Thirteen Ethics Observations On The GOP’s Letter To Iran

Letter to IranFrom the Washington Post:

“An already heated battle between the White House and Republicans over negotiations to curtail Iran’s nuclear program grew more tense Monday when 47 Republican senators sent a letter to Iran designed to kill any potential deal.

The White House responded by accusing the Republicans of conspiring with Iranian hard-liners, who oppose the delicate negotiations, and suggesting that their goal was to push the United States into a military conflict.”

Observations:

1. The letter cannot be defended as anything other than an effort to sabotage sensitive international negotiations. As such, it is direct interference with the President’s ability to do his job. The fact that Republicans, like Israel, have abundant evidence that President Obama is likely to do that job, in this case, badly and even dangerously is no justification for this unethical, unconstitutional, arrogant and offensive act. The American people elected Obama president, and with that came the authority to conduct foreign affairs and oversee negotiations with foreign governments. The letter is wrong in every way.

2. It does not matter, and should not matter, to any American whether or not they believe that a breakdown in negotiations with Iran would be preferable and safer than the kind of deal this President is likely to produce. It does not matter. The letter is per se a breach of the separation of powers, and as precedent, endangers the nation’s entire governance structure.

3. Anyone who defends this atrocious, reckless and unprofessional conduct is fully embracing “the ends justifies the means” as a principle of democratic government.

4. If he was not aware of it and did not approve it, Republican Senate leader Mitch McConnell is obligated to condemn this action, and punish all signatories,  stripping them of committee assignments related to foreign affairs.

Hillary’s E-mail Ethics Breach: The Only Questions Are 1) “How Can Anyone Trust Her?” and 2) “Is there Nothing Her Supporters Won’t Excuse?”

“Hillary Rodham Clinton exclusively used a personal email account to conduct government business as secretary of state, State Department officials said, and may have violated federal requirements that officials’ correspondence be retained as part of the agency’s record. Mrs. Clinton did not have a government email address during her four-year tenure at the State Department. Her aides took no actions to have her personal emails preserved on department servers at the time, as required by the Federal Records Act.”

I don’t know why the Times says “may have violated.” Her exclusive use of personal e-mail does violate the rules, and in fact the law, as the Times correctly states in the final sentence. Moreover:

1. This is a blatant example of Clinton again refusing to abide by rules and laws other officials are required to abide by. As the Washington Post notes, it was intentional: Clinton’s personal account was established on the same day that Clinton began her confirmation hearings to be Secretary of State., and the expiration on the domain is shortly after the 2016 election. The Ethics Of Netanyahu’s Speech and the Consequences Of Lost Trust

One of my knee-jerk progressive Facebook friends is addicted to terrible analogies. Here is his recent attempt to frame the controversial appearance by Benjamin Netanyahu before Congress today:

“At the invitation of Speaker Yuli Edelstein, President Barak Obama will appear before the Israeli Knesset on Thursday to give a major speech on the Netanyahu adminstration’s bungling of the Palestinian conflict, territorial abuse to build settlements, and allocation of US foreign aide…”

What’s wrong with that? You have three seconds.

Time’s up. That is a lousy analogy, because the positions of the U.S. and Israel are not accurately reversed as a good analogy would demand. If Netanyahu was appearing before Congress to lecture it on U.S. policies regarding illegal immigration over the Mexican border, that would justify my friend’s hypothetical. What Netanyahu is here to talk about, however, is the future of his people and his nation, not ours.

As I wrote here about a month ago, there is no question that this is a breach of diplomatic protocol, nor is there any doubt that Congress is defying tradition, separation of powers and probably the Constitution to invite the Israel Prime Minister to, in essence, lobby the public regarding the President’s conduct of foreign policy. Congress’s actions are objectively unethical, a calculated tit for the President’s equally unethical tat of using executive orders to circumvent the lawmaking process. This episode is ethically more complicated than that, however, and when the criticism is doled out, other ethical considerations and principles are relevant.

I am drowning in important ethics topics and short of time, so I’m reluctantly employing the rarely-used (here) flotation device of briefly noting three stories that would normally warrant full posts. I’ll reserve the right to change my mind and fully explore one or more of them later.

1. Wait: who’s the journalist here?

Six days after Ethics Alarms noted the ridiculous fact that the IRS has hired—for about 5 million dollars of taxpayer money— the same group of incompetents who botched their 800 million dollar job of getting Healthcare.gov up and running, the Washington Post ran the story (on page 18). The new contract itself dates from August: I regard my nausea over it as late, but I regard the Post’s failure to report the story until now a) suspicious, b) incompetent and c) indefensible.

Dark and Brooding Thoughts

White House chief of staff Denis McDonough suffered a slip of the tongue Sunday when he offered the first name of an American woman held hostage by the Islamic State of Iraq and the Levant.

In an interview with host George Stephanopoulos on ABC’s “This Week” about the ongoing situation with a Japanese hostage held by ISIL, McDonough mentioned the woman’s first name, which is not public knowledge.

No, Politico, this is not a “slip of the tongue.” McDonough was appearing on a full slate of Sunday morning shows, and he had certain objectives and parameters which, as a professional and a high-ranking advisor to the President of the United States, he was bound and obligated to be competent to fulfill, or he should not have accepted the assignment. There weren’t that many of them. One was not to reveal the name of an ISIS hostage, and he couldn’t do that. He was not properly prepped, or trained, or focused on his assignment.

It’s not because “anyone can make a mistake.” Professionals do not make such mistakes, and if they do, they are in the wrong profession. This occurred, as so, so, SO many other fiascos have, because this entire Administration is led by, staffed by and advised by hyper-partisan incompetents who learn nothing, understand nothing, and place the interests of the United States at constant risk; because a culture of arrogant incompetence has been allowed to flourish under the abdication of journalists to call it to account; and because the potential critics whose allied philosophies would make them the most effective voices to call for accountability are too biased, cowardly, or lacking in integrity to do so.

You can’t trust our national leadership. If you do, you are a fool. This has nothing whatsoever to do about policies, parties, or loyalty.

As I ponder this, I am trying to understand the character of a man who could preside of over such a incompetently staffed and managed administration and still deliver the defiant, dishonest, destructive and divisive speech he gave to the Congress last week.

That may be a futile effort. But I doubt that I  can continue to muster respect for those who continue to offer excuses and rationalizations for this ongoing tragi-comedy of unapologetic ineptitude rather than to face reality and try to help the nation survive the next two years.

That’s what I’m thinking tonight.

I wish I weren’t.

It’s STUPIDITY SATURDAY, Celebrating That Fascinating Nexus Between Dumb and Unethical! First Up: The IRS Picks A Contractor

Perusing the many ethics issues that have slopped into my inbox, I realized that a fascinating theme was developing: wanton, willful, inexcusable stupidity. Being stupid is not intrinsically unethical, for in many cases it is a malady, a Nature-dictated state like being short or bald, just one that is more limiting than most. Being stupid and allowing yourself to be placed in a position where your stupidity will harm others, however, is unethical.

Incompetence is not the same thing as stupidity necessarily, but it is a kind of stupidity and it generates stupidity: stupid risks, stupid decisions, stupid statements, stupid policies, stupid results. The recent Pew study showing that the two most common descriptions of President Obama were “good” and “incompetent” was intriguing on that issue. A man can be both “good” and “incompetent,” but a leader cannot. Obama can be a good man (though after hearing his defiant, dishonest, petulant and self-destructive State of the Union address, I find that hard to believe), but he cannot be a good leader while being an incompetent one.

The President is incompetent, and the incompetence has, as it always will with those serving under incompetent leadership, metastasized throughout his administration into incontrovertible stupidity of a sort that it is unethical for a leader to tolerate or allow to continue. Yet he does.

This brings us to the IRS. Believe it or not, just even months after federal officials fired the firm CGI Federal for its botched work on the Obamacare website Healthcare.gov, the IRS awarded these same bunglers a $4.5 million IT contract for its new Obamacare tax program.

Five Ethics Observations On The US’s Paris March Snub

In case you didn’t catch it, more than 40 world leaders joined the start of a Paris march for unity against terrorism and for freedom of speech, linking arms in a demonstration of solidarity. Even Netanyahu and Abbas were there! The Paris march may have included more than 1.6 million marchers before it was done, reportedly the largest demonstration ever. More than three million have now marched across France in response to the deaths of 17 resulting from extremist attacks in Paris last week, beginning with the executions of the staff of the satirical newspaper, “Charlie Hebdo.”

You would expect, and I am sure that the world expected, that the United States of America, reputedly the leader of the free world and the nation that most symbolizes the human right of free speech, would have participated in the event with enthusiasm, conviction, and prominence. But no. President Barack Obama did not come to Paris to join with his fellow world leaders. He did not send Vice President Biden either. Though Attorney General Holder was in Paris, he was not directed to attend the march, and did not.  The United States was only represented by its ambassador, who is not a world leader, and whose job it is to attend routine functions large and small.

Initially the criticism of the obviously intentional snub was muted, with the toadying mainstream news media, as has been its standard operating procedure since 2008, acting and speaking as if there was nothing amiss. Fox News, also as usual, was the exception, but since that network is isolated and pigeon-holed as a reflexive Obama critic “no matter what he does,” this was initially ignored as more right-wing carping. Then, to his great credit, CNN’s Jake Tapper took to Twitter to say  that he was “a little disappointed personally” at the lack of a strong U.S. presence, and in a later statement, escalating to saying that he “was ashamed.” He then wrote in an opinion piece…

“I find it hard to believe that collectively President Obama, Vice President Joe Biden, Secretary of State John Kerry, Secretary of Defense Chuck Hagel, Treasury Secretary Jack Lew and Attorney General Eric Holder — who was actually in France that day for a conference on counterterrorism — just had no time in their schedules on Sunday. Holder had time to do the Sunday shows via satellite but not to show the world that he stood with the people of France?

There was higher-level Obama administration representation on this season’s episodes of “The Good Wife” on CBS.”

2014 was the year of the Ethics Train Wreck. They were coming so fast that they were getting tangled up with each other, and old wrecks from past years started rolling again, or the damage that was triggered a year ago or more started kicking in. I don’t know if every year really is more ethics free than the year before, or that it just feels that way because I’m getting better at sniffing it out. By any standards, it was a wretched year, with epic ethical misconduct across the culture. But I can’t stall any more: let’s wade into it. There will be more installments this year, so the misery is coming in smaller bites. You’re welcome.

The Ferguson Ethics Train Wreck and The Obama Administration Ethics Train Wreck

The obvious winner is the Ferguson Ethics Train Wreck, which has managed to hook up with the 2012 winner, The Trayvon Martin- George Zimmerman Ethics Train Wreck, as well as a the sub-EthicsTrain Wreck attached to the death of Eric Garner, to further degrade U.S. race relations, undermine the stability of numerous cities, get several people, including the recently assassinated NYC police officers killed, revive race riots, give vile demagogue Al Sharpton unprecedented power and influence, and pick up such distinguished riders as President Obama,  Missouri Governor Jay Nixon, New York Mayor de Blasio. It is also still barreling along at top speed after many months, and is a good bet to continue its carnage well into 2015. 

Yet, it became clear to me this summer with this post that the entire Obama Administration has become an Ethics Train Wreck, and one that is neck-and-neck with the one spawned in Ferguson in threatening short and long-term damage. Incompetence, dishonestly, lack of transparency and arrogance have hardened cynicism in the public, corrupted the ethical values of defenders, let journalists to disgrace themselves, and fertilized festering potential disasters internationally and domestically. This is also, I now see, a wreck of long duration that started in 2009, and had gathered momentum with every year. It also has sparked other wrecks, including the one that now keeps it from being the sole 2014 winner. How much damage will The Obama Administration Ethics Train Wreck do in 2015? Which agency or department will prove itself to be corrupt, incompetent and mismanaged, which official will continue in a post after proving himself unfit to serve, which inept pronouncement or abuse of power will further degrade American trust and freedom?

I’m not looking forward to learning the answers.

Fraud of the Year

The U.S. Justice Department, which allegedly participated in a plot to force  Sierra Pacific Industries and other defendants  to pay $55 million to the United States over a period of five years and transfer 22,500 acres of land as settlement of charges brought against the company by DOJ for causing a 2007 wildfire that destroyed 65,000 acres of land in California. Naturally, the national news media has barely covered this scandal, which is still in litigation. Runner Up: The Victoria Wilcher scam, which made KFC pay for plastic surgery for a little girl when there was no evidence that the company was in any way involved with her injuries. News Item:

Up to 30,000 missing emails sent by former Internal Revenue Service official Lois Lerner have been recovered by the IRS inspector general, five months after they were deemed lost forever. The U.S. Treasury Inspector General for Tax Administration (TIGTA) informed congressional staffers from several committees on Friday that the emails were found among hundreds of “disaster recovery tapes” that were used to back up the IRS email system.

The announcement of the existence of the potentially incriminating emails—-that I.R.S. officials kept swearing were lost, a statement that every computer expert asked about it said was ridiculous—-was made, and the emails turned over, Friday afternoon, while everyone was freaking out over the President’s immigration order and the impending Ferguson grand jury decision. It also occurred well after the recent election, so if the communications do prove a coordinated effort within the Obama administration to illegally sabotage conservative groups prior to the 2012 election, there will be no electoral consequences to Democrats, and, as we all know, stupid voters can’t remember things like this for another two years.

Bazinga.

With More Evidence Of Pre-Election Obama Administration Sleight-of-Hand, I Ask Again: How Do Democrats React To This?

The post is intended to follow-up on this one, asking supporters of the President who are unbiased, fair and honest, how they continue to trust this administration in light of the repeated pattern of hiding negative developments as long as possible, assisting the compliant news media in burying them, and intentionally delaying admissions, disclosures and bad news until after elections.

It is not a partisan question, but a legitimate ethics inquiry. As I explained in discussing the recent election eve Fast and Furious document dump, there is not any legitimate question about whether this is ethical conduct by the Obama Administration, or whether it is in any way consistent with the pledge of transparency made by Candidate Obama in 2008 and currently posted on the White House website. It isn’t, on both counts. There is no argument about that—I know that. What I don’t understand, and very much want to, is why anyone—Democrat, progressive, Federal worker, journalist, MSNBC hack, Markos Moulitsas, Harry Reid, anybody at all—would excuse or try to justify it sufficiently to say “Yes, I trust these people.” I asked, and nobody took up the challenge.

Is it because everyone actually realizes how inexcusable and sleazy this is, and nobody trusts the Administration any more? That can’t be it: otherwise, I wouldn’t be reading all these amazing blog posts about columns about how stupid the American voting public was to send an emphatic “We’re sick of the Democrats” message at all levels of government, across states of all political persuasions. Is it because all the Obama supporters are in the throes of  DODD (Desperate Obama Defense Derangement)? I suppose that’s possible. It is also possible that Obama defenders are gun-shy here, since their standard refrains of “Republicans are obstructing everything,” “it’s all Bush’s fault,” “everybody does it,” “it’s because he’s black,” and “nobody’s perfect” not only fail to persuade but attract well-deserved derision.

I don’t know the answer, but I want to understand, Trust is the basis of democracy, and trust must work both ways. The Obama Administration consistently shows that it does not trust the American public to approve of its policies and conduct if the public has timely information about what the facts are. Why do so many people trust a leader who doesn’t trust them, and has contempt for its trust?
