Pandemic Ethics Potpourri: Spring Cleaning, Chapter 1

My files of potential and ongoing ethics stories and issues involving the Wuhan virus outbreak are stuffed to overflowing. I’m not going to have time to do the full posts many of these deserve, and the rest risk dropping into oblivion. Here is the first of several collections that will at least flag issues while allowing me to keep current…

1. Golf and the virus…

  • Three Massachusetts golfing enthusiasts, blocked from the links in their own state , were charged with misdemeanors in Rhode Island after going to extraordinary lengths to sneak into that state to hit the little white balls around. Rhode Island has issued a directive requiring all travelers to quarantine themselves for 14 days after entering the state. Gregory Corbett, 51, Tyler Pietrzyk, 22, and Nye Cameron, 22, determined to make it to the Meadow Brook Golf Course drove from Massachusetts to the smallest state, changed cars in a McDonald’s parking lot, and proceeded to the golf course with Rhode Island-issued plates to the club.

I’d say they should be scrupulously careful not to do any of the ordinary political partisanship that had already badly infected journalism. There’s a lot of ruined credibility out there. Everyone ought to be trying to crawl back toward the truth. I think Trump — in his daily briefings — has been “appeal[ing] to common values and emphasiz[ing] moral standards and solidarity.” But the Trump-hating media will not help him do this. They’re looking for ways to blame him, to worsen his credibility. Why not help?”

——Bloggress Ann Althouse, reacting to one more New York Times Trump-hate piece, this one called “Trump’s ‘Light at the End of the Tunnel’ Is a Delusion;”yesterday’s (by Obama’s disinformation chief, Susan Rice) was “Trump Is the Wartime President We Have (Not the One We Need)/He should start leading with the decency and resolve that we deserve. I’m not holding my breath” 

The answer to Ann’s rhetorical question is “of course they do,” and I mainstain hope that a sufficient number of citizens will hold them responsible for an unprecedneted breach of tradition, duty and common sense. Attacking and undermining any leader in the midst of a national challenge is irresponsible and dangerous, yet virtually all of the mainstream media is not only doing it but doing it with increasing intensity. [Okay, bear with me now. This COTD by Steve Witherspoon was actually entered on this post, where the issue at hand was alluded to obliquely in the post, then expanded upon in a comment. But I went into far more detail regarding the issue in today’s Warm-Up, and there was even a poll on the issue, so I’m assigning the comment to that post, not the one that inspired it.]

I officially mark my immediate ethics conflict as solved. The poll results are moot regarding this specific episode but still valid regarding the general problem. So far, about half the voters said I had a duty to post the non-diverse idiot photos even if it did get me called a racist (Easy for them to say!). Fortunately, the option I favored (with three votes out of 24) was made accessible within minutes of the posting. I know have a fully diverse array of dufuses wearing their masks wrong, and hope to have more.

Sunday Morning Alarms, 4/5/2020: After The First Two Items, You Won’t Want To Read Any More And Will Just Go Back To Bed…

1. KABOOM! Pennsylvanian Anita Shaffer, 19, decided to flee her York County home  a week ago for a mental health drive.  On her way back home, two Pennsylvania State Police officers stopped her about her car’s faulty tail-light. While talking with the officers,  Shaffer told them that she was just “going for a drive.” In response, they wrote her a ticket for more than $202.25 for violating the Pennsylvania Governor Tom Wolf’s stay-at-home order.

That’s the citation above. It says Shaffer “failed to abide by the order of the governor and secretary of health issued to control the spread of a communicable disease, requiring the closure of all non-life-sustaining businesses as of 20:00 hours on March 19, 2020. To wit, defendant states that she was ‘going for a drive’ after this violation was in effect,”

State police spokesman Ryan Tarkowski explained the ticket, saying, “Troopers have been encouraged to use contacts with the public as opportunities to reinforce the necessity to abide by stay-at-home orders.”

And how, exactly, does ticketing an individual who is engaged in conduct that cannot possibly infect anyone  accomplish  that?

Well, Tarkowski blathered,  being a soulless bureaucrat incapable of admitting that THE STATE is full of it in this case, “Troopers maintain discretion to warn or issue citations and the decision is specific to the facts and circumstances of a particular encounter.”

Fine. These facts do not justify a ticket by any stretch of the imagination. The officers’ discretion shows they are not qualified to wield the power they have. Indeed, the citation magnifies the extreme arbitrariness of such orders, and their danger when those charged with enforcing them have the judgment of Gestapo officers.

I’m surprised the cops didn’t slap her around a little, shoot her in the kneecap or even rape her, you know, to show the defiant prole who’s boss and not to ever, ever defy Big Brother.

Tarkowski also said Shaffer’s citation is the only one issued for violating the stay-at-home order. It’s good that the police picked a representative one to symbolize the Pennsyvania message to it’s citizens, which is apparently, “You will do as you are told, underlings.”

Well, not to be crude, but screw that.

Shaffer told reporters  she was within her rights to operate her car, and plans on challenging the citation.  Good. And again I ask, where is our vaunted American Civil Liberty Union on this issue? For three years, we have been hearing false cries of outrage about how the President is an autocrat just waiting to crush our civil rights, and now, when the civil rights of citizens are being ignored by tin pot governors all over the country, the ACLU just shrugs and sighs in its bunker, “It’s for the greater good.”

Why is today unlike any other day?

1. What’s wrong with this picture? This, courtesy of ABC News, was the scene on a New York City subway yesterday:

My question is this: how can everyone be cheering Governor Cuomo’s leadership during the pandemic crisis when this is still going on? I heard Cuomo say, in one of his briefings, “You can’t stop public transportation. You just can’t.” Yet if you are going to allow the above scene all day, every day in your state’s largest city, why bother with the rest of the measures? Just wall off the Big Apple and let everyone get sick.

“Tiger King” Ethics…If You Can Control Your Gagging

You should watch the current hit Netflix documentary “Tiger King” as an ethics exercise, if you can keep focused. It’s difficult. The seven episode horror show/freak show/ “Well, it’s time for another shower!” thing is rife with revelations about America and its culture as well as the infinite variety of humanity that breeds and mutates under rocks and over them. But it is also so teeming with freaks, sociopaths and morons that it often makes you feel like you are watching “The Anna Nicole Show” or one of the other reality shows that exploits its dumb, attention addicted stars.

Focus, Jack! Focus! There are a lot of ethics issues here, largest among them the icky exotic animals trade.  (Fun Fact!  There are more tigers in the U.S. than in the rest of the world combined. Now: Is that a good thing for tigers, or a bad thing?) There are also clinical cases of  corrupt business owners, narcissism on steroids, marriages that make Bill and Hillary Clinton look like John and Abigail Adams, toxic personalities (once you have met series star “Joe Exotic,” you may never think of anyone as a narcissist again…no, not even you-know-who), astounding hypocrisy, the infuriating twilight world of young, healthy people (well, physically healthy anyway) whose lives consist entirely of getting stoned or waiting to get stoned, abuse of the legal system, idiots with guns… the list is ridiculously, depressingly long. From Idaho, Common Sense Measures Regarding Transgender Competitors In Women’s Sports

Naturally, the common sense measures are being condemned as bigoted and unethical.

Idaho is now Ground Zero in the controversy over the ethical and equitable treatment of transgender individuals. In addition to the newly passed and signed Fairness in Women’s Sports Act, which bans biologically male transgender athletes from competing in women’s sports events,  Idaho Governor Brad Little (a Republican, of course) signed a bill making it more difficult to change the sex designation on a birth certificate.

Ethics Alarms has discussed the transgender/women’s sports controversy in many posts. It’s admittedly a difficult ethics conflict that has played out in many strange ways across the country, including a female high school wrestler transitioning to male being forced to compete against females, and many instances of formerly male athletes competing as women crushing their double-X opposition while giving us photographs like this:

Female athletes who have protested the unfairness of this development, like Martina Navratalova, have been attacked as bigots, while some feminists have predicted that allowing trans athletes to continue to take advantage of their passing through puberty as males will destroy women’s sports, negating the salutary effects of Title IX, the law that made gender discrimination in sports illegal.  Idaho state Rep. Barbara Ehardt , who played basketball at Idaho State University and later coached Division I women’s teams, led the way in pushing the legislation through to law. “If I had had to compete against biological boys and men, I don’t think I would have had the opportunity to play,” she told reporters. “Honestly, I know firsthand that we simply can’t compete against the inherent physiological and scientifically proven advantages that boys and men possess. We simply can’t do it, regardless of any hormone usage.”

Intersex competitors, like Caster Semenya, pose a different ethical problem. Continue reading →

Happy Day Like Any Other Day.

Well, not “happy,” exactly…

I’m on record on Ethics Alarms as detesting April Fools Day, as well as regarding April Fools stunts by professionals, like lawyers and journalists, unethical though usually not sanctionable. It should be a children’s day, like Halloween, but adults are determined to co-opt all such days, ruining it for everybody.

1. I lost a good friend yesterday. It’s more than that really: the human race lost one of its finest representatives. His name was Dennis Nollette; he was a lawyer, a writer and a bon vivant, but most of he was one of those amazing people who made you feel good just by being around him. I knew him in laws school, where he was my room mate for a year; he also was a member of the casts of the three productions I staged when I was a student. Since graduation, I think I saw Dennis six times, never for long, but with him it seemed like the time melted away: he was always the same, always emitting his powerful positive energy, optimism, and love for those around him, and I always felt as close to him as ever.

And just like that, he’s gone. There was no warning; it all happened so fast. All I have now is an overwhelming feeling of loss, along with an acknowledgment of my duty to let as many people as possible know that he was here, that he made the world a better place by being here, and that those of us who remains should follow his example by making the best out of life, and encouraging others to do the same by our example. That was Dennis’s genius, and attention must be paid.

2. Maybe the Constitution IS a suicide pact…Justice Robert H. Jackson’s  famous line in his dissenting opinion in Terminiello v. Chicago, a 1949 free speech case, has come to mind many times in the past few weeks, as the news media and online sources have churned out some of the most irresponsible and outrageous essays in memory, many of them about how this period will “change America forever,” usually in undesirable ways.  90% of these screeds are nonsense and based on flawed reasoning. My current leader for the worst idea is this piece, by conservative gadfly Roger Simon: “Should We Postpone the Presidential Election One Year?”

It’s an incompetent question. Not only shouldn’t we, we can’t, and any suggestion from Republicans that we ought to even think about it would be instantly condemned as the attempted dictatorship by Donald Trump that Big Lie #3 has warned us about.  We also know that if the President did get an extra year, it would spent all of it defending himself against one impeachment attempt after another. New Media Gaslighting Update, And An Insufficiently Inflammatory Rant

As the majority of Americans gradually come around to appreciating the President’s efforts and leadership in the uncharted metaphorical waters of a strange and still infuriatingly under-understood pandemic, the Get Trump media has shifted into pure propaganda and fiction to claim otherwise. Here’s David Leonhardt, arguably the most rabid and untrustworthy of all the op-ed writers in the Times “resistance” stable, claiming, “Trump Is Hurting His Own Re-election Chances: Don’t be fooled by snapshot polls.” That should be, “Who are you going to believe, me or your own eyes?” Even worse is The Atlantic, which is literally a full time Trump Derangement publication now. Peter Wehner is the prime balladeer of the magazines fantastic songs: two weeks ago, he wrote, “The Trump Presidency Is Over: It has taken a good deal longer than it should have, but Americans have now seen the con man behind the curtain.”

This kind of hysteria-mongering is even worse: “How Donald Trump Could Steal the Election.” The First Amendment allows publications to publish such vomit, but that doesn’t mean its ethical for them to do it. Like earlier article about how the President might just refuse to leave office if defeated, or use the epidemic to declare himself dictator, such fever-dreams are based on nothing but clinical obsession and hate. The author The Atlantic dredged up is a professor of political science at the University of Maryland named Jeffrey Davis. He, his university, and The Atlantic should all be discredited in the future, as their judgment is stunningly awful and their trustworthiness is non-existent.

Then there’s this: In an open letter to Vice-President Pence, British journalist Mehdi Hasan writes in The Intercept that he must  invoke 25th Amendment and have the President removed as “unable to discharge the powers and duties of his office.” Yes, it’s good old Resistance Plan E (on the list that goes up to S.) And what triggered the resort to this oldie but goodie? The President was mean to a reporter, Hasan is a journalist, so that settles it! Cementing the total lack of seriousness in his article, Hasan cited Bandy Lee as authority—you know, the discredited Yale psychiatrist who has breached her profession’s ethical standards by diagnosing the President from afar, and who is thus the go-to guest any time CNN or MSNBC has another “How do we get rid of this guy without beating him in an election?” panel. (She also exposed her integrity and motives recently by refusing to diagnose Joe Biden’s cognitive problems.) It’s another embarrassing article. Why would anyone publish such garbage? Comment Of The Day: “A Brief But Significant Addendum To “I’ve Looked And I’ve Tried And I Believe In Civility, But The Only Fair Descriptive Word For These People Is ‘Asshole’”

Steve-O-in-NJ has given us his thoughts on the continuing assault on the President of the United States as he does his best to deal with the unprecedented Wuhan virus crisis. (Reader Pennagain has expressed a preference for “Pangolin virus.” The prejudice against scaly anteaters is wide and deep, and when we start hearing reports of thugs beating up pangolins while shouting anti-pangolin slurs, we’ll know who to blame. )

The inspiration for Steve’s Comment of the Day was Hillary Clinton’s mocking tweet that put her on the current Ethics Alarms Asshole List, though I’m not sure she ever left it. I’ll also mention here that no less a luminary than John Kerry has apparently joined those of us who believe that “asshole” is sometimes the only description that will do.  Commenting on GOP House member Thomas Massie’s absurd stand temporarily blocking passage of the epidemic emergency legislation, the former Senator and Secretary of State tweeted,

Breaking news: Congressman Massie has tested positive for being an asshole. He must be quarantined to prevent the spread of his massive stupidity. He’s given new meaning to the term #Masshole. (Finally, something the president and I can agree on!)

I am not at all surprised. I’m also not surprised at Joe Biden’s recent tweet in which he said that when he was president he would put science first, implying what many have stated outright, that Trump disregards science and is afraid of smart people (which all liberals are, of course, they only wouldn’t be liberals if they weren’t). Basic decency went out the window on the left when Trump was elected, although it had been hanging out the window for a while.

A lot of the open rudeness and contempt seemed to start in the Clinton era, maybe together with the rise of the internet. Now anyone could say anything he wanted and send it around the world in a few seconds. A lot of people did just that, no matter how dumb, how rude, or profane, or how unfair what they had to say was. Then the refrain was that your character didn’t matter as long as you were successful and had the right views. The other side of that, though, was that if you had the wrong views you were beneath contempt.

As we moved into the administration of Bush the younger a whole “anger industry” developed. I know, because my bookshelves are groaning under the weight of a huge number of anger-based books that I gleefully devoured at the time to feed my contempt of the other side. I’m not just talking Ann Coulter, either.

David Horowitz’ “Left Illusions: An Unholy Odyssey” and “Unholy Alliance: Radical Islam and the American Left,” Daniel J. Flynn’s “Why the Left Hates America” and “A Conservative History of the American Left,” John J. Miller’s “Our Oldest Enemy,” and a lot of similar materials have all made my night table. On the other side there’s Al Franken’s “Lies and the Lying Liars who Tell Them,” Michael Moore’s “Stupid White Men,” and so on. People paid money to have their anger stoked and their reasons for being angry confirmed. Continue reading →
