Jeff H, along with Tim LeVier and Glenn Logan, represents the longest commenting ethics observers on this site, their participation going back to the old Ethics Scoreboard. It is always a special pleasure to welcome one of them to a Comment of the Day honor, for, like all who venture into the comment wars, they have done a great deal to provide lively, perceptive and useful content here, and I am more grateful than I can express. (Jeff, a cartoonist, also contributed the drawing of Muhammad as cute Teddy Bear you will periodically see in the side header.

OK. Here’s what I think:

I am the sort of person who thinks a person is whatever they feel they are inside. People like to talk about, ‘well, a transperson will never really be a woman” or whatever. I’ve not got much time for that. I ain’t got it in me to judge people for something like that. As I said to someone who was talking about the ‘perverts’ who dress like women, “Far as I care, I ain’t going to say you’re wrong. You are whatever you say you are. You say you’re a toaster, I’ll give you two pieces of bread.”

That also means that I think that a transperson should use the bathrooms they’re comfortable with. The notion that there are creeps purposely crossdressing to get into the ladies’ room seems basically fictitious. Even if it was true, unless it was to a gigantic density, I don’t see that as a legitimate reason to force them to use a bathroom they’re not comfortable with.

(It’s been going around, but there have been three Republican congressmen arrested for inappropriate conduct in men’s rooms, and they say no transpeople have been arrested for the same. I hope it doesn’t turn out that is HAS happened, but if it had… I think someone would have brought it up by now.)

So this is where I stand on the issue of the transgendered. I try to be as permissive and accepting as possible without being dismissively so. I’m not likely to budge on this, since most of the arguments against it seem similar to the anti-homosexual arguments most of us reject on sight.

Having said this… if Mack is really, in his heart of hearts, a male… then I don’t understand what possible pride he can take beating a bunch of girls at a sport when he’s ALSO taking performance-enhancing drugs. (Aside from everything else, I don’t really care if you have a legitimate reason to take steroids; I think you shouldn’t play competitive sports if you have to take them because they self-evidently give an unfair advantage.) Mack Beggs is a competitive wrestler at Euless Trinity High School, and also is a biological female more than a year into the process of “transitioning” to male.  Beggs just won his third consecutive girls’ wrestling tournament victory in the 110-pound weight class. I’ll call him “he” because that is what the student wants to be called, and he, in great part due to the male steroid treatment he has been undergoing,  is now 55-0 on the season. All of his opponents have been high school girls who are not taking steroids, and unlike Mack, do not intend to become, for all intents and purposes, male.

While Beggs says he wants to wrestle in the boy’s competitions,  the University Interscholastic League rules use an athlete’s birth certificate to determine gender, a measure that makes sense in most cases, just not this one. (See: The Ethics Incompleteness Principle) The rules prohibit girls from wrestling in the boys division and vice versa, and rules are rules. If you are a rigid, non-ethically astute bureaucrat, you follow rules even when you know that they will lead to unjust, absurd results, like Mack’s 55-0 record in matches.

The  rules also say that taking performance enhancing drugs like the testosterone that has given Beggs greater muscle mass and strength than his female competitors is forbidden, but  UIL provides an exception for drugs prescribed by a doctor for a valid medical purpose. After a review of Beggs’ medical records, the body granted him permission to compete while  taking male steroids—compete as a girl, that is.  Rules are rules!

One athletic director, after watching Beggs crush a weaker female competitor who left the ring in tears,  asked for his name not to be used as he commented to reporters, and opined that “there is cause for concern because of the testosterone,” and added, “I think there is a benefit.”

Really going out on a limb there, sport, aren’t you?

Ethically, Caster Semenya Points Us Directly To Gender-Free Sports Competition, And There Is No Ethical Way To Avoid It

Ethics Alarms first mentioned female runner Caster Semenya in this essay , when the international sports community was debating the South African track champion’s fitness for competition. Caster, depending on who you believe, is either a woman, intersex, a woman with freakishly high levels of testosterone in her body, or a man who identifies as a woman. What is undeniable is that she is faster than most women, and maybe all of them, and her unique physical make-up, whatever you want to call it, gives her an advantage. Since the last Olympics, Caster has been forced to take drugs that inhibited her body’s production of testosterone.Then, in July 2015 , the Switzerland-based Court of Arbitration for Sport overturned the 2011 IAAF regulations that restricted testosterone levels in female athletes. They also suspended hyperandrogenism regulations for two years. Now Semenya will be able to compete as she is naturally, and because she will, she is widely expected to smoke the competition.

Is it fair to let her run? Is it fair not to let her run? After this year of controversy and confusion over gender, with boys and men “identifying as women” and transgender discrimination laws roiling the culture wars, this is a perfect time for an intersex champion. Then, presumably, all hell will break loose. A sports scientist tells The Guardian,

“I’m actually dreading the Olympics. People only want to hear a good story so when Semenya wins gold the South African media will go crazy. If she breaks the world record, which I think she will, it’ll be even crazier. You can lie and say: ‘Happy days. Let’s celebrate our golden girl’ – which the politicians and media want. Or you can be honest and principled and say: ‘Actually, there are many things we need to address.’ That’s very unpopular”

Society and sports have reached the point  the ethical solution is obvious and unavoidable, and, unfortunately, brutal. If society is accepting the fact that a binary gender distribution is a myth, and there may be seven, ten, or dozens of gender variations along a spectrum, then integrity and consistency—and fairness—demands that gender distinctions in sport be eliminated as arbitrary. Comment of the Day (And Response): “MORE Gender Issues Confusion Monday, PART 3:The New York Times’ Hit Piece On Donald Trump And Women”

I am late posting this provocative and wide-ranging comment from repeat-Comment of the Day author Chris Marschner. Chris attempts to explain, and even defend, the unwillingness of  Donald Trump supporters to find literally any misconduct or verbal outrage sufficient reason to reject him. On the way, he touches on affirmative action, SNAP, voter ID laws, the transgender bathroom controversy, and more.

I’ll have some substantial comments at the end. for for now, here is Chris Marschner’s Comment of the Day on the post, MORE Gender Issues Confusion Monday, PART 3:The New York Times’ Hit Piece On Donald Trump And Women:

[Commenter Humble Talent] stated, “Pundits don’t understand why saying dumb things about women or minorities doesn’t skewer him. I do: His voters don’t care. His voters don’t care where people pee, they don’t care how many abortions the lady down the street gets, they don’t care about racism, sexism or whatever-phobias. They care about taking care of their families. They care about jobs. This is the demographic Bernie and Trump tapped into. People not like us. Uneducated people. People living day to day. Bills to pay and mouths to feed, when nothing in the world is free.”

First let me say that I find Trump’s rhetoric distasteful and I did not vote for him in the Maryland primary.

Labeling all Trump supporters as “uneducated and unlike us” may be too simplistic. Actually many do care where people pee or how many abortions take place. You might want to consider that it is just a matter of priorities when faced with the possibility that a progressive candidate like Hillary Clinton might get elected leading to further stagnation of their upward mobility while forcing them to succumb to even more government intrusion into their lives.

Perhaps there is also a group of educated voting taxpayers who are tired of being labeled as social misanthropes when engaging in reasonable debate over a variety of issues. Many well educated people who earn more than the median income but less than that which is necessary to be absolutely financially independent understand the economic repercussions of challenging some progressive ideas that are at odds with their own reasoned thinking. How exactly does a conservative faculty member debate a topic when he/she runs the risk of being labeled a racist, Uncle Tom, misogynist or other type of person in what could be called the “Hater” segment of society for not towing the employer’s or the group’s normative thinking. How many business owners publically regurgitate the progressive ideology or opt for a low profile to avoid the onslaught of protesters that can threaten that which they may have spent a lifetime working long hours to build

I could also argue that many private corporate cultures are an outgrowth of weighing the economic pros and cons of taking an ideological stand and often opt for the culture that prevents further costly governmental intrusion into their operating policies. Only a few have challenged the government’s desire to dictate corporate culture and policy.

Your Ethics Alarms Cognitive Dissonance Guide To The Planned Parenthood Shooter Spin Game

Cognitive DissonanceTo the left is a simplified version of Leon Festinger’s Cognitive Dissonance Scale. Most of the people and institutions who use the scale to mislead and manipulate public opinion neither know this diagram nor have heard of Dr. Festinger, but it is what they are employing in the daily wars to win ideological political converts by distorting the significance of current events.

Robert Dear’s as yet unexplained shooting rampage within a Colorado Springs Planned Parenthood facility has immediately created an opportunity for cognitive dissonance manipulation. Festinger’s research showed that our minds will always try to resolve dissonance when something with a high, or positive score—say, “Free Speech,” appears to be closely associated with something else that is low on the scale, such as “hateful speech.” How the dissonance is resolved will depend on the scores of the two dissonant objects or beliefs.

If you want the public to decide that something it approves of is less worthy of approval, attaching it to something the public believes is reprehensible will do the job by creating cognitive dissonance and pulling the well-regarded object down the scale. If you want the public to move its opinion of a person, organization or concept from negative territory into positive, identifying someone or something the public regards far more negatively who opposes the person, organization or concept will tend to move the object of the negative entity’s opposition upward on the scale. In these situations, the mind seeks distance from the reviled entity. I hate broccoli; I learn that Donald Trump hates broccoli; I don’t want to have anything in common with Donald Trump. Pass the broccoli, please.

The latter is the process repeatedly applied by the protesters of police shootings when African Americans are the victims. The public correctly opposes abuse of power and wrongful violence by law enforcement officials; it is far below the mid-point on the scale. It also a opposes criminal activity and resisting legitimate law enforcement. With rare exceptions, every black victim of a questionable police shooting was engaging in or had engaged in criminal activity, and had resisted arrest. These have been criminals, but because the alleged misconduct of the police is far lower on the scale than the criminal activity involved, the criminal victims are propelled by cognitive dissonance into the scale’s positive territory. (The media assists the process by publicizing the most benign images of the victims they can find. The most frequently used photo of Laquan McDonald, who was executed by a Chicago cop, shows him in his high school graduation gown, for example. The cop didn’t shoot a criminal who refused to stop when ordered to, he shot a smiling young man with a bright future. The police officer is thus a monster; the victim a martyr and a hero.)

The standards of acceptable Halloween costuming, as you might have predicted given the catalyst President Obama has given to extreme restrictive political correctness, keeps evolving to the hypersensitive and the restrictive. The issue is easier with children’s costumes: children’s masquerades should be age-appropriate; they should not be manikins for their parent’s senses of humor or political views, and as long as they are in the spirit of horror movies, the criticism of those who don’t understand horror movies should be jeered at or ignored. The major controversies arise now over adult costumes. The Girl Scouts Face Corruption By A Rich, Cruel, Horrible Person

Fortunately, they knew what to do.

Last May the Girl Scouts made news when they announced a new policy of acceptance for transgender girls.  The policy was reasonable and case-by-case based, but the policy is secondary to the story. What matters is that the organization adopted it as consistent with its mission.

Last month, a $100,000 donor sent the Queen Anne offices of the Girl Scouts of Western Washington a note demanding that the chapter “guarantee that our gift will not be used to support transgender girls. If you can’t, please return the money.” The $100,000 was about 25% of the group’s yearly fundraising goal, and would have been used to send about a 500 indigent girls to camp.

Council CEO Megan Ferland returned the donation, telling the donor “Girl Scouts is for every girl. And every girl should have the opportunity to be a Girl Scout if she wants to.” Of course she did. A non-profit organization cannot put a price tag on its mission and its integrity. This would be like St. Jude’s Hospital accepting a huge donation in exchange for allowing a black child to die of cancer. It would be like a a women’s college’s board of directors cutting a profitable deal with an outsider to close the school down, just to pick a wild hypothetical out of the air. It is the equivalent of treason, selling out one’s nation, or taking money to betray a family or a friend who trusts you. Continue reading →

Speech And Thought Control At CUNY

A responsible parent has an ethical duty to pull their child out of any university that does  something like this.

“Effective Spring 2015, the (graduate center’s) policy is to eliminate the use of gendered salutations and references in correspondence to students, prospective students, and third parties,” Louise Lennihan, interim provost, states to employees in a recent memo. “Accordingly, Mr. and Ms. should be omitted from salutations.” Lennihan instructs staffers to interpret the new policy “as broadly as possible,” that it applies to “all types of correspondence, such as: all parts of any letter including address and salutation, mailing labels, bills or invoices, and any other forms or reports,” states the memo, a copy of which was provided to The College Fix by school spokeswoman Tanya Domi. Rather than using “Mr.” or “Ms.,” staff are instructed to refer to students by his or her full name. The policy will “ensure a respectful, welcoming, and gender-inclusive learning environment … [and] accommodate properly the diverse population of current and prospective students,” Lennihan states in the memo.

Now, I almost never use these salutations any more. “Mr.” has always seemed pompous to me, and now it reminds me of the New York Times with its tradition of calling the President “Mr. Obama.” (Over the weekend, the Times garnered guffaws for calling Wisconsin Governor Scott Walker “Mr. Scott” throughout an op-ed. Nice editing there). “Miss” seems condescending, “Mrs.” is a minefield, and “Ms.” sounds ugly while being both dated and unwelcome from some women. (Once I called a women “Ms.” and she barked at me, “Do I look like a dyke to you???”) And I hate being called Mister myself. All of the is irrelevant, It is not any university’s business to enact speech codes, banned words, or other undemocratic and ideologically driven attempts at censorship and speech control. Who approved the playing of Aerosmith’s “Dude Looks Like A Lady” over photos of convicted Wikileaks leaker Bradley Manning in uniform and in feminine make-up and garb? Fire him.

This isn’t professional, and it isn’t the proper role of journalists to mock the gender identity issues of public or private individuals. Fox is playing to the worst of its core conservative audience, the gay- and trans-hating troglodytes, and thus embraces bigotry as reasonable and humorous. Manning’s sexual problems are of tangential news value, and to the extent that they are, they should be treated with sensitivity and respect, with Fox’s goal being to educate its audience, not to play playground tease.

It would be impressive and appropriate if one of the more responsible, independent Fox on-air personalities—Shep Smith? Megyn? O’Reilly?—would chide their network for this. They should be embarrassed.

Old Don, Dawn, New Don

Let me begin by saying that I have no idea what is going on, was going on or will be going on with ABC producer Don Ennis. Unless he has the worst sense of humor in the world, whatever it is isn’t good, or anything I would wish on someone else. I am, to a point, sympathetic. However, if I were his employer, I would tell Ennis today that he will have to work out his unusual identity issues somewhere else, and I believe that would be the right thing to do. It may not, however, be the legal thing to do, which is one of approximately 268 reasons I’m glad that I am not Mr. Ennis’s employer.

Not that it wouldn’t be exciting. If you hadn’t heard, last May Don Ennis, a well-respected ABC News editor and previously unambiguously male, entered his newsroom wearing a cute black dress and an auburn wig and announced to a stunned staff, colleagues and superiors that he was transgender. The ABC News national assignment editor said he was forever more to be known as Dawn Stacey Ennis. “Please understand,” he said in a statement, “this is not a game of dress-up, or make-believe. It is my affirmation of who I now am and what I must do to be happy, in response to a soul-crushing secret that my wife and I have been dealing with for more than seven years, mostly in secret. A father of three, “Dawn” announced that the newly-confirmed she was separating from her wife of seventeen years.

His colleagues were supportive, as was everyone else in the media, which is why you probably hadn’t heard the story. They left flowers on Dawn’s desk; ABC News President Ben Sherwood wrote her a note of support. I would have done likewise. This is a real problem, and exactly the kind of personal, medical crisis that the workplace ought to accommodate, while providing emotional support for the difficult and courageous transition. Thus Ennis continued to work at ABC sporting hormone-induced breasts, make-up, lipstick, skirts and heels. This undoubtedly caused a period of adjustment and awkwardness, but I would expect mature professionals to handle it gracefully.

Today, we learned, along with ABC, that Ennis has had a change of heart, and almost everything else. In a jaw-dropping e-mail to family and co-workers  titled “Not Reportable, Very Confirmed,” Ennis explained that he was Don Ennis again. “That will be my name again, now and forever. And it appears I’m not transgender after all.” Continue reading →
