the school’s  policies were updated a year ago to include guidance regarding gender identity,  gender pronoun use was not included. Vlaming’s attorney argues that the school cannot require his clients to speak words that violate his conscience. This is undeniably true. Vlaming says he is being fired for for having views held by “most of the world for most of human history. That is not tolerance,” Vlaming said. “That is coercion.”

He has not decided on his next steps.

Yikes. I do not see how speaking words that are not blasphemy can qualify as a breach of faith. I do not see how calling a student by name rather than pronoun can be called discrimination or create a “hostile environment.” I do see how a teacher calling an apparently female student by male pronouns could confuse other students, suggest that gender is more flexible than it is healthy to believe, and be something parents could legitimately object to. I think that the First Amendment pretty clearly prevents a government institution like a school from demanding that a teacher use specific pronouns simply because a student wants him to do so, when using the opposite pronouns are still arguably accurate and the teacher is willing to use the student’s name only.

I think that’s sufficient background to ask this perplexing Ethics Alarms Ethics Quiz question of the day:

Was it ethical for the teacher to refuse to use the student’s preferred pronouns in referring to that student?

Fire Lisa Mars

I usually hesitate to call for anyone to be fired, though there have been exceptions. In this case, however, the call is mandatory on ethical grounds. It is unethical for a school dedicated to the arts to hand oversight to an gross incompetent who doesn’t comprehend the arts she is supposedly responsible for teaching; it is unethical for someone to take on this responsibility who is wildly unqualified for the job; and it is unethical for that individual to act in a way that undermines the mission of the school she heads.

I have just fairly described Lisa Mars, currently the principal at the Fiorello LaGuardia High School, the high school “of music, arts the performing arts” made famous in the movie and TV show, “Fame.”

On opening night of a school production of “The Sound of Music,” she ordered all Nazi-themed props and set pieces struck. They are offensive, you see. Never mind that the show is set during Germany’s take-over of Austria as the Third Reich was expanding. Never mind that Nazi Germany and its officers are major elements in the plot, or that the plot is based on the real-life escape of the singing Von Trapp family from the Nazis. Never mind that theater is a representational art form. Stage deaths are not real killings, stage rape isn’t really rape, stage racism isn’t really racism, and stage representations of Nazi symbols do not promote fascism. Most grade-school actors can grasp this basic principle, but not the head of a school for the performing arts.

“This is a very liberal school, we’re all against Nazis,” one sophomore said. “But to take out the symbol is to try to erase history.” Yes, that too. “Obviously the symbols are offensive,” he added. “But in context, they are supposed to be.”

Mid-World Series Hangover Ethics Warm-Up, 10/27/2018: Mike Tyson, Intimacy Coordinators, And The Blackface Teacher Principle

This is how my morning began…

1. To get this out of the way..I watched every  second of every inning on last night’s longest post-season baseball game in history, as any loyal, ethical baseball fan is obligated to do. It was worth it, too, even though my team lost. The game was the sports equivalent of The Odyssey, “War and Peace,” “King Lear,” “The Ring Cycle,” “The Ring Trilogy,” “Nicholas Nickleby” or “The Seven Samurai,” a complex morality and adventure tale that had suspense, disappointment, wonder, exhilaration , humor and tragedy, heroes and villains. Such games reward all of the time and suffering a fan puts into following baseball seriously. It is worth the investment.

Ironically, this epic occurred shorty after the Wall Street Journal published a truly ignorant and idiotic opinion piece called , “Our Insane Ideas to Save Baseball/Baseball has problems. There aren’t enough hits. There are too many pitchers. The games take too long. So we bullpenned our solutions. Are you ready for Strike Four?”

It is a wonderful example of the incompetent variety of criticism I call “Wanting to change what you haven’t taken the time to understand.” I get it: the authors don’t like baseball, and barely pay attention to it., or, in the alternative, they are just seeking clicks. In any event, you can’t argue with people who say that the problem with opera is that it’s too often in a foreign language, or that the problem with hip hop is that it isn’t music, and shouldn’t, or that the problem with our democracy is that people can say things that upset other people. And you shouldn’t argue with them. They don’t respect the topic enough to be educated about it.

2. Of course, baseball games ARE too long, and the overwhelming reason is TV ads, which add about a half hour to every game, and more to post-season games. The disgusting response of Fox is to stick 10 second commercials into a split screen during the game, like between batters. Here’s a slugger walking to the plate in a tense situation, and half the screen is devoted to a quickie plug for “Ralph Breaks The Internet.” I hope fans are burning up social media attacking this greedy new form of broadcast pollution.

3. How is this possible? In a #MeToo Mad era when simply being accused of sexual assault without proof is deemed by even lawyers who should know better as sufficient justification to inflict serious and permanent consequences on the accused, Mike Tyson is the star of an animated TV show, is cast in movies, and is now shopping a TV show, based on the ex-boxer’s life as a marijuana grower and marketer, starring him and called “Rolling With the Punches.” Continue reading

Ethics Observations On The Megyn Kelly “Blackface” Fiasco

You know, one could make a strong argument that the misadventures of a richly compensated  morning TV host is not worth thinking about, arguing about, or even paying attention to. The problem is that in trivial events vital enlightenment often reside. We ignore the Megyn Kelly mess at great risk. There are many ethics lessons there.

The Megyn Kelly fiasco started long before her self-immolation over the now-radioactive topic of Halloween costumes, but let’s begin there. In case you missed it (that is, you have a life), Kelly was using her special segment of the “Today Show” to moderate a round-table discussion of how, as she put it,  “the costume police are cracking down” on Halloween costumes. The former Fox News host and Donald Trump irritant decided to emulate the President and blunder into a political correctness minefield.

“What is racist?” she mused. “You do get in trouble if you are a white person who puts on blackface on Halloween, or a black person who puts on whiteface for Halloween. Back when I was a kid, that was O.K., as long as you were dressing up as a character.” Then she talked about the travails of Luann de Lesseps, a member of the cast of the Bravo reality show “The Real Housewives of New York,” who was criticized for dressing up as Diana Ross, complete with skin-tone.  Megyn found the criticism  passing strange.

By the end of the week, Kelly had issued a tearful on-air apology and others on social media. She had been condemned by “Today” colleagues and NBC News chairman Andrew Lack, went even further at a midday staff meeting, saying,“There is no other way to put this, but I condemn those remarks.There is no place on our air or in this workplace for them.”

Then NBC announced that “Megyn Kelly Today” was cancelled, and so was Kelly’s 19 million dollar a year employment, subject to the result of negotiations between her lawyers and NBC’s.

From The Ethics Alarms “Now What?” Files: The Hopeless Dallas “Cop Shoots Black Neighbor” Tragedy

I could easily put this story in the Ethics Alarms Zugzwang file, because I see no analysis or result that won’t make the situation worse.

A white off-duty police officer named Amber R. Guyger  entered the apartment of  Botham Shem Jean, a 26 year old accountant, and fired her service weapon twice at him, killing the St. Lucia immigrant. She claims that she mistakenly entered the wrong apartment after returning home from her 14-hour shift and believed  Jean, who is black, was an intruder.

Indeed, her apartment was directly below his. She had inexplicably parked her car on the 4th floor, where Jean’s residence was, rather than the 3rd floor, where hers was. So far, there is no indication that the shooter and the victim knew each other. Guyger had a clean record. Other facts are in dispute. The officer told investigators the apartment door was  ajar and then fully opened when she inserted her computerized chip key. That seems possible but unlikely.  Lawyers for  Jean’s family say the door was closed. How could they possibly know that?  Guyger said in court documents that when she opened the door,  she saw shadows of someone she thought was a burglar, and shouted commands before shooting. Lawyers for Jean’s family have elicited testimony from neighbors that they heard someone banging on the door and shouting, “Let me in!” and “Open up!” before the gunshots.  Why would the officer do that if she didn’t know Jean, or if she thought it was her own apartment? They also said they then heard Jean, say, “Oh my God, why did you do that?”

Boy, that sounds like an awfully convenient exclamation to be remembering now, don’t you think? But who knows? Maybe it proves the two knew each other. (Why didn’t Jean say, “Who are you?”) Maybe it is another “Hands Up! Don’t shoot!” lie for cop-haters and race-baiters  to adopt as a rallying cry. Continue reading

Morning Ethics Warm-Up, 8/27/2018: Petards, Conflicts, And Bullshit Edition

Good Morning!

1. Oh no! Hoisted by my own petard! I’m pretty certain that Clinton fixer Lanny Davis has an unwaivable conflict of interest in his representation of Trump fixer Michael Cohen. The legal ethics establishment is soft-peddling the issue because most legal ethicists apparently hate President Trump more than they like ethical lawyering, but I’ve been wrestling over whether to file a disciplinary complaint. The problem is that any complaint that has even a tinge of political motivation won’t be touched by the Bar (if prior performance is any indicator), so a complaint by me would be the proverbial lonely tree falling in the forest. The remedy would be to issue a publicity release about the complaint, but I’ve criticized that tactic as unethical right here, on more than one occasion. Rats.

It might be just as well. After the mere hint that I was defending Donald Trump (I was not) on NPR appears to have gotten me blackballed there after many years as an ethics commentator, I probably should not criticize the lawyer for the most popular sleaze in D.C. these days.

2. Neil Simon Ethics. In an alternate universe, my still operating professional theater company, dedicated to keeping unfairly buried, forgotten or unfashionable American theater works of the past in front of audiences who deserve a chance to see them, is looking at a lot of Neil Simon productions. The works of the —by far—most successful writer of comedies in Broadway history are already sneered at as sexist and “outdated,” and I can vouch for the fact that all it takes is one militant female board member with a checkbook and a chip on her shoulder to kill a production. Remember S.N Behrman? Seen any Philip Barry plays lately? How about Kaufman and Hart? Simon just died, and he’s already heading to obscurity along with those guys, and most of their plays are still funny too.

3. Here’s another topic it’s dangerous to get intoFrom CBS:

A pregnant Washington state woman said she was fired via text message from a sub shop where worked, with a store manager telling her “it’s not a good time to have somebody who is leaving for maternity leave in several months anyway.” Kameisha Denton told CBS Seattle affiliate KIRO-TV that she had told the manager she was pregnant and due in December, asking for maternity leave.

Denton said she realized that she hadn’t been assigned shifts at Jersey Mike’s sub shop in Marysville, Washington, so she sent a text to her manager inquiring about the hours. The response she says she received was shocking.

When Denton asked for her “updated schedule” she received something a bit different. The store manager named only as “Marcos” in Denton’s phone responded, “I am sorry to inform you but it’s not going to work out with Jersey Mikes. It’s not a good time to have somebody who is leaving for maternity leave in several months anyways. You also failed to tell me this during your interview.”

Denton posted the exchange on Facebook in a post that had garnered over 1,000 shares in just two days.  

Denton told KIRO-TV,  “I was just like in shock, it took me a minute to face reality — I was like this is really happening.”

Morning Ethics Round-Up, 8/13/2018: Rally? What Rally? Bias? What Bias? Texts? What Texts? Spy? What Spy?

Huh. I didn’t know that ZZ Top were white supremacists!

Good Morning!

I just know this week will be better than last week…

…though these items certainly don’t inspire hope.

1. The dangers of “future news” That huge, scary rally in Washington where the nation’s capital was going to be descended-upon by all those white supremicists activated by Donald Trump’s election and rhetoric to celebrate last year’s Charlotteville riots? About two-dozen people showed up. I talked to friends in the District who said they were terrified of the rally. CNN, the networks, the Times and the Post had all headlined this major, major event, which would show just how much racism there is in America. This was fake news, straight up. It was imaginary, “future news,” a headline about what was going to happen because the mainstream news media wanted it to happen. Then they could bleat out the narrative that President Trump was inspiring racists to come out of the woodwork. Maybe someone would get killed, like in Charlottesville! Well, they could hope.

What investigation went into the determination that there was going to be a huge gathering of racists in D.C.? Clearly, not enough. 24? 24??? I could set up a rally of locals who think Gilbert and Sullivan should be taught in the schools that is five times that with some phone calls, texts and a Facebook post. It would take me a couple of hours. Yet the Times put the inevitability of this massive white supremacy rally on its front page. “After weeks of hype…” wrote the Times. Weeks of hype by the press.

Incompetent, dishonest, irresponsible. You know. As usual.

It is worth mentioning that the counter-demonstration to the imaginary demonstration was many times larger than two-dozen people.

2. In related news about non-news...The Boston Globe has been contacting newspaper editorial boards and proposing a “coordinated response” to President Trump’s criticism of the news media, especially his controversial “enemy of the people” rhetoric. “We propose to publish an editorial on August 16 on the dangers of the administration’s assault on the press and ask others to commit to publishing their own editorials on the same date,” The Globe said in its pitch to fellow papers.

Talk about bad timing! We just had the explosion of the fake racist rally story. We have the Manafort trial being featured on the front page of most newspapers like it’s the O.J. trial, when  the majority of public has no idea who the man is and the trial details have nothing to do with anything newsworthy. We have the mainstream news media giving the claims of a reality show villain the kind of attention John Dean received for his Watergate testimony while it makes sure nobody knows that a Chinese spy infiltrated the staff of a powerful U.S. Senator for 20 years. Nah, the news media isn’t the enemy of the public! It just deliberately abdicates its duty to inform the public objectively , is engaged in a coordinated effort to bring down an elected President, has abused its First Amendment-bestowed immunity from the consequences of its conduct, and is working to divide the nation to the point where it cannot function. That’s all. None of this is good for the people or the nation, but that doesn’t make those intentionally harming both enemies, exactly….although off the top of my head,  I can’t think of a more accurate word for it. Flipping Off The President, And Proud Of It (With A Poll!)

Remember Julie Briskman? She flipped off the President’s motorcade in  November, and was so proud of that eloquent statement that she posted a photo of her gesture on Facebook. He company, A government contractor, promptly fired her. I wrote at the time,

Flipping a middle figure to the President’s motorcade is protected speech. Flipping said finger to the President when one works for a company dependent on government contracts and plastering photos of one doing this on social media is not what I would call wise, and Julie Briskman should have reasonably expected her employers to admonish her to keep the company’s public image in mind the next time she was tempted to bite the hand that feeds it. Akima LLC, however, a Virginia-based company, fired her.

They have every right to do this, but it was a gross and cruel over-reaction. Worse, the company wasn’t even honest about its rationale,telling her that company policy forbade an employee having  anything ‘lewd’ or ‘obscene’ on your social media. Sure. “The finger” is undeniably rude. Obscene it’s not.

But Julie doesn’t read Ethics Alarms (obviously!), and sued for wrongful termination. Last week, Virginia judge Penney Azcarate judge dismissed Briskman’s wrongful termination claim. Her lawyers had claimed that Briskman’s employers violated public policy by forcing her resignation.

As I said, I don’t think the company was particularly fair to Briskman, who is young and like most of the resistance, lacks judgment and proportion. I doubt that anyone would take it out on her employers that they employed a rude and immature jerk as a marketing analyst. It need not have fired her. Still, Virginia is an employment at will state where you can be fired for having an obnoxious laugh. As Ethics Alarms has held here frequently regarding professors who post racist rants on social media and episodes like that of Adam Smith, the so-called Chick-Fil-A Video Vigilante who verbally abused a Chick-Fil-A employee and posted the video of him doing so, companies have every right to regard an employee whose public behavior embarrasses their employers as a liability, and to treat them as such. It isn’t kind, and it isn’t compassionate, but as I wrote about Smith,

“I can’t blame anyone who doesn’t want to be represented by a man whose judgment was this wretched and who is best known for bullying an innocent minimum wage employee because he didn’t like her boss’s take on gay marriage. Actions have consequences, and while the cumulative effects of the foolish and damning video have been excessive, no individual component of it is. Someone should be kind, obey the Golden Rule and give Smith a shot at redemption, but no one individual is ethically obligated to do so. Smith’s sad fate, which extends to his family, is still his own doing, and he alone is accountable.”

Morning Ethics Warm-Up, 7/6/2018: I See Unethical People…

Good morning, everyone!

1. Good, but better if it had happened six months ago. Ethically-challenged EPA chief Scott Pruitt finally “resigned” yesterday.  He was actually fired, and President Trump should have fired him as soon as it became clear that his pal couldn’t break himself of the bad habits he developed as a lawyer and a politician, including taking advantage of his position for personal gain. There were 14 separate investigations of Pruitt’s conduct, and his continued presence with Trump’s leave undermined the President’s pledge to “drain the swamp.” As several wags said with utter accuracy, Pruitt personified the swamp, but Trump does not place ethics or avoiding the appearance of impropriety high on his list of priorities, and never has. Pruitt’s conduct was also as stupid as it was wrong. He was a villain of the environmental Left, and had bullseyes and laser targets metaphorically covering his body. In such a situation, a prudent individual knows that he or she must be otherwise beyond reproach. Not Pruitt!

The National Review neatly summed up his demise:

“EPA administrator Scott Pruitt had enemies who were out to get him because he is a Republican, a conservative, a high-ranking member of the Trump administration, and an environmental deregulator. But it wasn’t liberals, the media, or deep staters who made him get large raises for his top aides, deny that he knew about it, and then admit that he did. It wasn’t they who made him have an aide find him a discount mattress, or run sirens so he could get to a French restaurant on time. The aides who told journalists, or congressional investigators, or both about Pruitt’s misbehavior weren’t all or even mostly liberals or deep staters. Several of them were conservative Trump supporters who were disturbed by Pruitt’s behavior and thought he was serving both the president and taxpayers poorly. Some of them had come with Pruitt from Oklahoma because they believed in him. The more they saw him in action in D.C., the less they did. Today it caught up with him.”

Good riddance.

2. Wait, haven’t we seen this movie before? Many commenters here expressed skepticism at the accusation that GOP Congressman Jim Jordan had turned a blind eye to sexual abuse  of student wrestlers when he was an assistant wrestling coach at Ohio State almost 40 years ago. Indeed the timing of the story looked like a political hit job, and it may be one whether the allegations are true or not. But now, as I noted in the first post about the controversy, the issue is Jordan’s denials. They rang false to my trained ear, and now there are four former wrestlers who say Jordan knew a team doctor was abusing the students.

It’s still their word against his, but it doesn’t matter. My position, as in the Harvey Weinstein mess, as in cases where fathers are molesting daughters, and in the Penn State scandal and so, so many others, is that those close to the situation either knew or should have known, and often deliberately avoid “knowing.”  Even if Jordan didn’t know, he should have and could have, and if he immediately accepted responsibility when the issue arose, he might have preserved some level of trustworthiness. He didn’t. They never do.
