A dolphin died in New Jersey’s South River last year, so a blogger sought to discover what killed it. She duly filed a public record request to the NJ Department of Agriculture for the results of the dolphin’s autopsy.The Department turned down her request, on the grounds that it violated the amended Public Records Act, which includes an exception for HIPAA information, including diagnosis and autopsies:

Dolphin privacydolphin privacy 2That’s right: New Jersey wants to protect the dolphin’s privacy. No, there is no dolphin autopsy exception to New Jersey’s law, and no cetacean privacy inclusion in HIPAA. On the off-chance that it isn’t obvious, Louis Bruni is an idiot.

This should be funny, I guess, but my patience with fools and dolts making life more difficult, expensive, inefficient and frustrating has about run out. My rapidly developing theory on crazy people starting to shoot other, thus-far less crazy people is that constant contact with the Louis Brunis of the world drive them to it, when combined with hopelessly bewildering technology and outrageously complicated rules, laws, regulations and procedures and the brazen dishonesty and corruption of so many of the “public servants” who are pledged to care about our welfare.

One day a delicate soul, their sanity on the ragged edge, makes a simple request, not even in an important matter, and are foiled by someone who thinks Dead Flipper has privacy rights, and who nonetheless has his salary paid by taxpayers. Out of the millions and millions of Americans who cope with this crap every day, day after day, an infinitesimal percentage of the public can’t handle that one extra insult to logic and common sense. and snaps like a dry twig in the wind. Like Sweeney Todd, their now damaged mind concludes that there are two groups of human beings, those who make everyone else miserable because they are evil, stupid, or both, and those who are the first group’s helpless victims. “Kill them all!” the now deranged victims of our Brunis conclude: killing the miscreants is just, and killing their suffering victims is merciful.

And off they go.

Now imagine layer and layer of Brunis, up and down all levels of government, sometimes reaching executive levels with access to real power. You know, like Joe Biden. John Kerry. Michele Bachmann. No, don’t. We have enough crazy people all ready.

In Washington State, Not “Over-Incarceration,” Just Incompetent And Cruel Incarceration

Since 2002, the Washington State Department of Corrections (DOC) has allowed a sentencing-calculation glitch in its computers to allow more than 3000 inmates to walk out of prison before their sentences were complete. Now the state is rounding-up  ex-prisoners, in many cases after they have built back their lives, settled down, found jobs, and done all of the things, difficult things, former felons are supposed to do once they have paid their debts to society.

Last month, Governor Jay Inslee and DOC Secretary Dan Pacholke  revealed that incorrectly programmed computer software  had been  miscalculating release dates Washington convicts sentenced to extra prison for violence related to their crimes. Although DOC employees have been aware of the problem since 2012,an assistant attorney general advised against an urgent review, allowing the error, and the early releases, to continue for three more years as a software fix was delayed repeatedly. (Yes, there is an investigation.) Finally, a fix is supposedly in the works.

None of this was the fault of the prisoners who were released early, but they are the ones being made to suffer for it. Most of those who have been out for long periods are being left alone, according to the standards for review, but for those deemed to need additional prison time, the trauma is significant. The Seattle Times interviewed Miranda Fontenot, whose fiancé, James Louis, was taken into custody last week when he checked in with his community corrections officer. Continue reading →

The Unethical Web-Shaming Destruction Of Holly Jones

“I will never go back to this location for New Year’s Eve!!!” young Holly Jones ranted on an Indianapolis bar and restaurant’s Facebook page. “After the way we were treated when we spent $700+ and having our meal ruined by watching a dead person being wheeled out from an overdose my night has been ruined!” The angry post accused the evening’s restaurant manager of rudeness, the party’s waitress of profanity and the establishment itself of inattention.

After a sharp on-line rebuttal by the restaurant, the Web Furies were unleashed. Jones’ post became the latest web-shaming catalyst and an invitation to join a cyber-mob where fun could be had by all turning an ordinary jerk into a national villain. Lots of people signed up. The mob tracked down Jones and bombarded her own Facebook page with hate—she took the page down—then moved on to the salon where she worked as a hairdresser, threatening a boycott unless it fired Jones.

So it did.

These exercises in vicious web shaming can be ranked along an ethics spectrum. At the most unethical end is the destruction of Justine Sacco, who had her legitimate marketing career destroyed by social media’s  hysterical over-reaction to a self-deprecating, politically incorrect tweet. Now she works promoting a fantasy sports gambling website, a sleazy enterprise that entices chumps into losing serious cash with a business model derived from internet poker—she not only had her life derailed, she was corrupted too.

At the other end is Adam Smith, the one-time executive who wrecked his own career, with the help of another cyber-mob, by proudly posting a video of himself abusing an innocent Chic-fil-A  employee because Smith didn’t like her boss’s objections to gay marriage.  Somewhere between the two is Lindsay Stone, who lost her job by posting a photo showing her pretending–she later said— to scream at the Tomb of the Unknown Soldier while flipping the bird at the “Silence and Respect” sign.

The distance between Smith and Jones is the difference between words and conduct. Smith’s video showed him abusing a young woman, and his posting of the video indicated that he saw nothing wrong with it. Jones, in contrast, did nothing, other than prove herself to be, at least at the moment she posted her rant, an utter jerk. Everyone along the spectrum, however, including Jones, were excessively and unjustly harmed by the web-shaming  campaign against them. Last I checked, Smith was unemployed and destitute three years after his episode of atrocious judgment.

In the current case, the cyber-mob forcing Holly’s employer to fire her is ethically worse, by far, than anything she can reasonably be accused of doing by posting her criticism of the restaurant. Continue reading →

Observations On A Nauseating Development

Observation One: If you don’t see what’s nauseating about it, you are part of the problem. Here:

Top Obama administration  officials, including Denis McDonough, Obama’s chief of staff, Attorney General Loretta Lynch, FBI Director James Comey, Director of National Intelligence James Clapper, National Security Agency Director Michael Rogers, and White House Chief Technology Officer Megan Smith met in San Jose, California, with representatives of Twitter Inc., Apple Inc., Facebook Inc., and other Silicon Valley companies to seek ideas on how extremist content online can be identified and removed, as well as help creating alternative messages to counter terrorist recruitment methods using social media. You can be thoroughly nauseated by reading about the whole embarrassing fiasco here.

“The gathering took place as Obama announced a new counterterrorism task force to thwart extremists and their use of social media after recent deadly attacks in Paris and San Bernardino, California. The task force will organize federal efforts into several areas, including research and analysis, technical assistance, communications, and programs to help prevent radicalization, according to the Homeland Security Department.”

Every now and then, and it is never on a post that I am especially keen on or that I expect to catch fire, a link to an Ethics Alarms essay is suddenly being clicked on by a lot of people who have no interest in ethics, but a particular interest in a topic I happened to stumble into, as I am wont to do. Usually these waves of traffic contribute nothing of substance to our ethics colloquy, produce no new regular readers, and  they depress me, as did the so-called “Instalanche” of a few years back when Glenn Reynolds deigned to link to a post.  A bigger group of nasty right wing jerks I have never encountered before or since: I lost a bit of respect for Professor Reynolds that day (His avid followers maintained it was ethical to spread a web rumor that Harry Reid was a pederast in retribution for Reid’s “Romney hasn’t paid taxes” lie. It’s not.)

The current ‘-lanche’ has arrived courtesy of my post of a couple days back about an unlabeled hoax study published by The Journal of Evaluation in Clinical Practice, a (formerly) respectable scientific journal. Of the few new readers who have commented, most have distinguished themselves by making the typical threadbare rationalization used for all web hoaxes, to wit:  “Anyone who didn’t figure out it was a gag isn’t as smart as I am.” If these people typify the ethical acumen of scholarly journal readers, we have trouble my friends, right here in River City.

See, Brilliant Advanced Degree-holders, the problem with respectable journals (if there are such things) publishing inside jokes without proper labeling is that the false studies are read and believed by journalists, who spread the misinformation like an oil slick over the culture and public consciousness. It doesn’t matter if you got a chuckle out of it; what matters is that a lot of people were made to believe false information, and it is the purveyors of that false information, not the oh so gullible and ignorant victims of it, who are at fault. Rick Jones, whose blog has been a past award winner at Ethics Alarms and who is also a much-cherished commenter here, has posted the nominees for his annual “Curmie Awards” (his blog is, after all, Curmudgeon Central.) The Curmies are “presented to the person or persons who most embarrass the profession of educator.”

This time, only one of his nominees were the objects of posts on Ethics Alarms. Following is the list of finalists; then go here to read more of Rick’s riffs on the nominees, and to recoil in horror at Rick’s dishonorable mentions, like the  Texas high school that “not only painted Christian zealotry on the corridor walls, they used made-up quotations from the likes of George Washington and Ronald Reagan to do it.” (I’m really sorry I missed that one.)…

1. …Gustine ISD in Texas, where Principal Alan Luker faced a rather unique problem: someone was leaving feces on the gym floor. So, naturally, a couple dozen 4th and 5th graders were carted off to separate rooms for girls and boys and made to drop their pants….

2. … Harrisburg (PA) Sci-Tech High School, where an (of course) unnamed Assistant Principal threatened senior Alexus Miller-Wigfall with suspension for wearing a dress that was “too revealing” to prom…apparently motivated by the fact that Ms. Miller-Wigfall has “more boobs than other girls,” who “have less to show.” (More boobs? Two aren’t enough for this girl?) [Ethics Alarms post here.]

3.…The State Education Department in Florida, which devised a testing apparatus whereby students who got perfect scores on a standardized test actually hurt their school and their teacher by not improving on the previous year’s perfect score. How often does this happen? Actually, tens of thousands of times annually. Yes, there’s a provision that allows districts to correct the record, and indeed the problem might have been fixed by now, but the mere fact that the default position was to punish teachers and schools for not improving on perfection tells us everything we need to know about the corporate-driven lunacy that now infests public education. [ I omitted this initially, finding it so incomprehensible that I, I don’t know, thought Rick was having a stroke or something. He assures me it’s real.]

Update On Hillary’s Stupid E-Mails: She Lied, Of Course.

Once Bernie Sanders, Hillary Clinton’s fake competition for the Democratic nomination, declared twice during televised debates that since the public was “sick of hearing” about Clinton’s stupid e-mails, most of the news media decided that it had permission to stop covering the issue. That serves the public interest badly, of course, since the public has a right to know whether a woman presuming to become President of the United States either 1) lied in to  face of the public by stating outright that she never sent or received classified material on her illicit private e-mail server, 2) was unable to recognize what was obviously classified material, thus placing it at risk on an unsecured server, and/or 3) has the technological acumen of an Irish Setter. An old Irish Setter.

More than 1,200 emails from Hillary Clinton’s private server during her time at State have now been deemed classified, after the agency publicly released its eighth batch of the messages late Thursday.

On New Years Eve, the State Department released roughly 5,500 more containing more than  1,200 e-mails culled from the private account that Clinton exclusively used while Secretary of State. What’s More Unethical Than A Web Hoax? How About A Scientific Journal Hoax?

The Journal of Evaluation in Clinical Practice, a respected scientific journal, published a supposedly peer-reviewed study in its current issue finding that kisses from mommy are not an effective way of remedying children’s boo-boos. Several news outlets fell for the hoax, including The Daily Caller.

“Maternal kisses are not effective in alleviating minor childhood injuries (boo-boos): a randomized, controlled and blinded study“ described the results of research allegedly conducted on 943 pairs of toddlers and their mothers and designed to determine whether a kiss from a child’s mother after a minor injury significantly reduced the child’s distress.

There were plenty of red flags in the study beyond its ridiculous subject matter. For example, the “researchers” wrote that they intentionally constructed scenarios in which children would hurt themselves. In one scenario, the authors claimed that they placed chocolate in an area where a child would bump his head trying to reach the chocolate. In another, they said that the researchers placed a child’s favorite object behind a heated coil so the child would burn herself trying to access the object. Continue reading →

Columnist Malpractice On The Tamir Rice Tragedy

This is not how police saw Tamir Rice before he was shot, but never mind: the objective is to inflame public opinion, not to accurately convey what happened and why.

Washington Post reporter Lonnae O’Neal found herself compelled by the Tamir Rice grand jury decision to write the kind of irresponsible column for the paper that can be written but shouldn’t be written—not by a professional journalist, not when public passions are inflamed, not when complex and entangled issues need analysis, careful words, perspective and wisdom. It is an emotional scream of pain and frustration, unleavened by objectivity, fairness or restraint. Such columns do much damage, and no good. Such columns are destructive. I hope writing it relieved her pain, but that’s not justification enough.

I was alerted to the kind of column it would be  by its first sentences:

A 12-year-old black boy walks into a Cleveland park, plays with a toy gun and, within seconds of arriving, a police officer shoots him dead. His partner tackles the boy’s 14-year-old sister as she rushes to his side, handcuffs the girl and shoves her into a squad car, helpless, as her brother lay dying.

If we want to accurately describe the event that ended  Tamir Rice’s life so prematurely from the perspective of people who loved him, and of people mourning the senseless death of a child, those who read about the boy’s death and want to cry to the skies, “Why? How can this happen?,” then that is a defensible beginning….maybe.  That is not her intent, however. The intent of her column is to indict “the system” for not indicting the officer who shot Tamir Rice. With that intent, the description is a lie, a manipulative appeal to pure emotion that willfully and negligently makes the system, which is not and must not be based on emotion, incomprehensible.  Continue reading →

Just One Simple Question, Really: How Many Dishonest, Deluded, Shameless or Incompetent State Department Employees Had To Pass On This To Allow It To be Published?

A just-issued report on State Department’s 2015 accomplishments, written by spokesman George Orw…I mean, John Kirby, includes a section headlined with this:

“Bringing Peace, Security to Syria”

It really does. No, really.

It also includes a section titled, “Iran Peaceful Nuclear Program Ensured,” which is untrue and ridiculous ( nothing of the sort is “ensured”), but to be fair, the State Department apparently believes this. Even John Kerry can’t believe that the State Department has brought peace and security to Syria.

Could he?????
