The Pink Slime Debacle: Is Anyone To Blame?

The maker of so-called “pink slime” filed for bankruptcy last week as the direct result of a public furor and public relations disaster related to “finely textured beef.” As a result, upwards of 650 people are losing their jobs, perhaps many more. Ground beef and other beef-based food will be more expensive, and quite possibly less healthy. Who, if anyone, is at fault?

The “pink slime” controversy was launched by cable TV chef Jamie Oliver, a healthy eating advocate who urged his viewers to reject ground beef that included the commonly-used filler. It is all meat, you know. In fact, it is virtually fat-free beef that begins as slaughterhouse trimmings, is then heated and spun in a centrifuge to separate tiny particles of meat from fat, and subjected to a puff of ammonium hydroxide gas to kill bacteria. Then it was mixed with ground beef. The process sounded unappetizing, and the nickname, coined in an e-mail by a USDA official, made it seem especially disgusting. The internet and social media got a hold of it, and the next thing you know, there were petitions and outrage. And the net result…jobs lost, beef made more expensive, no improvement in taste or health…a complete loss.

Good job everybody!

And almost everybody’s to blame too.

In rough order of culpability:

  1. The meat industry, for using unnatural, treated meat as filler and hiding it with the deceitful label “100% beef.” Consumers should have known what was being added and how it was produced, and it should have been on the labels.
  2. The clever USDA official. His cute name was a food slur, and in these days of viral tweets, YouTube videos and emails, coming up with a disgusting name for a safe food was reckless and irresponsible.
  3. The news media and websites, for not adequately defusing the controversy by explaining exactly what the substance was, indulging the anti-meat agenda of certain writers and reporters.
  4. Consumers, for being naive, emotional, irrational, and too easily stampeded. Most processed food can be made to seem disgusting,  especially anything to do with meat. So is a lot of food preparation. The public won’t take the time to distinguish between genuinely unhealthy foods and those that just involve processing that isn’t suitable for the squeamish, so they go overboard on the random targets of attention-seeking, half-cocked activists, and often the government and regulators follow the hysteria. This is the tragedy of DDT; this is Alar; this is cyclamates. Industries are destroyed that don’t deserve to be; lives are ruined, and the public health isn’t improved.

Was Jaime Oliver’s conduct wrong? I don’t think so. He’s a natural foods advocate; he has philosophical objections to processed food, and he  performed a public service by letting the public know something about its food that it should have been told about sooner. The story of “pink slime” could and should have been explained truthfully by someone who approved of it; it’s not Oliver’s fault that the job fell to an opponent.

Our Untrusted Professions: Another One Bites The Dust…Or Should.

America’s trust crisis, which has seen virtually all its institutions decline precipitously in public trust, hasn’t left the professions unscathed. Far from it: Gallups’ annual poll of the public’s regard for the professions, the most recent of which was released last December, showed accountants trusted by only 43% of the public (abysmal for a profession whose only mission is to accurately determine the truth and to relay it—funeral directors are trusted more), journalists at just 26% (which is more than they deserve), bankers at 25%, lawyers at an insulting 19% (for a profession that includes honesty as a core ethical requirement), business executives slightly less at 18% (but no lower than those champions of the 99%, labor leaders, also at 18%). Stockbrokers, who figure to have fallen even lower after Greg Smith’s anti-Goldman Sachs diatribe, came in at a “can’t be trusted to deliver the water bill payment” 12%, and then we’re really in the pits of utter distrust, with lobbyists, used car salesmen, and members of Congress, all tied for last place at 7%.

In contrast, one of the professions that always is on top of the list or near it is pharmacists. In 2011, the friendly neighborhood druggist scored a trust rate of 73%, better than doctors and second only to the perennial champs of the last decade, nurses.

Ethics Dunces: Belvedere Vodka and Arnell

“Ethics Dunces” doesn’t really do these two organizations justice. Try “too dumb to live” and “too unethical to be trusted with sharp objects.”

Or vice-versa.

Marketing whizzes Arnell devised this hysterically funny vodka ad for Belvedere Vodka, showing a happily horny man sexually assaulting a terrified female victim. What fun! And such a witty tag line: “Unlike Some People, Belvedere Always Goes Down Smoothly.”

Goes down, get it?

It took about an hour after this juvenile, rape-friendly offal was posted on Twitter and Facebook for there to be such a negative reaction that even the bombed cretins at the vodka company were able to figure out something was wrong. So they pulled the ad, and apologized, kind of, tweeting,

“We apologize to any of our fans who were offended by our recent tweet. We continue to be an advocate of safe and responsible drinking.”

Uhhhhhhno. “We apologize to those who were offended”–a non-apology apology. Ethics strike two. “We continue to be an advocate of safe and responsible drinking”—what? These idiots still didn’t understand what they were supposed to be apologizing for!!!   Ethics Strike THREE! Continue reading

Fairness and the Transgendered Miss Universe Contestant

The Miss Universe Canada organizers have kicked contestant Jenna Talackova out of their beauty pageant because she was born male.  Fair? Well, the qualifications for the pageant require that an entrant be a “naturally born female.” I’m sure that was seen as a clear and reasonable restriction when it was devised, but let a few lawyers at it today. Jenna says she was always female, but just trapped in a male body. She was also “naturally born.” Hmmmm.

[UPDATE: (4/10/12) On April 5, the pageant announced that Talackova would be allowed to compete after all, and announced a rules change that will allow transgendered competitors next year.]

Jenna falsely stated on her entrant forms that she was “born female.” Since she has told officials that this wasn’t true, she is obviously no lawyer, but really: why shouldn’t a transexual be able to compete? The issue should be whether she’s a female now, right? The pageant might as well require that all contestants must be born gorgeous. Miss Universe Canada could, I suppose, duck the problem by requiring that no entrant can have appearance-enhancing surgery. Of course, then the pageant would have no contestants at all. Dr. Z’s Tips to Avoid Unethical Influences in the Workplace and in Life

I’m giving ethics seminars to lawyers and accountants today at a non-profit conference in Washington, D.C. While I’m gone, I thought you might want to think about one of the topics I’ll be talking about, the problem of avoiding unethical influences and being co-opted by an unethical culture. What follows are some of the principles advocated by psychologist  Philip Zimbardo, “Dr. Z” to his students, who is best known for devising the infamous Stanford Prison Experiment (it was even made into a movie), that demonstrated to a frightening degree how ethical individuals could engage in horrendous acts when placed in the right (or wrong) environment. Zimbardo has studied, taught and written about this phenomenon extensively, and I find his advice bracing and wise, as well as fodder for debate and discussion. Here it is: Continue reading

Unethical Advertising Slogan of the Month: Reebok

You read that right: the slogan, which Rebok printed up for use by an affiliated gym in Germany and which quickly went viral on the web, is

“CHEAT ON YOUR GIRLFRIEND, NOT ON YOUR WORKOUT!”

As blatantly unethical exhortations in pursuit of commerce go, this one is pretty spectacular. Consider:

  • It is disrespectful of women.
  • It advocates betrayal, dishonesty, disloyalty, infidelity, promiscuity and cheating.
  • It designates a higher priority to narcissistic self-maintenance over love, commitment, and stable relationships.
  • It represents an athletic equipment company giving the stamp of approval to cheating.

That’s a remarkable amount of bad ethics in just eight words. A masterpiece of economical cultural poison. Bravo! Continue reading

Easy Call: Employers Asking For Facebook Passwords? It’s Unethical. So Let’s Stop It.

Ethics Alarms’ predecessor, The Ethics Scoreboard, had a feature known as “Easy Calls,” where I would render periodic ethics verdicts I thought should be obvious. Today’s talk radio and blogosphere sensation, the report that asking for a job applicant’s Facebook password is becoming a common practice of employers, is a classic easy call. And like a lot of those on the Scoreboard, an amazing number of people are getting this easy call wrong anyway.

For example, I heard lawyer-radio talk-show host Laura Ingraham today mock complaints about the practice, saying it was a legal request. Sure, it’s legal. It is still wrong, an indefensible incursion of personal privacy. “You are always free to look for a job somewhere else,” Ingraham says, as if that makes everything fine. Being free to reject an unfair and coercive job requirement doesn’t make it any less unethical. Law professor Orrin Kerr says that the Facebook demand is in the same league as demanding a job applicant’s house keys. Let’s see, what else could a prospective employer ask? Continue reading

Soon after I posted my article about Mike Daisey’s representation of fabricated events and facts as truth in his January feature on NPR, the actor/activist posted this dismissive explanation on his own blog.  It is Dan Rather’s Memogate excuse taken to the next level, the epitome of self-justification of the unapologetic zealot who believes that all is fair in the battle against (what he regards as) evil, employing a full battery of rationalizations for unethical conduct:

Unethical Quote of the Month: Mike Daisey

“Well, I don’t know that I would say in a theatrical context that it isn’t true. I believe that when I perform it in a theatrical context in the theater that when people hear the story in those terms that we have different languages for what the truth means.”

Actor, writer, activist Mike Daisey, in an interview with NPR’s Ira Glass, exploring how Daisey was able to justify fabricating facts and accounts for the earlier aired—and just retracted—“American Life” installment called “Mr. Daisy  Goes To The Apple Factory.” NPR checked the particulars of Daisey’s first hand account of the human rights and labor violations he claimed to witness at Apple’s factory in China, and found that the writer had embellished, exaggerated,  and misrepresented much of what he reported. What NPR had broadcast as journalistic reporting was an excerpt from Daisey’s acclaimed touring one-man stage show, The Agony and Ecstasy of Steve Jobs.”

Daisey’s quote, which is both illuminating and chilling, argues that using made-up stories and personal accounts in a theatrical context qualifies as truth, even if the same misrepresentations in a journalistic context are inappropriately false. The problem with his argument, and the flawed ethical theory behind it, is that both the NPR audience and his theater audience believe that Daisey is telling the truth. Daisey’s solution to the problem is simple: his one-man show does tell the truth…it just uses lies to do it. Continue reading

Ethics Corrupters on The Web: Symptoms of a Cheating Culture

I encountered this charming example of high school cheating advice quite by accident. There is a stunning amount of this kind of thing on the web, and perhaps what is most impressive about it is the matter-of-fact way it is received. This example was posted on a Facebook page, and the few posters who registered objections to it as cheating were ridiculed. mocked and insulted by the rest as prudes, fools, judgmental ass-holes, “holier-than thou” bitches, and worse. One commenter couldn’t understand why this would  even be called cheating. “Nobody’s copying any  exam answers!”, he asked, puzzled.

The trick here reminds me of a response I got from a lawyer in an ethics seminar, as I was discussing a hypothetical in which an attorney had promised to review a non-profit client’s by-laws that had to be included in a crucial grant submission. Continue reading
