Ethics Warm-Up, 2/19/19: College Disgrace Edition [Updated!]

Hello, Readers, and Goodby, Columbus (see #5)!

In case you care: yesterday was about the third time in ten years that I have failed to get at least one post up. I was in New Brunswick, NY, after the three and a half-hour trip from Virginia took over five hours instead of three. I had scheduled a 6:15 am wake-up call, and a room service breakfast at 6:30 in order to prepare for my 3 hour seminar and get a post or two up before I had to check out at 8 am. No wake up call. No breakfast. I was awakened at 8:05 am by Clarence Darrow, aka actor Bruce Rauscher. Somehow we made it to the seminar on time, Bruce was great, the lawyers were happy, but by the time the return journey got me home that night any Ethics Alarms post I attempted would have been in Esperanto.

I’m sorry.

1. Revelation! Hearing Darrow’s courtroom arguments in a different interpretation and pace made me realize that part of his methodology was to gradually convince juries that he was smarter than they were, and that they should just do what he said because he proved he had thought the issues through more thoroughly than they had or could. His genius was that he could do this without appearing to be arrogant or conceited. This is how effective leaders lead, and also how they corrupt, persuading normal people to just surrender their judgment.

I am an advocate of capital punishment, but when Darrow made this argument pleading for the lives of thrill-killers Leopold and Loeb….

What is the public’s idea of justice? “Give them the same mercy that they gave to Bobby Franks.”

Is that the law?  Is that justice?  Is this what a court should do?  Is this what a state’s attorney should do?  If the state in which I live is not kinder, more humane, more considerate, more intelligent than the mad act of these two boys, I am sorry that I have lived so long.

…I had to pause and wonder if he had found the fatal weakness in the logic of the death penalty. I have a rebuttal, but I have thought about the issue a long time, and Darrow wasn’t THAT much smarter than me. But if I were a typical juror (or even a judge, as was his audience in this case), I might be tempted to see the case Darrow’s way.

2.  Once again, the totalitarian instincts of progressives and attempted thought-control on campuses...I believe that this escalating phenomenon will eventually lead to an epic cultural conflagration.

Orange Coast College barred its chapter of the Young Americans for Freedom  displaying this banner….

…..at a campus student recruitment fair. The College objected to the banner’s depicting images of two rifles which college officials said were forbidden by a college policy that bars not just firearms but “any facsimile of a firearm, knife, or explosive.”

Obviously, however, such a decision violates the First Amendment. Explains Constitutional law expert Eugene Volokh, “once a university opens up a space where students may display banners, it then may not restrict such displays unless the restriction is viewpoint-neutral and reasonable. It’s hard to see a viewpoint-neutral rationale for banning even sillhouette displays of guns, which no-one would confuse for real guns….even if the rationale is viewpoint-neutral, it’s not reasonable: To be reasonable, a restriction on speech within a government-created forum must be “consistent with the [government’s] legitimate interest in ‘preserv[ing] the property … for the use to which it is lawfully dedicated.'” Nothing about the display of rifle sillhouettes interferes with the government’s legitimate interest in preserving campus property for its normal uses, except insofar as such a display conveys a pro-gun viewpoint to which some people object.”

Of course, the real purpose of the restriction is political indoctrination of students and agenda-driven limitations on advocacy. College administrators who don’t comprehend the Bill of Rights better than this may be qualified to educate trained ferrets, but not human beings less human beings.

The professor also points out that the school’s sports team logo…

…violates the school policy exactly in the manner the banner does, for it includes an illustration of a knife.

Morning Ethics Warm-Up, 2/7/2018: Something In This Post Is Guaranteed To Send You Screaming Into The Streets

Good Morning!

1 Oh no! Not my permanent record! My wife gave a small contribution to Mitt  Romney’s campaign, and has been hounded by RNC robocalls and mailings ever since. GOP fundraising started getting really slimy under the indefensible Michael Steele’s leadership, and continued to use unethical methods after Steele went on to job at a bait shop or something. Last week my wife got an envelope in the mail with a block red DELINQUENCY NOTICE! printed on it. A lie, straight up: there was no delinquency, just a my wife’s decision that she would rather burn a C-note than give it to the fools and knaves running the Republican Party. She registered an official complaint with the RNC, and received this response from Dana Klein, NRCC Deputy Finance Director:

“My job as the Deputy Finance Director is to communicate with supporters to let them know the status of their NRCC Sustaining Membership. Unfortunately, I have bad news for you. As of right now, you have a delinquency mark on your record for your failure to renew your membership. But, I have some good news. You can remove this delinquency mark if you renew by the FEC deadline on Wednesday.”

Both my wife and I were professional fundraisers for many years. This is deceptive and coercive fundraising, and anyone who voluntarily supports an organization that uses such tactics is a victim or an idiot.

Or, I suppose, a Republican.

2. Another one…This is another one of the statements that I am pledged to expose every time I read or hear it: a Maryland legislator, enthusing over the likelihood that a ballot initiative will result in legalizing pot in the state, ran off the usual invalid, disingenuous and foolish rationalizations for supporting measure. (Don’t worry, pot-lovers: I’m resigned to this happening, not just in Maryland, but nation wide. As with the state lotteries, our elected officials will trade the public health and welfare for easy revenue every time. Minorities and the poor will be the most hurt, and the brie and pot set couldn’t care less.) Only one of his familiar bad arguments triggered my mandatory response pledge: ” to legalize a drug that is less harmful than alcohol.”

This is the bottom of the rationalization barrel, “it’s not the worst thing.” Alcohol is a scourge of society, killing thousands upon thousands every year, ruining families and lives, wrecking businesses, costing the economy millions of dollars. Just yesterday there was a report that fetal alcohol syndrome was far more common that previously believed. There is no question, none, that U.S. society would be healthier and safer without this poison accepted in the culture: unfortunately, it was too deeply embedded before serious efforts were made to remove it. Now pot advocates want to inflict another damaging recreational drug on society, using the argument that it’s not as terrible as the ones we’re already stuck with. Stipulated: it’s not as harmful as alcohol. It’s not as harmful as Russian Roulette or eating Tidepods either. I have a bias against taking seriously advocates who use arguments like this; it means they re either liars, and know their logic is absurd, or idiots, and don’t.

3. Riddle me this: What do you get when you cross casting ethics, weak and lazy school administrators, political-correctness bullies-in-training with “The Hunchback of Notre Dame”?

Answer: a cancelled high school musical, and per se racism supported by the school.

New York’s Ithaca High School was beginning production of the Disney film-based musical “The Hunchback of Notre Dame” but made the unforgivable error, in the eyes of student activists,  of casting of a white student as a Romani heroine Esmeralda, played in the classic film by that gypsy wench, Maureen O’Hara, and in the Disney version by a Toon.  Several students quit the show in protest,  and formed an activist group to reverse the decision. It sent a letter calling the casting “cultural appropriation” and “whitewashing,” calling the student the “epitome of whiteness.” The letter admitted that she was also “a stellar actor, singer and dancer” that any stage would be “lucky to have,” but what is the talent, skill and competence required for a role compared to what really matters, her skin color? The students demanded that the school either choose a different show or recast Esmeralda a black and brown actress. Continue reading

Ethics Hero: Notre Dame Political Science Professor Vincent Phillip Muñoz

Vincent Phillip Muñoz is the Tocqueville Associate Professor of Political Science and Concurrent Associate Professor of Law at The University of Notre Dame. Following the violent protest that prevented his announced lecture at Middlebury College earlier this month, Prof. Muñoz invited Murray to speak at the University of Notre Dame next week. This occasioned some protests and objections from students and faculty at his own college, and he responded with an essay at RealClearPolitics, writing in part…

Charles Murray is speaking at Notre Dame because I and another Political Science professor assigned his book “Coming Apart” in our classes. His visit is one of several outside lectures that are part of this semester’s Constitutional Studies offerings. My class, “Constitutional Government & Public Policy,” addresses some of the most important and divisive issues in American politics: abortion, gay marriage, religious freedom, inequality, freedom of speech, death penalty, race and the meaning of constitutional equality, immigration, euthanasia, and pornography.

 The class is designed to prompt students to think more deeply and thoughtfully about contemporary moral and political issues. I don’t assign a textbook or “neutral” readings that summarize the issues; I require students to read principled thinkers who advocate vigorously for their respective position. I want my conservative students to read smart, persuasive liberal thinkers, and I want my liberal students to read thoughtful conservatives. Educated citizens can give reasons for their beliefs and can defend intellectually the positions they hold. That requires that we understand and articulate the positions with which we disagree.

…“But Murray is controversial and will make students feel uncomfortable,” my faculty colleagues say. Don’t I know that he has been accused of being racist, anti-gay, and a white nationalist? I’m told that bringing him to campus is not fair to Notre Dame’s marginalized students.

I have no desire to inflict unwanted stress or anxiety on any member of the Notre Dame community, especially our minority students. I appreciate the concern for student well being that motivates some of the opposition to Murray’s visit. But I believe what is most harmful to students—and, to speak candidly, most patronizing—is to “protect” our students from hearing arguments and ideas they supposedly cannot handle.To study politics today requires handling controversial, difficult, and divisive topics…

The price of a real education is hearing powerful arguments that make us realize our opinions are based on untested assumptions. Only then, when we realize that we do not know as much as we think we know, can genuine learning occur.

I invited Dr. Murray to Notre Dame months ago…Given what happened at Middlebury, it would be cowardly to disinvite Murray now. Rescinding his invitation would communicate that violence works; that if you want to influence academia, sharpen your elbows, not your mind. It would tell those who engaged in violence—and those who might engage in or threaten violence—that universities will cower if you just appear intimidating. Rescinding Murray’s invitation would teach exactly the wrong lesson…

Notre Dame faculty critical of Murray have implored me to think about the larger context of what his visit means. I am. That is why I will not rescind his invitation. As a professor and program director, my job is to do what we are supposed to do at universities: pursue the truth through reasoned dialogue and discussion. Whether you find Charles Murray’s scholarship persuasive or objectionable, his visit offers an opportunity to learn. That is why I invited him to speak at Notre Dame. After Middlebury, it’s all the more important that he do so.

It is almost an insult to academia to call Prof. Muñoz ‘s statement heroic. It should be obvious. Dissenters from the position he articulates should be instantly recognizable as regrettable outliers, the opponents of academic freedom and freedom of thought, the advocates of censorship and ideological indoctrination. Yet increasingly it is this traditional view of higher education that Muñoz advocates that is under attack. Continue reading
