Ethics Train Wreck Analysis: The Richard Jewell Case

“Richard Jewell,” Clint Eastwood’s excellent but much maligned film about a historical episode with many ethics twists and turns, is extremely accurate and fair in all respects, except for the glaring exception of the screenwriter  Billy Ray’s representation that reporter Kathy Scruggs obtained the information that Jewell was under suspicion by the FBI in exchange for one night stand with the agency’s lead investigator. This was the point where the Richard Jewell Ethics Train Wreck of 1996 acquired a car containing the 2019 movie “Richard Jewell.”

Let’s look at those other cars.

I. Jewell

Jewell was a socially awkward, lonely, obese man who lived with his mother. He was in many ways a stereotypical misfit with low  self-esteem, who developed ambitions about becoming a law enforcement officer, a job that would would provide him with the respect and power that he lacked and wanted. The film begins with Jewell’s stint as an office supply clerk in a small public law firm, where he becomes friends with attorney Watson Bryant. Jewell quits to pursue his dream of becoming a law enforcement officer, and Bryant, in saying good-bye, asks his friend to promise that if he ever acquires the authority he seeks, he won’t become a jerk, and abuse it.

This was a real life conversation. Bryant recognized that Jewell was a border-line Asperger’s sufferer, whether or not he knew the name or the clinical condition, and exactly the kind of personality who should never be given a shield and a gun.

Jewell took a job as a campus security officer at Piedmont College, and rapidly realized Watson Bryant’s worst fears by reacting to his authority by abusing it, being over-zealous and generating an unusual number of complaints from students. Jewell was fired, but the need for security personnel at the upcoming Atlanta Olympics gave Jewell another chance at some authority at least. He probably shouldn’t have had such a chance. Jewell was not a man who should have been in the security field or the law enforcement field; his judgment was poor, and his emotional problems made him a bad risk.

Thus the conditions for the ethics train wreck were put in place. It was up to moral luck whether hiring Richard Jewell would turn out to be a disaster, or a  fortunate near miss. Instead, it turned out to be something else entirely, a classic example of a bad decision having a good result—at least for a while.

2. The Bomb

In the early morning of July 27, 1996, Jewell, now working in Atlanta’s Centennial Park as part of the Summer Olympics security force, noticed an abandoned backpack by a bench. Over-zealous, officious and a fanatic about following procedure, Jewell insisted on reporting the pack as a “suspicious package,” despite the chiding of his colleagues, who wanted to take it to Lost and Found. If, as was overwhelmingly likely, the backpack had been just a backpack, Jewell probably would have been mocked. But again moral luck took a hand. He was right. It was a bomb. Jewell and other officers began clearing the area, and the bomb went off, killing one victim, Alice Hawthorne, and wounding many, still  far less serious damage than what might have occurred had Jewell not been so scrupulous in his discharge of his duties.

How I Boarded The “Richard Jewell” Ethics Train Wreck

It is unusual to see an ethics train wreck continue to  roll along to the extent that it affects the movie about the ethics train wreck, but that was what happened with the Richard Jewell saga. Remember the definition of an ethics train wreck: an episode in which virtually everyone who becomes involved in it, however tangentially, becomes entangled in ethics mistakes and misconduct. The  “Richard Jewell” Ethics Train Wreck (or the Richard Jewell Ethics Train Wreck) even yanked me on board.

I’ve already written about the film, directed by Clint Eastwood and a 2019 holiday bomb (no pun intended). My focus then was on the single unethical feature of the screenplay, its unfair portrayal of the real-life Atlanta-Constitution reporter, the late Kathy Scruggs, who broke the FBI leak that the security guard who had become a national celebrity by detecting the deadly pipe bomb that had exploded at the 1996 Atlanta Olympics  was suspected of making the bomb himself. Though film reviewers usually register few rejections when films smear the deceased in pursuit of a more compelling narrative, “Richard Jewell’s” claim that Scruggs traded sex for the leak walked into the #MeToo buzzsaw, and on that basis alone, Clint’s movie was trashed  by reviewers and pundits alike.

Me Too, and I hadn’t seen it. I wrote in part,

I strongly doubt the average viewer passed on the film because it may have been unfair to a dead reporter. Who had the genius idea that releasing a film about the press’s abuse of a strange, sad, fat man played by an unknown actor would be a Christmas season hit? I had no interest in seeing the movie, and I’m an admirer of Eastwood and will cheer on any further proof of how rotten our journalism has become, but why pay to see the news media falsely try to destroy a security guard in 1996 when the same institution has been trying to destroy the President of the United States for three years?… So the news media was incompetent and vicious to Richard Jewell? That’s supposed to get me to the movie theater?

Nevertheless, let me be clear: I hate what the movie did to Kathy Scruggs, just as I detest it every time an individuals can’t defend themselves are lied about in a movie, misleading audiences and scarring their reputations….

Unless Eastwood had strong evidence that the reporter was trading sex for information, he should not have used her name. He owes the Scruggs family an apology, and I’m glad his movie is tanking.

Movie Flop Ethics, Part I: “Richard Jewell” And The Alleged ‘Female Reporter Trading Sex For Scoops’ Smear

The two big flops among movies that opened last weekend were director Clint Eastwood’s “Richard Jewell” and “Black Christmas,” the second attempt to re-boot the 1976 slasher cult film. Both disasters have ethics lessons to teach, or not teach. Let’s look at Clint’s movie first.

“Richard Jewell” made lass that $4.5 million in its first weekend, and has also been snubbed by the various year-end awards. It is based on the now mostly forgotten  story of how Jewell, initially hailed as a hero for his part in foiling the 1996 Atlanta Olympics bombing plot,  was falsely accused  of complicity by local law enforcement, the FBI, and the news media. Conservative outlets loved the film, but the other side of the divide focused on a subplot, as the film’s screenplay  suggested that a named Atlanta Journal Constitution reporter, now deceased,  used sex to persuade a source to break the story.  The Journal Constitution has been attacking the film, denying that Kathy Scruggs would ever used he body to get a scoop. Her colleagues, friends and  family all insist that she would not have slept with a source, and reporters around the country circled the metaphorical wagons to proclaim they were shocked–shocked!—that anyone would even suggest such a thing. Jeffrey Young, senior reporter for HuffPost tweeted,  “The lazy, offensive, shitty way screenwriters so often treat female journalists infuriates me. Depicting women using sex to get stories is disgusting and disrespectful. It’s also hacky as hell. I was planning to see this movie but not anymore.’ Melissa Gomez of the Los Angeles Times wrote,  “Hollywood has, for a long time, portrayed female journalists as sleeping with sources to do their job. It’s so deeply wrong, yet they continue to do it. Disappointing that they would apply this tired and sexist trope about Kathy Scruggs, a real reporter.’ Susan Fowler, an opinion editor at the New York Times tweeted “The whole “female journalist sleeps with a source for a scoop” trope doesn’t even make any sense…”

This would be damning, except that while it may not be standard practice, there are plenty of examples of female journalists doing exactly what Eastwood’s film suggests.  Last year the Times—yes, Susan Fowler’s paper—reported on the three-year affair between  Times reporter Ali Watkins and James Wolfe, senior aide to the Senate Intelligence Committee, and a regular source for her stories. In October,  an employee of the United States Defense Intelligence Agency was arrested for leaking classified material to two reporters, and he was involved in a romantic relationship with one of them. Both reporters are still employed by their respective news organizations, the  Times and CNBC, so its hard to argue that sex-for-scoops is being strongly discouraged.

Morning Ethics Warm-Up, 9/12/17: Hurricane Reports, And Poor Charles M. Blow Needs A Vacation

Good morning.

1 There is supposedly a controversy regarding the on-the-spot hurricane reports: is it ethical for networks and news stations to place reporters and camera operators in mortal peril by having them scream into a mic while being buffeted by wind, rain and debris?

What’s the controversy? Of course it’s unethical. In addition to sending ridiculously mixed and self-contradictory messages—“I’m standing here in the storm telling citizens in the area that they shouldn’t be in the middle of this storm!”—it is also bad Ethics Chess. This stunt will continue until the first reporter is blown into a wall and sustains permanent brain damage, or is injured by a flying piece of debris that impales her, maims her, or cuts her in half. It is entirely predictable that this will happen eventually, and once it does, reporters will stop doing it. Why not stop this before a the inevitable tragedy occurs?

TV stations do it for ratings, that’s all. It’s great visual programming. It’s not necessary. Half the time, we can’t make out what the reporter is screaming, and what they are screaming is redundant and stating the obvious.

Apparently the first reporter to do this was Dan Rather.

2. What is the mission of a pundit, a talking head, a columnist? It has to be—don’t you think?—to enlighten readers, to convey a constructive, useful analysis of complex issues, to reliably filter facts and controversies through a unique view-point without so completely tainting his or her output with bias that it actively misleads.

Yesterday New York Times columnist Charles Blow issued a column titled “Soul Survival in Trump’s Hell on Earth.” This was the apotheosis of the kinds of columns Blow has been writing almost exclusively now for months; at least I hope it’s that, for I can’t imagine where he goes from here. This column, like the others, is nothing, literally nothing, but a nearly fact free exposition on the theme, “I hate the President. I really do. I do so, so much. I know you do too, and if you don’t, I hate you too. ARRRGGGGHHH!”

The headline isn’t hyperbole; Blow, if he is to believed, really thinks Americans are living in Hell because Donald Trump is President. Not because there is a Great Depression hovering over the land, not because we are embroiled in a Civil War, or the existential threat of a world war, or the daily threat of an  international stand-off igniting into world-wide thermonuclear obliteration, but because a President was elected that offends the ideological and partisan sensitivities of Charles M. Blow.

Hell.

Seriously.

How can the New York Times continue to justify publishing the weekly primal screams of this pompous, doctrinaire, and now apparently deranged pundit? Exaggerating problems and pronouncing that we are all but doomed is not a service. It is harmful. The only readers who will be persuaded by a column like this are the ones who decide that something has to be done and that it’s time to build that bomb. Moreover, when a pundit reaches the stage that Blow has, where the simple act of a government not agreeing with his views and enacting policies that he does not favor launches him into hysteria, that pundit needs a vacation. Or maybe another career.

What are Blow’s arguments that justify his diagnosis that the United States is now Hell on Earth? Is it that a major party and its supporters have set out deliberately to undermine American institutions by rejecting a national election, seeking to remove an elected President by non-electoral means? Is it that the  international fumblings and ditherings of the previous administration are, as predicted, resulting in increased threats to the United States and the rest of the world? Is it that American journalism and its uniquely free news media, beyond question the app that makes democracy function, has now become, by its own abuses, so completely politicized and untrustworthy that it has become a threat to the nation, rather than its watchdog?

An Ethics Wow: Maureen Dowd’s Strange, Bold, Honest—Chicken?—Absolute Bullseye New York Times Column About The Election And Its Aftermath [UPDATED]

Op-ed writer Maureen Dowd, the New York Times’ Queen of Snark, is widely regarded as an arch-liberal, if an amusing one. During the campaign, however, she  emerged as an analyst who was not dissuaded from telling the truth and expressing deep displeasure with Hillary Clinton’s ethics. As the full-force assault on Donald Trump and Republicans by her employer and colleagues since November 8 has shown, this isn’t a safe stance to take on the flagship of biased American media.

Maybe that explains why Dowd took such a strange and circuitous route in today’s print column, in which she places what are obviously her own words and conclusions in the mouth of Kevin, her conservative, “affluent, educated suburbanite” brother, introducing the column as his, based on the barrage of pro-Trump gloating Dowd says she received at the hands of her Trump-supporting kin, which she calls her “own little basket of deplorables.”

It’s really Maureen’s column, of course, and I would have made her an Ethics Hero if she had only had the guts to own it unequivocally. That cavil aside, I gained a great deal of respect for Dowd through her writing this. She rose far above the vast  majority of her ideologically similar peers by doing so, and the nation and especially the Democratic party would be better off if angry liberals read it and accepted its truths as the icy dousing in unbiased reality they so obviously need in order to stop embarrassing themselves. Ethics Alarms and I, as it happens, didn’t need her analysis, since it literally matches what has been explained here for months. Still, I find it gratifying  that at least one prominent liberal pundit gets it, and had the integrity, sort of, to say so in the Times.

“The Affair” Smears An American War Hero

“The Affair,” Showtime’s much lauded soap opera, wrapped up its season yesterday, without me. There are some things I won’t forgive, and sliming the legacy and reputation of long dead individuals of character and accomplishment is one of them.”The Affair” was guilty of that the previous week. It is dead to me.

The background: General Omar Bradley is increasingly accorded credit for planning D-Day, and thus is owed a large share of the world’s gratitude for winning World War II. He was not flamboyant like Patton or MacArthur, and had no political aspirations, so despite his remarkable life in service of the United States, Omar Bradley is an undeservedly obscure historical figure. He is, also, beyond any controversy, an American hero.

He also was an especially ethical one, as indicated by three of his better known quotes:

“It is time that we steered by the stars, not by the lights of each passing ship.”

“We have grasped the mystery of the atom and rejected the Sermon on the Mount. The world has achieved brilliance without conscience. Ours is a world of nuclear giants and ethical infants. We know more about war than we know about peace, more about killing than we know about living.”

“Dependability, integrity, the characteristic of never knowingly doing anything wrong, that you would never cheat anyone, that you would give everybody a fair deal. Character is a sort of an all-inclusive thing. If a man has character, everyone has confidence in him. Soldiers must have confidence in their leader.”

Why the writers of “The Affair” decided smear Bradley, I cannot fathom. Nonetheless, any viewers of the show that watched the penultimate episode and who didn’t know who Bradley was, and many who did, left it with the belief that Bradley, a who by all accounts was faithfully and lovingly married to the his first wife throughout the war and until her death, had an affair with actress Marlene Dietrich, who traveled with the U.S. Army for nearly two years at the end of the war. “The Affair’s” self-obsessed and perpetually horny protagonist, a successful novelist, told his therapist—and boy, does he need one–that his new book would be a historical novel about Omar Bradley. Then he said that he was tempted to skip the affair with Marlene Dietrich, but then that was the most interesting thing about Bradley to him. Continue reading

As Ethics Corrupters Run Amuck, Ethics Alarms Presents “Ethics Corrupter Weekend”! Part I: “Truth” Is False

Truth

“Truth” is in theaters now, and reportedly bombing. As soon as I learned about the source of the film (disgraced ex-CBC producer Mary Mapes’ memoir, “Truth and Duty: The Press, the President, and the Privilege of Power”) and its plot, I resolved not to watch it, as I would just end up walking out of it. Nonetheless, the fact that Robert Redford is connected with the project is profoundly disappointing. Redford is the ultimate Hollywood liberal, but his films have often been about ethics, and I regard him, or perhaps past tense is more appropriate, as having principles and integrity. True: actors need not agree with or endorse their roles or the projects of others, but Redford is unusual: he lends credibility to any project he allows to carry his name.

Connecting his name to “Truth” is a betrayal. The film makes martyrs of Mapes and Dan Rather, who attempted to tilt the 2004 election by smearing George Bush, without evidence, on “60 Minutes.” Not only was this a political hit job by biased journalists, it was one tainted by intentionally manufactured evidence. Mapes and Rather presented a forged document alleging that Bush went AWOL during his Texas Air National Guard service in the early 1970s. It was all the pair had that went beyond hearsay to make the allegation, and after the document was decisively shown to be a forgery (its font wasn’t available on the typewriter that had to have been used to make the original document.) Once the forgery was discovered by an enterprising blogger and confirmed by multiple document specialists. Rather and Mapes embarked on a rationalization orgy. Rather, to his undying shame, repeated his defenders’ argument that the forgery as “fake but accurate,” and does to this day, in essence rejecting journalism ethics wholesale. So determined was he to prove what he believed to be true but couldn’t prove fairly or ethically that he cheated, playing dishonest political operative to achieve worthy partisan goals “by any means necessary.”

Bias makes us stupid, and in this case, bias made Dan Rather corrupt.

Ethics Quote Of The Month: Washington Post Film Critic Ann Hornaday on “Selma”

“How to reconcile facts and feelings, art and fealty to the truth? When filmmakers recall with pride about the deep reporting and research they’ve done for their projects, then they deserve to be held accountable for their projects. For fact-based films, accuracy becomes a formal element, along with acting, design and cinematography. It’s up to each viewer to identify the threshold where artistic license compromises the integrity of the entire endeavor. Cinema has more responsibility in this regard precisely because of its heightened realism, its ability to burrow into our collective consciousness and memory, where the myth has a tendency to overpower settled fact. But viewers have responsibilities, too. If accuracy has become a formal element of historical dramas, then the ensuing fact-checks have become just as integral a part of how we view them. That means it’s incumbent on audiences to engage in a mode of spectatorship that, rather than decide who’s right, can listen to and respect expert critiques, and still open themselves up to a piece of filmed entertainment that speaks to less literal, more universal truths.”

The question of whether film makers have an ethical obligation to fairly represent history, and particularly individual historical figures, in their movies has been a topic visited frequently at Ethics Alarms, and I’m not going to re-hash conclusions that have been thoroughly discussed before, such as

…here, regarding the casting of “The Impossible” with a gleamingly light-skinned central family and the changing of the real life heroine from Spanish to British

…here,  discussing complaints that a fictional event was not portrayed accurately in “Noah”

…here, exploring the many falsehoods, some quite despicable, in James Cameron’s “Titanic”

…here, regarding unfair criticism of “Argo”

and here, discussing “Lincoln” screenwriter, playwright Tony Kushner’s inexcusable choice to represent a real life former Congressman voting against the Thirteenth Amendment abolishing slavery when in fact he voted for it.

The conclusion of that last one sums up the lessons of the rest, I think. Kushner’s defense against criticism of the collateral damage his invented facts wreaked was to argue that they were legitimate tactics in the pursuit of drama and “greater truths.” He then compared smearing the reputation of a Congressman, to the detriment of his descendants, to misrepresenting the kinds of socks Lincoln wore. (Kushner can be a brilliant writer, but his ideological utilitarianism is repellant.) I wrote:

I suppose some of you may have thought about this two years ago, when the Spanish film “The Impossible” was first released. I, however, take a while to catch up with my movie-viewing, and though the film was much praised by critics and got Naomi Watts an Academy Award nomination, I had not seen the film until recently. “The Impossible,” about as accurately as a motion picture can, tells the amazing story of how Spanish physician María Belón, her husband Enrique Álvarezs, and her three young sons miraculously  survived the 2004 Indian Ocean earthquake and tsunami when the family was on vacation in Thailand.

It is an engrossing, harrowing movie. I was surprised to find out, however that the family’s name wasn’t “Bennett,” and that they weren’t British, as the movie presented them. Apparently to maximize box office receipts, the film makers decided to take the heroic story of a real family and make the characters “more relatable” by recasting them as English-speaking Brits. There was a minor controversy about the film “whitewashing” the story*, but not much of that made it into the mainstream media. Belón, after all, is white. She was an active participant in the appropriation of story and that of her husband and sons, and they all profited from it, at least financially. Still, the movie’s point of view left a bad taste in the mouths of some international critics. Here is Australian critic Ruby Hamad:

“Based on the true story of a dark haired and darkish-skinned Spanish family, the filmmakers admitted to changing their nationality and casting lily-white actors in order to make the story ‘universal’. In other words, only white people can stand in for the human race as whole. For this reason, Thailand and its people are mere backdrops for the story of a Caucasian family who learn the hard way that even western privilege is no match for the brute force of mother nature.”
