The CNN “Joke About Donald Trump’s Plane Crashing”: Now THAT’S A “Nothingburger”

But it’s nice to know that some people at CNN now know how Billy Bush felt.

A website called FTVLive  obtained video of CNN’s Suzanne Malveaux talking to her crew and her producer before going live on CNN, as they waited for Trump’s  press conference. His plane to yet land.

On the video, a producer can be heard saying “When I do this, it means his plane’s landed’ and later, she seems to be saying, dead-pan”That means his plane’s crashed….just kidding” There is some incomprehensible chatter briefly after that.

Thanks to some websites like Mediaite on a slow news day, this gourmet “nothingburger” was widely and critically circulated. “The crew decided to joke around about a pretty grisly topic,” intoned Mediaite’s  Justin Baragona.

This, believe it or not, prompted CNN to issue an apology! This…

“An unfortunate and inappropriate remark was made by one of our producers off camera yesterday. We have apologized to the Trump transition team, and the Producer has been disciplined.”

Oh, balderdash. There was nothing “unfortunate and inappropriate” about that comment, which was not an expression of hostility to Trump, or anything else but on the job self-mockery. I would make that joke. I have made essentially that joke in various settings. At a surprise party for my mother, for example: “OK, I’ll make this sign when she’s coming up the walk, this sign when she’s at the door, this sign if she trips at the door and falls down the stairs, and this sign if she’s attacked by the neighbor’s dog.”  So what? The male star of the buzzy movie musical “La La Land,” which opens next week, is Ryan Gosling. The role was originally offered to Miles Teller, who was a rising hot property and star on the threshold for acing the role of the abused drummer in “Whiplash,” like “La La Land” directed by Damien Chazelle.

But according to the people familiar wit negotiations, Teller was insulted by money he was offered,  a paltry $1 million, primarily because his putative co-star, Emma Stone,was being offered almost $3 million. After some back and forth, Chazelle replaced Teller with Gosling. Thus did Teller lose out on an a rare opportunity to make himself a major star in a film that is widely believed to be an Oscar magnet, and, of course, he won’t have that million dollars, either.

This a particularly vivid example of the ethics dilemma created by comparative salaries. I have not seen or heard of a satisfactory solution to it, from the management side or the labor side. Management would prefer that employees not know what other employees are making, and with good reason. The information can cause envy, bitterness, anger and lawsuits. Every employee has a tendency to believe they are more valuable, and indispensable, than they really are. Of course, some employers want to keep salaries secret because there are disparities that they cannot defend, or that may be illegal. While transparency is desirable to prevent unfair salary differences, however, it can make legitimate disparities untenable. Continue reading

Note To Prof. Painter On His Teeth Gnashing Over Trump’s Conflicts: “If You Have No Option, You Have No Problem,” or “NOW You Tell Us?”

Ethics expert Richard Painter, who was White House ethics counsel from 2005 to 2007, has authored a thorough, convincing and I’m quite certain accurate brief about all the problems arising from soon-to-be President Donald Trump’s vast business connections, and the conflicts of interest they can and will involve. It’s an automatic ethics train wreck. Here’s Painter:

Even absent a quid pro quo, the Emoluments Clause bans payments to an American public official from foreign governments. Yet they will arise whenever foreign diplomats stay in Trump hotels at their governments’ expense; whenever parties are organized by foreign governments in Trump hotels (Bahrain just announced such a party in a Trump hotel this week); whenever loans are made to the company by the Bank of China or any other foreign-government-owned bank; whenever rent is paid by companies controlled by foreign governments with offices in Trump buildings; and whenever there is any other arrangement whereby foreign government money goes into the president’s businesses….How can we expect a Trump administration to rein in loose lending practices, particularly in the real estate sector, when the president himself owes hundreds of millions of dollars to banks? What will he do when a foreign dictator acts up in a country where there is a Trump hotel?

Unethical Facebook Post Of The Month: The Fired KFC Employee

We can make short work of this one. The post, which is being circulated around social media with great glee, embodies an unethical impulse, breach of confidentiality, and vengeance. It is miles away from the other end of the disgruntled ex-employee spectrum, but on the spectrum nonetheless, along with taking a shotgun to one’s former office and firing away. Trying to harm an employer because you got yourself fired simply illustrates the kind of character deficits that resulted in the termination.

As with everything else in life,there is an ethical way to get fired. That would be to shake the hand of the one who handed you the pink slip, state your appreciation for the chance to work and sincere regret that it did not work out, then to say good-bye and good luck to fellow workers, then walking out with head held high. Leaving while darkly muttering “You’ll be sorry!” under your breath, or trying to harm the company’s reputation or business though retaliation later, is both unethical and stupid. Calvin better hope his ill-considered message doesn’t get into any potential employer’s hands. You’d have to be nuts to hire someone like him.

His is the not-so-secret recipe for distrust and failure.

Holiday Ethics Assigment: Quick! Watch These 25 Great Old Ethics Movies Again Before You Go Bonkers Too!

I am compiling a new list of great ethics movies to help those troubled by the recently completed Presidential campaign, the election and its aftermath. I haven’t decided whether to reveal it piecemeal, or collectively as I have before, but I do need to begin by presenting the previous list of 25, actually the combination of several previous posts. Ethics films I have covered individually since those lists debuted, like Spotlight and Bridge of Spies, will eventually be added.

For now, here’s the top 25. Don’t pay attention to the order.

1Spartacus (196o)

The raw history is inspiring enough: an escaped gladiator led an army of slaves to multiple victories over the Roman legions in one of the greatest underdog triumphs ever recorded. Stanley Kubrick’s sword-and-sandal classic has many inspiring sequences, none more so than the moment when Spartacus’s defeated army chooses death rather than to allow him to identify himself to their Roman captors (“I am Spartacus!”)

Ethical issues highlighted: Liberty, slavery, sacrifice, trust, politics, courage, determination, the duty to resist abusive power, revolution, love, loyalty.

This is juuuust the beginning…

I have noted before that our President Elect never expresses any ethical awareness, and uses rationalizations exclusively to explain and justify his conduct. This is typical of say, 12-year-olds, but is less common among professionals in responsible positions.

Trump just authored a classic example, following the expression of concerns about his conflicts of interest, which are massive, unavoidable, and which should have been addressed seriously long ago, like in a Presidential debate, and at length. Unfortunately, Hillary Clinton and various journalists felt it would be more helpful to their cause to spend time talking about what Trump had said about an over-weight Miss Universe and in a private conversation with Billy Bush. How did that work out for you, guys?

Now various lawyers and ethics experts are saying that Trump “must” sell off his business holdings because his company’s myriad business entanglements will cast many White House decisions under a cloud. The President Elect has a neat answer for them, to wit:

“The law’s totally on my side, meaning, the president can’t have a conflict of interest.”

Bravo! This is a perfect expression of Ethics Alarms Rationalizations #4, and #5

4. Marion Barry’s Misdirection, or “If it isn’t illegal, it’s ethical.”

The late D.C. Mayor and lovable rogue Marion Barry earned himself a place in the Ethics Distortion Hall of Fame with his defense of his giving his blatantly unqualified girlfriend a high-paying job with the DC government. Barry declared that since there was no law against using the public payroll as his own private gift service, there was nothing unethical about it. Once the law was passed (because of him), he then agreed that what he did would be wrong the next time he did it.

Ethics is far broader than law, which is a system of behavior enforced by the state with penalties for violations. Ethics is good conduct as determined by the values and customs of society. Professions promulgate codes of ethics precisely because the law cannot proscribe all inappropriate or harmful behavior. Much that is unethical is not illegal. Lying. Betrayal. Nepotism. Many other kinds of behavior as well, but that is just the factual error in the this rationalization.

The greater problem with it is that it omits the concept of ethics at all.  Ethical conduct is self-motivated, based on the individual’s values and the internalized desire to do the right thing. Barry’s construct assumes that people only behave ethically if there is a tangible, state-enforced penalty for not doing so, and that not incurring a penalty (that is, not breaking the law) is, by definition, ethical.

Nonsense, of course. It is wrong to intentionally muddle the ethical consciousness of the public, and Barry’s statement simply reinforces a misunderstanding of right and wrong.

From The “Rules Are Rules” Files: China’s “No Arms, No Loans” Policy

Just when you are tempted to think the United States leads humanity in outrageous bureaucratic rigidity and the refusal to make sensible exceptions when common sense and decency demand it, a story like this one comes across the wires to restore one’s faith that cruelty and stupidity are universal.* That’s something to be thankful for…isn’t it?

Maybe not.

Wu Jianping, a 25-year-old teacher from Zhengzhou in the Henan province of China, told the news media there that banks have denied his application for a mortgage loan because he had inadequate identification.  Banks in China require fingerprints for loans, and Wu has no fingers. In fact, he has no arms, having lost both of them when he was electrocuted in an accident at the age of five.

Jianping says he typically writes his signature by holding a pen in his mouth, but banks rejected his loan applications on the grounds that his written signature can be easily imitated, presumably by anyone holding a pen in his mouth, and they don’t accept toeprints.

“Fingerprinting is a common practice because signatures can be imitated, but there is no way to copy a fingerprint,” one bank employee was quoted as saying. Ah. And just how does someone impersonate a loan applicant with no arms? How many 25 year-old teachers without arms are there in China, anyway? Are people always coming up to Wu Jianping in the streets of Beijing, where he works, and telling him, “I’m sorry! I mistook you for someone else” ?

The banks are receiving widespread criticism online and in social media, with many writing that demanding fingerprints from an armless man is unreasonable. Gee, ya think? Let’s have a panel discussion about it. Now some of the banks are apparently relenting. That’s generous of them.

I bet George Bailey would have given Wu a loan…

The Complete “It’s A Wonderful Life” Ethics Guide [UPDATED AGAIN! ]

 Once again, Ethics Alarms re-posts its ethics guide to Frank Capra’s 1946 masterpiece “It’s A Wonderful Life,”one of the great ethics movies of all time. It was written in 2011, and revised regularly since, including for this year’s version. I suspect we need it more in 2016 than usual.

It is fashionable now, and was even when the film was released, to mock its sentiment and optimism. On one crucial point Capra was correct, however, and it is worth watching the film regularly to recall it. Everyone’s life does touch many others, and everyone has played a part in the chaotic ordering of random occurrences for good. Think about the children who have been born because you somehow were involved in the chain of events that linked their parents. And if you can’t think of something in your life that has a positive impact on someone–although there has to have been one, and probably many—then do something now. It doesn’t take much; sometimes a smile and a kind word is enough. Remembering the lessons of “It’s a Wonderful Life” really can make life more wonderful, and not just for you.

Here we go:

1. “If It’s About Ethics, God Must Be Involved”

The movie begins in heaven, represented by twinkling stars. There is no way around this, as divine intervention is at the core of the fantasy. Heaven and angels were big in Hollywood in the Forties. Nevertheless, the framing of the tale advances the anti-ethical idea, central to many religions, that good behavior on earth will be rewarded in the hereafter, bolstering the theory that without God and eternal rewards, doing good is pointless.

We are introduced to George Bailey, who, we are told, is in trouble and has prayed for help. He’s going to get it, too, or at least the heavenly authorities will make the effort. They are assigning an Angel 2nd Class, Clarence Oddbody, to the job. He is, we learn later, something of a second rate angel as well as a 2nd Class one, so it is interesting that whether or not George is in fact saved will be entrusted to less than Heaven’s best. Some lack of commitment, there—then again, George says he’s “not a praying man.” This will teach him—sub-par service!

2. Extra Credit for Moral Luck

George’s first ethical act is saving his brother, Harry, from drowning, an early exhibition of courage, caring and sacrifice. The sacrifice part is that the childhood episode costs George the hearing in one ear. He doesn’t really deserve extra credit for this, as it was not a conscious trade of his hearing for Harry’s young life, but he gets it anyway, just as soldiers who are wounded in battle receive more admiration and accolades than those who are not. Yet this is only moral luck. A wounded hero is no more heroic than a unwounded one, and may be less competent as well as less lucky.

3.  The Confusing Drug Store Incident

George Bailey’s next ethical act is when he saves the life of another child by not delivering a bottle of pills that had been inadvertently poisoned by his boss, the druggist, Mr. Gower. This is nothing to get too excited over, really—if George had knowingly delivered poisoned pills, he would have been more guilty than the druggist, who was only careless. What do we call someone who intentionally delivers poison that he knows will be mistaken for medication? A murderer, that’s what.  We’re supposed to admire George for not committing murder.

Mr. Gower, at worst, would be guilty of negligent homicide. George saves him from that fate when he saves the child, but if he really wanted to show exemplary ethics, he should have reported the incident to authorities. Mr. Gower is not a trustworthy pharmacist—he was also the beneficiary of moral luck. He poisoned a child’s pills through inattentiveness. If his customers knew that, would they keep getting their drugs from him? Should they? A professional whose errors are potentially deadly must not dare the fates by working when his or her faculties are impaired by illness, sleeplessness or, in Gower’s case, grief and alcohol.

4. The Uncle Billy Problem

As George grows up, we see that he is loyal and respectful to his father. That’s admirable. What is not admirable is that George’s father, who has fiduciary duties as the head of a Building and Loan, has placed his brother Billy in a position of responsibility. As we soon learn, Billy is a souse, a fool and an incompetent. This is a breach of fiscal and business ethics by the elder Bailey, and one that George engages in as well, to his eventual sorrow. Let’s Hear No More About Facebook “Values”

The New York Times reports that Facebook has developed software that will enable partner Chinese companies to monitor popular stories and topics that Facebook users share across the social network. Facebook’s partner would have power to decide whether those posts should show up in users’ feeds and suppress posts from  in specific geographic areas. The censorship and information-suppressing software  was created to help Facebook get into China, a lucrative market where the social network has been blocked. CEO Mark Zuckerberg is, sources say, full supportive of this effort by Facebook to make the subjugation of Chinese liberty easier.

One of Facebook’s core mission statements is “Make the world more open and connected.” Like so many mission statements, it is public relations deception. If Facebook was devoted to this mission, it would not even consider breaching its intent, letter and spirit by spending time and money to develop censorship software.

Facebook’s real mission is making a fortune by expanding into new markets. Let us not debase the topic of this blog by defaulting to Rationalization # 25. The Coercion Myth: “I have no choice!”

Facebook has a choice, the ethical one. That choice is to tell China it has a choice: either accept Facebook without censorship, of do without it. Google and Twitter, neither exactly paragons of virtue, have been blocked there for refusing to yield to the government’s  censorship requirements. Boy, when a company isn’t even as ethical as Twitter..wow.

This is the company we are going to trust to decide what is “real news.”  Ridiculous.

Prominent Democratic Party supporter Zuckerberg, like the party itself, is insufficiently allergic to the methods and objectives of totalitarianism.

Americans: End This Slippery Slope Now, Before It’s Too Late.

Ethics Alarms has repeatedly inveighed against public accommodations that have attempted to discriminate based on customers’ social and political views. This growing phenomenon is part of the ugly legacy of division and and hyper-partisanship created by the Obama years, and it threatens to get worse. If we want an ethical society and a healthy culture, we have to unite and reject this undemocratic tendency quickly and emphatically. It literally threatens all of us.

The specific incident prompting this alarm comes from a restaurant in my region, Maggiano’s Little Italy in Chevy Chase, Maryland.

Last week, Maggiano’s was subject to a protest so vociferous that the restaurant has to shut down for the safety of employees and diners. The reason for the protest was that National Policy Institute (NPI), an alt-right group, was having a banquet there. In a grovelling e-mail to the community, Maggiano’s management wrote that

“We were not aware that NPI was dining with us or what the group represents. After the event, an attendee sent a tweet in which she made a “Sieg Heil salute” in support of Hitler and white supremacy. This expression of support of Hitler is extremely offensive to us, as our restaurant is home to Teammates and Guests of every race, religion and cultural background. We want to sincerely apologize to the community of Friendship Heights for inadvertently hosting this meeting, which resulted in hateful sentiment.”

When did it become required conduct for restaurants to investigate the liberal bona fides of a group before it could be granted leave to dine there? When did what a diner tweets after a meal become conduct a restaurant had to account for? If Maggiano’s can be bullied into apologizing for serving the NPI, why would serving any other group or organization that some group of self-righteous protesters find objectionable, fairly or not, pose a similar risk?

Put aside the Nazi salute: that’s inappropriate conduct in a public place, and the restaurant could certainly, and should, tell diners who behaved like that to leave. That’s not what the restaurant is apologizing for, however.  They are apologizing for hosting the group, despite its Constitutionally protected political views. Continue reading
