Stipulated, We Can’t Trust Polls, But This One Is A Harvard Poll, So…Well We Can’t Trust Harvard, Either, But Still It’s An Interesting Poll…

We can see one reason why we can’t trust polls from these two headlines:

The Hill: “More Americans oppose Kavanaugh nomination amid partisan rancor.”

AOL: “Nearly two-thirds of voters believe Kavanaugh should be confirmed if the FBI finds no corroboration of the charges.”

We can’t trust polls because they are made to be spun.

The Harvard Center for American Political Studies /Harris Poll online survey of 1,330 registered voters was conducted September 29 to 30. The partisan breakdown is 37 percent Democrat, 32 percent Republican, 29 percent independent and 2 percent other. The full poll isn’t out yet, but here are some results, with my comments.

  • 37 percent of registered voters want their Senators to give Kavanaugh’s nomination the thumbs up, while 44 percent want their Senators to vote against him. But 18 percent of respondents are undecided.

And, apparently, a lot of those surveyed didn’t watch the hearings, don’t know that Dr. Ford’s accusations are unsubstantiated, and almost certainly haven’t read the report of the Committees expert prosecutor, who found them dubious based on her testimony. Thanks, Biased Mainstream Media! But the truth will out…

  • 44%  of men per cent want their senators to vote in favor and another 44% wanting them to vote against Kavanaugh. Among female voters, 44% want Senators to vote against confirming Kavanaugh, while 31% want him confirmed. 24% remain undecided.

Yes, more women are unfair and biased on this nomination. But who wouldn’t want to install a cultural norm where your gender was regarded as automatically unimpeachable, no matter who you accused. with or without evidence?

  • 45%  of independents currently “don’t back their Senators confirming Kavanaugh,” compared to 28% who want him confirmed.

The Facts Are In: Surprise! Serena Williams And Her Defenders Were Dead Wrong In Every Respect

It is rare that a public controversy that breaks down ideological lines actually has a resolution. The uproar over the sexist “double standards” a tennis umpire supposedly used against Serena Williams as she lost the U.S. Open championship (fair and square) to Naomi Osaka is just such a rarity. Although it should have been obvious on its face (Yes, it’s legal jargon, but I love it) that Serena was grandstanding to distract from her loss and posing as a gender rights crusader when she was really being an entitled celebrity jackass, social justice warriors fell all over themselves rationalizing her outburst, with columns titled, “Right message, wrong timing” at best,  and demands that the umpire and the U.S. Open owe Williams an apology for enforcing the rules at worst.

There’s no longer any valid  justification for debate. Williams was wrong; her defenders were biased, and it is they, not match umpire Carlos Ramos, who are obligated to apologize.

The New York Times isn’t always spinning for the Left. In a thorough article yesterday, it revealed that when the rampaging tennis diva protested to Brian Earley, the tournament referee, “There are men out here who do a lot worse than me, but because I’m a woman you are going to take this away from me? That is not right,” she was perpetrating a falsehood.

The Times actually looked at the data, something that should have been available to the public immediately after the Williams tantrum, but let’s be grateful for responsible journalism even when it’s suspiciously late. The conclusion: Serena’s accusation notwithstanding, “men appear to be fined proportionally more often than women for a variety of offenses.”

Morning Ethics Warm-Up, 9/14/18: A Newly Christened Ethics Train Wreck!

Good Morn…ARRRGH!!!

1. As predicted…The wounded Ethics Alarms commenter who sued me for defamation is appealing the Massachusetts judge’s ruling granting my motion to dismiss for failure to state a cause of action. His main objective, I assume, is just to waste as much of my time and money as possible. Apparently he either has posted or will post the entire transcript of the hearing and a recording of the proceedings on his website.

2. It’s official! The Bret Kavanaugh confirmation is officially and ethics train wreck. It was already a national embarrassment. Putting it over the top and on the metaphorical rails was the truly nauseating smear attempted by Senator Diane Feinstein (D-Cal). Here is her statement:

“I have received information from an individual concerning the nomination of Brett Kavanaugh to the Supreme Court. That individual strongly requested confidentiality, declined to come forward or press the matter further, and I have honored that decision. I have, however, referred the matter to federal investigative authorities.”

This is pure innuendo with no content whatsoever, and thus dirty politics, indeed McCarthyite politics. But wait! There’s more! From the Intercept:

It purportedly describes an incident that was relayed to someone affiliated with Stanford University, who authored the letter and sent it to Rep. Anna Eshoo, a Democrat who represents the area. Different sources provided different accounts of the contents of the letter, and some of the sources said they themselves had heard different versions, but the one consistent theme was that it describes an incident involving Kavanaugh and a woman while they were in high school.

I’m sorry if heads are exploding, but I’m especially concerned about those who will try to rationalize what Feinstein, and the Democrats, are doing in their desperation to defeat the nomination of a completely qualified Supreme Court candidate. A second, third or fourth-hand hearsay account from an anonymous source alleging  some kind of possibly sexual misconduct (by 2018 #MeToo rules, I’m sure) was passed along to Feinstein, who announced that she was referring it to the Justice Department, and the alleged conduct of an undefined nature occurred when Kavanaugh was a high school student. There Is Gender And Racial Bias In The Legal Profession, But This Study Doesn’t Prove It…Because Of Bias

Incompetent, agenda-driven research leads to warped debates, hyped conclusion and bad policy. It also undermines credibility of those who cite some legitimate problems. The recent report, which proposes strategies for employers to eliminate the alleged barriers to women and minorities in the legal profession, is such research. It was conducted by the Center for  WorkLifeLaw at the University of California, Hastings College of the Law, for the bar association’s Commission on Women in the Profession and the Minority Corporate Counsel Association.

At least the New York Times headline, for once, was accurate., at least the online version: “Lawyers Say They Face Persistent Racial and Gender Bias at Work.” Yup, that’s what the survey showed. What it didn’t show is that there really is such discrimination, how much there is, or how it manifests itself. Here’s part of the executive summary:

Prove-It-Again. Women of color, white women, and men of color reported that they have to go “above and beyond” to get the same recognition and respect as their colleagues.

  • Women of color reported PIA bias at a higher level than any other group, 35 percentage points higher than white men.
  • White women and men of color also reported high levels of PIA bias, 25 percentage points higher than white men.
  • Women of color reported that they are held to higher standards than their colleagues at a level 32 percentage points higher than white men.

This demonstrates, at least within the reliability of the survey,  that minorities and women perceive that they are being discriminated against more than white males. That’s a useless result. We have seen and read, for example, how various African American activists and celebrities like Charles M. Blow and Ta’ nahisi Coates teach their sons that police are racists, and that they must fear them. As a result, they interpret all interactions with police through this prism. One doesn’t have to be a research ethicist to conclude that this warps their perception. Similarly, all women currently in the workplace have been bombarded by the media, activists, peers and the culture for most or all of their working lives about how hostile the workplace is to women.

At least four of the seven most common and insidious biases are at work:

1. Herd mentality: The tendency to adopt the opinions and follow the behaviors of the majority to feel safer and to avoid conflict. Also known as mob psychology, peer pressure, and group-think.

Members of groups seeking political power through maximization of perceived victim status are influenced by the needs, mission and perceptions of that group.

2. Confirmation Bias: the tendency to look for or interpret information in a way that confirms pre-formed beliefs.

If you already believe that you are going to be the target of discrimination, you will interpret events to confirm that belief.

3. Self-Serving Bias: when an individual attributes positive outcomes to internal factors and negative outcomes to external factors.

This is the most tragic phenomenon of both a history of bigotry towards certain groups and the laudable efforts to raise awareness of it to eliminate the conduct. It pushes women and minorities to blame external factors for their failures, and in so doing impedes their chances of success. I have previously written about my personal epiphany in this area, when an African American singer who I rejected for a challenging tenor role accused me outright of not casting him because of his color. He could not hit the notes the role required, and yet he was convinced that bias, and not his own deficiencies as a singer, was what cost him the part.

4. Bias Blindness: the tendency not to acknowledge one’s own thought biases.

I don’t doubt that there is considerable gender and racial bias in law firms. Indeed, I am certain of it. This kind of study, however, is not the way to sound the alarm, and smacks of either incompetence or dishonesty.

Oh, Fine: I Knew Wikipedia Was Untrustworthy, And Now I Find Out It’s Partisan Too….

If the mainstream media, social media, and the most accessed encyclopedia won’t tell the truth without trying to manipulate it, what chance do we have?

Yesterday I again tip-toed into the realm of government lawyer ethics for a CLE seminar. As I did last week, I attempted to mention the most important government lawyer issues raised by the events of the past year without triggering partisan zealots and the anti-Trump deranged. I also noted that being a partisan zealot or anti-Trump deranged qualifies as a potential conflict of interest for a government lawyer, interfering with his or her ability to be objective, independent, competent, loyal and zealous. I did not say, but could have, as proven by Sally Yates. I know from past experience that this particular—100% accurate—observation is inviting a fight.

However, I did feel it necessary to discuss Bruce Ohr, the Justice Department official who is at the center of several Mueller investigation controversies. I am not yet prepared to weigh in on Orr, except to note this, as I did yesterday: The fact that Ohr served as the Justice Department contact for Christopher Steele, the former MI6 agent commissioned to author the dubious Trump–Russia dossier that was used as the primary justification for the FISA warrants permitting surveillance of the Trump campaign, while Ohr’s wife, Nellie Ohr, worked for Fusion GPS, the opposition research firm that prepared the dossier under a contract with the Democratic National Committee and the Hillary Clinton campaign (but I repeat myself), was a blatant conflict of interest, and arguably (and I’ll argue it) an unwaivable one. It also violates the ethics requirement that all government employees must follow to avoid the appearance of impropriety. (Pretty much the entire Mueller investigation has breached that. )

In the course of trying to confirm the basic facts of Ohr’s conduct, I consulted Wikipedia. Where else do you go these days for a dispassionate up-to-date recitation of facts without spin? Not  the New York Times. Not Fox News. As Frankie Pentangeli says to Michael Corleone, “Your father did business with Hyman Roth; your father respected Hyman Roth; but your father never trusted Hyman Roth.” That pretty much describes my relationship to Wikipedia. I don’t trust it. I frequently find errors in entries; I know people who have Wikipedia pages who are about as deserving of them, or less, than my Jack Russell Terrier; and I have never forgotten how my father spend hours correcting a wildly inaccurate Wikipedia article about a World War II battle that he was deeply involved in and wrote about in his book only to have his work rejected because Wikipedia does not accept, it said, “first hand accounts.” Wikipedia is a classic example of an imperfect resource that is both essential and hopelessly flawed by its very nature. Morning Ethics Warm-Up, 8/30/18: Double Standards, Signature Significance, Facebook Tricks, And Pettiness From Beyond The Grave!

1. Tennis Ethics: Yes, I’d call this a double standard…When I saw the headline at AOL— “The US Open has been accused of sexism after a female tennis player was slapped with a code violation for changing her top in the middle of a match”—I assumed that this was another bare-breasts equality story. No, it was even stupider than that. At the U.S. Open at Flushing Meadows this week,  Alizé Cornet was playing Swedish star Johanna Larsson when Cornet realized she  had put her her top on backwards during a break.

So she quickly fixed the wardrobe malfunction on the court, briefly exposing her black sports bra. The Horror. The umpire slapped Cornet with a code violation, unsportsmanlike conduct. But male players frequently remove their shirts on the sidelines, and usually aren’t wearing any bra at all. Indeed, male player Novak Djokovic  removed his shirt on the same day Cornet received her warning. Women’s Tennis Association rules state that women are not allowed to change clothes while on the court, but there is no similar rule for men.

2. Signature significance for an unethical politician. (But it’s Andrew Cuomo, so we knew that anyway.) During the New York  gubernatorial candidates’ debate  between Governor Andrew Cuomo and actress-turned-politician Cynthia Nixon, there was this exchange,

Cuomo: Excuse me, can you stop interrupting? 

Nixon: Can you stop lying?

Cuomo: Yeah, as soon as you do!

The audience thought this was funny.

3. Today’s  alarming “Nah, [enter Social media of mega-tech company here]  doesn’t abuse its power 0r manipulate information for a political agenda! Why would anyone suggest such a thing?” note:

NPR, to its credit, published an investigative reporting piece debunking a popular anti-gun fake stat, one that David Hogg et al. have wielded repeatedly: the U.S. Education Department’s claim that in the 2015-2016 school year, “nearly 240 schools … reported at least 1 incident involving a school-related shooting.”  The NPR investigation findings:

“…NPR reached out to every one of those schools repeatedly over the course of three months and found that more than two-thirds of these reported incidents never happened. Child Trends, a nonpartisan nonprofit research organization, assisted NPR in analyzing data from the government’s Civil Rights Data Collection.

We were able to confirm just 11 reported incidents, either directly with schools or through media reports.

In 161 cases, schools or districts attested that no incident took place or couldn’t confirm one. In at least four cases, we found, something did happen, but it didn’t meet the government’s parameters for a shooting. About a quarter of schools didn’t respond to our inquiries.

“When we’re talking about such an important and rare event, [this] amount of data error could be very meaningful,” says Deborah Temkin, a researcher and program director at Child Trends.

Gee, ya think?

This statistic has been disputed before, but since the challenges came from conservative news media, the NRA or other Second Amendment supporters, the mainstream media kept using it, and I’m sure the Parkland kids will keep using it anyway, since facts seem to have little importance to them. National Public Radio, however, has been resolutely anti-gun for decades, and never saw a liberal cause it didn’t admire.

When a Facebook user shared the NPR article on Facebook, however, it was removed because, as Facebook informed him,  “it looks like spam and [it] doesn’t follow our Community Standards.” See?

Saturday Ethics Warm-Up: Algorithms, The Beatles, Baseball, Football, And Omarosa

Good morning.

1.  More Scorpion-Frog Ethics. I refuse to do a full post on Omarosa, the latest slimy opportunist the mainstream media is suddenly treating as a trsutworthy source because she claims to have dirt to spill on President Trump. To ist credit, NPR is at least flagging her sliminess, in a post titled “Omarosa Tells NPR She Heard Trump ‘N-Word Tape,’ Contradicting Her Own Tell-All Book.”

As I wrote regarding Manigault Newman previously (and the same applies to Michael Cohen), one can be nauseated by the disloyalty, dishonesty and venality of such scum and still have little sympathy for their victim, Trump, who was a fool to trust such obviously untrustworthy individuals, give them influences, notoriety and power they are unfit to have, and still claim to be hiring and appointing “the best people.”

The same sentiment applies to the biased, obsessed and incompetent news media. If journalists keep presenting present the likes of Omarosa, Cohen, Stormy Daniels, Michael Wolff, and, yes, James Comey, as credible first-hand Trump accusers, how can they expect the public to take any legitimate future accusers seriously, should any appear? Their predecessors will have all been obvious publicity-seekers, shake-down artists, motivated by personal agendas or greed, and obviously so. The news media, meanwhile, undermines its own credibility—what little remains–by so eagerly treating these tarnished sources as if they were not what they so obviously are.

2. They’re baaaack!. The NFL’s pre-season games are underway, and what do you know? The players are kneeling again, protesting during the National Anthem in what they deny is a protest of the National Anthem in what the news media regularly calls the “National Anthem protests.”  Wait, what’s that protest about, exactly? The New York Times has settled on “social inequality and police brutality.” And what do they mean? Here’s the latest interpretation by one of the most prominent Kneelers, Malcolm Jenkins of the Philadelphia Eagles:

“Before we enjoy this game lets take some time to ponder that more than 60% of the prison population are people of color. The NFL is made up of 70% African Americans. What you witness on the field does not represent the reality of everyday America. We are the anomalies…”

Anomalies because they aren’t in jail? That sounds rather racist to me. Anomalies because they make millions of dollars? Are the Kneelers saying that all African Americans should be making a lot of money? That prison populations should be representative of the same demographic percentages as the public as a whole? Is he calling for affirmative action in the courts (social justice, I guess) or claiming that the large black prison population is caused by police brutality?  That’s funny: I assume that it is because a disproportionate number of blacks are committing crimes. Is that their fault, or the fault of NFL ticket-holders? This remains the most incoherent, self-indulgent protest ever, and one that prompted one of the President’s more accurate tweets–-two, in fact:

The NFL players are at it again – taking a knee when they should be standing proudly for the National Anthem. Numerous players, from different teams, wanted to show their “outrage” at something that most of them are unable to define. They make a fortune doing what they love………..Be happy, be cool! A football game, that fans are paying soooo much money to watch and enjoy, is no place to protest. Most of that money goes to the players anyway. Find another way to protest. Stand proudly for your National Anthem or be Suspended Without Pay!

That last part relates to the also incoherent NFL policy on kneeling during the anthem. On this, Jenkins told Philly.com, “Quite frankly, guys in our league don’t like being told what to do, what they can and can’t do. We don’t have this type of policies for the other causes we support, whether it be our ‘Salute to Service,’ or breast cancer awareness, or anything else. It’s just when you start talking about black folks, quite frankly. It’s disheartening, but we’ll continue to be creative.”

Huh? Employers in all professions and occupations tell employees what to do, and on-the-job protests disrupting the workplace are universally forbidden. (I know you guys are “anomalies,” Malcolm, but you still collect a paycheck…) Do these players really not see the distinction between engaging in a league-approved promotion like ‘Salute to Service,’ or breast cancer awareness, and a wildcat protest that annoys and insults paying customers? Is anyone going to fact-check that misleading statement,  as someone like Snopes undoubtedly will, regarding the President’s mistaken claim that “most of that money goes to the players”?

Then, “quite frankly,” we get the race card. Of course! “When all else fails…”

Morning Ethics Warm-Up, 7/3/2018: Remember Pickett’s Charge! Edition [UPDATED]

Good Morning!

1. “General, I have no division!” At about 2:00 pm, , July 3, 1863, by the little Pennsylvania town of Gettysburg, Robert E. Lee launched his last, desperate and audacious stratagem to win the pivotal battle of the American Civil War, a massed Napoleonic assault on the entrenched Union position on Cemetary Ridge, with a “copse of trees” at its center. The doomed march into artillery and rifle fire, across an open field and over fences, lasted less than an hour. The Union forces suffered 1,500 casualties,, while at least 1,123 Confederates were killed on the battlefield, 4,019 were wounded, and nearly 4000 Rebel soldiers were captured. Lee’s bold stroke had failed spectacularly, and would go down in history as one of the worst military blunders of all time.

That verdict is debatable, but this is not: Pickett’s Charge, as the attack came to be called, holds as many fascinating ethics lessons as any event in American history, and this blog has returned to it for enlightenment time and time again.

There is the matter of the duty to prevent a disaster that you know is going to occur, the whistleblower’s duty, and the theme of Barbara Tuchman’s work, “The March of Folly.” There was Robert E. Lee’s noble and unequivocal acceptance of accountability for the disaster, telling the returning and defeated warriors that “It is all my fault.” The defeat also turned on moral luck, with many unpredictable factors, such as the intervention of a brave and intrepid Union cavalry officer named George Armstrong Custer, who also teaches that our greatest strengths and most deadly flaws are often the same thing, and that the Seven Enabling Virtues can be employed for both good and wrongful objectives.  Pickett’s Charge shows how, as Bill James explained, nature conspires to make us unethical.

Pickett’s Charge also teaches that leadership requires pro-active decision-making, and the willingness to fail, to be excoriated, to be blamed, as an essential element of succeeding. Most of all, perhaps, it illustrates the peril’s of hindsight bias, for without a few random turns of fate, Robert E. Lee’s gamble might have worked.

2. Funny how if you continually denigrate someone based on his color and gender, he will eventually stop respecting you. Stanford University has established a Men and Masculinities Project  that aims to help men develop “healthy and inclusive male identities”—because they obviously don’t have those now.  “We acknowledge that male identity is a social privilege, and the aim for this project is to provide the education and support needed to better the actions of the male community rather than marginalize others,” anti-man-splains Stanford’s gurus. Stanford, of course, is not alone in pushing the ubiquitous progressive narrative that men are toxic, along with whites, making white men the worst of all. Perhaps this might explain why support for Democrats among young white men is falling fast.

Nah, it must be because they are sexist and racist…

3. But..but…settled science! The Economist estimates that as many as 400,000 papers published in supposedly peer-reviewed journals were not peer-reviewed at all. Scientists, scholars and academics are no more trustworthy or alien to unethical conduct than anyone else, but because most of the public (and journalists) don’t  understand what they write about and have to accept what they claim on faith, they are presumed to be trustworthy.

Think of them as the equivalent of auto mechanics. Continue reading

More On “Media Bias Report 3.1”

It is amazing how many desperate liberals  circulate or defend  the absurd, misleading and incompetent chart purporting to measure the bias of various news sources as if the thing had any integrity at all. First of all, they could not (I hope) have read the creator’s nonsensical criteria for her assessments. Second, it should be obvious that no single individual could possibly examine and compare over 40 news sources with anything approaching thoroughness and accuracy. How would this be possible, even as a full-time endeavor, which it most certainly was not in this case? A research group like Pew might be able to pull such a study off with a large budget, lots of time, and a substantial staff, and even then I’m very dubious.

The chart is a classic example of making fake research—garbage in, garbage out— look impressive through packaging. This is, of course, unethical.

Exhibit A. On Why The News Media Won’t Address Its Unethical Bias

Just look at that chart, sent to me by a frequent commenter here. I wish I could make it larger on the site, but a clearer version is here.

The woman [going by only the name “Vanessa,” as far as I could discover] who created this appears to be serious: if this is satire or trolling, she fooled me. The thing is so obviously itself a product of liberal bias that it is amazing that it would be presented as otherwise. There is Fox News way over in the hyper-partisan conservative field, which is mostly fair, but lo and behold, there sit outrageously hyper-partisan CNN, The New York Times and the Washington Post mostly in the “neutral” field while ABC, CBS, NBC,  NPR and TIME [KABOOM!] are sitting entirely in “neutral.”

How is it possible that someone could come to such an obviously incorrect conclusion? Several ways, actually. One is that she is far enough left that the biased and slanted hackery of sources like CNN seem moderate and fair to her. Another is that she doesn’t have a clue what bias is. A third is that she’s an idiot, and a fourth is that she’s doing propaganda for the propagandists. She has a long section on her methodology here: please read it if you are curious, and report back. I’m not going to waste my time. Any methodology that leads to the conclusion that NPR is paragon of unbiased journalism is crap by definition. I don’t need to read it to figure that out. Vanessa says we should trust her analysis because she in an English major and a patent lawyer.

Oh.

This visual representation of denial does have value: it demonstrates that there are no unbiased news sources, and that journalism is not merely untrustworthy, but actively impeding the communication of essential knowledge to the public, so they can make the informed choices crucial to a functioning democracy.

Of course, I knew that already.
