Morning Ethics Warm-Up: 8/12/17

Good morning, all!

1. I can’t keep writing the same post repeatedly as the politically correct, the historical censors, the Soviet-style Left and the gallactically stupid continue to tear down statues and eliminate honors to significant Americans who are predecessors deemed worthy.  Just hunt for the “airbrushing history” tag here and you’ll find too many already. We should note, however, how the cognitive dissonance scale is coming into play to the benefit of the unethical airbrushers.

In Charlottesville, home of the University of Virginia, this weekend will witness thousands of white nationalists and neo-Nazis demonstrating to protest a plan to remove a statue of Robert E. Lee  from a city park, because, Lee’s sub-21, infinitely wise undergrads insist, erasing Lee from history will undo the legacy of racism, or something. Of course, for the Racist Right to be the ones protesting makes this position look reasonable. White supremacists organizing the protests unjustly associates Lee with their cause, making his statue mean something it never did, and attaching him to  cause that was not his. The protests against tearing down Lee’s statue–UVA’s founder, Thomas Jefferson, will be next on the non-person list, or close to it—should be coming from historians, scholars, liberals, believers in fairness, nuance, and integrity, and those who are literate enough to understand that the life of Robert E. Lee has much to teach every child and American about loyalty, hubris, hard choices, tragic choices, hypocrisy, courage and more. Why aren’t they protesting? Two reasons, now: they don’t want to be shoulder to shoulder with the scum of the earth, and they are too timid to stand up for crucial ethical principles, unlike the censors of Charlottesville, who don’t understand them, and the Neo-Nazis and white supremacists, who don’t have them.

2. And speaking of historical airbrushing and censorship: Last year, I designated the Smithsonian Institute’s National Museum of African American History and Culture in Washington, D.C as an Ethics Dunce for omitting the second African American SCOTUS justice, Clarence Thomas from mention while devoting an exhibit to his unsubstantiated accuser, Anita Hill.  Now the museum has announced plans to honor Jim Vance.

Come on, you all know who Jim Vance is, don’t you? (D.C. area residents: shut up!) Jim Vance, who transformed America for blacks? Give up? Vance was a long-time popular local D.C. television news broadcaster, with a nice screen presence and a casual delivery.  He just died, and he was black. The museum’s founding director, Lonnie Bunch, said the broadcaster “symbolized that it was really important that America was changing and his presence was a symbol of that change.” Right, sort of….although Vance was hardly the first or the most prominent black newscaster in D.C. Clarence Thomas, however, was the first conservative black justice…which is, of course, why is being shown such disrespect by the “Nation’s Attic.”

I haven’t visited the huge, striking new museum on the mall yet, and I won’t until its shows signs of being am objective chronicler of history rather than a tool of interest group propaganda. Continue reading →

An Ethics Hypothetical: If “The Nation” Is Right About The DNC Hacks, How Should Democrats And The Mainstream Media React?

And how will they react?

Yesterday, The Nation, the most Left of the Left’s major national publications, reported this:

  • There was no hack of the Democratic National Committee’s system on July 5 last year—not by the Russians, not by anyone else. Hard science now demonstrates it was a leak—a download executed locally with a memory key or a similarly portable data-storage device. In short, it was an inside job by someone with access to the DNC’s system. This casts serious doubt on the initial “hack,” as alleged, that led to the very consequential publication of a large store of documents on WikiLeaks last summer.
  • Forensic investigations of documents made public two weeks prior to the July 5 leak by the person or entity known as Guccifer 2.0 show that they were fraudulent: Before Guccifer posted them they were adulterated by cutting and pasting them into a blank template that had Russian as its default language. Guccifer took responsibility on June 15 for an intrusion the DNC reported on June 14 and professed to be a WikiLeaks source—claims essential to the official narrative implicating Russia in what was soon cast as an extensive hacking operation. To put the point simply, forensic science now devastates this narrative.

“This narrative” has been a cornerstone of the effort, undemocratic and indefensible, to undermine the legitimacy of Donald Trump’s Presidency from the beginning. It was launched as a primary rationalization for Hillary Clinton’s stunning loss, James Comey and a sexist, racist, stupid electorate being the others. As the Nation writes,

“The evolution of public discourse in the year since is worthy of scholarly study: Possibilities became allegations, and these became probabilities. Then the probabilities turned into certainties, and these evolved into what are now taken to be established truths. By my reckoning, it required a few days to a few weeks to advance from each of these stages to the next. This was accomplished via the indefensibly corrupt manipulations of language repeated incessantly in our leading media.”

The Nation’s report, essentially declaring that a major element in the “Russiagate” narrative, the DNC hacks, is fiction, that the intelligence agencies that declared it otherwise are wrong, and that Wikileaks, Russia, Putin and Donald Trump have been correct all along is noteworthy because the publication is no ally of the Republicans or Trump, but their declared intractable foes. This is an ideological publication, squarely in Bernie Sanders’ camp because it is run by Socialists like Bernie. But bias doesn’t necessarily make you stupid. The Nation has been around for a long time because while its analysis is colored by it view of humanity and the world, it has largely avoided the kind of dishonesty and distortion that are slowly destroying the credibility of CNN, Rolling Stone, the New York Times and others. The Nation has strived to maintain its integrity, not always succeeding, but obviously trying. Its staff believes that the truth supports its dedication to socialism, so it does not usually try to hide the truth—unlike the mainstream media reporters, for example, who apparently tried hard to make the troubling episode of Bill Clinton’s meeting with Loretta Lynch go away. 1. Less than two weeks after social justice bullies on social media chastised actor Mandy Patinkin for agreeing to take the place of a black actor in Broadway’s “Natasha, Pierre & The Great Comet of 1812,”  causing the politically impeccable Mandy to withdraw with humble mea culpas, and the “woke” creator of the  the Tony winning musical to humbly kowtow to the new show business principle that it is better for a show to close entirely, putting everyone out of work, than for a white actor to take over a role from a black actor who took over the role from a white actor in the first place, “The Great Comet’s” producers announced that the show will close in September.

Good job, everybody!

2. First Amendment incursions are creeping in from all sides and all angles so fast it’s hard to slap them down. Cowboy Joe West, the major leagues’ longest-serving umpire,was just suspended for three days for comments he made a in an interview with USA Today published on June 20, to mark   the umpire’s 5,000th regular-season game. Asked which player beefed most frequently about his calls, West said “it’s got to be Adrian Beltre.” Beltre, who recently punched his own ticket into the Hall of Fame by getting his 3000th hit, is apparently something of a human Bermuda Triangle for ethics controversies.

“Every pitch you call that’s a strike, he says, ‘Whoa! Whoa! Whoa!,'” West was quoted as saying.  “I had a game with him recently and the pitch was right down the middle. He tells me, ”That ball is outside.’ I told him, ‘You may be a great ballplayer, but you’re the worst umpire in the league. You stink.'”

MLB suspended West for three days, telling the umpires union in a letter that the discipline was in response to an “appearance of lack of impartiality.” Beltre has said that he never assumed West was being anything but facetious. The umpires union is livid, and West is likely to file a grievance.

There are two theories about this strange episode in the Marshall household. I think it’s more evidence of slippage on the societal slope to speech suppression. My wife thinks baseball is laying the groundwork for replacing umpires on balls and strikes with robo-calls. After all, robots aren’t biased.

I hope she’s right, but I doubt it.

3. Why don’t Democrats want to clean up eligible voter rolls?the Justice Department filed a Supreme Court amicus brief  supporting the state of Ohio as it fights to defend its law that purges names from voter rolls if  those names aren’t attached to votes for a significant period. This reverses the Obama Administration’s position, which backed a lower court decision  that it ran afoul of the 1993 National Voter Registration Act.

Why does Ohio want to de-register voters who don’t vote for two years, then are sent notices asking that they confirm their voter registration, don’t respond to the notices ,and continue to not vote for another four years? I assume it is because the state doesn’t want dead people on the voter rolls. Why do Democrats want the names of dead people listed as eligible voters?

Morning Ethics Warm-Up: 7/30/17

Good Morning!

(I’m starting this post just a few minutes before noon, thank to a WiFi outage. I’m sorry.)

1. I finally saw “Passengers,” which most people and critics seemed to hate. I see no obvious inferiority to the over-praised and honored “The Martian” or “Gravity,” especially the latter, which bored me to tears, but never mind: it’s an ethics movie. It is also a moral luck movie, and that drove me crazy. I’ll bet so many viewers (SPOILER ALERT!) saw the film and came out saying, “She had to forgive him, because if he hadn’t awakened her prematurely to keep him company, everyone would have died!”

No, no, no! His (Chris Pratt’s) conduct toward her (that’s Jennifer Lawrence, and anyone who wrongs Jennifer Lawrence deserves the torments of Hell) was just as bad–and it was horrible—whether it turned out well by chance or not. Subsequent discoveries or unpredictable events cannot make an unethical act retroactively ethical.

2. San Francisco’s Medicaid program sends illegal immigrants this letter:

When the anti-Trump deranged argue that the President is “crazy,” my stock answer is going to be that nothing he has said or done is as “crazy” as the position that it is right and just to officially encourage foreign citizens to breach our borders, defy our sovereignty and break our laws….and the people trying to use the 25th Amendment to execute a coup are exactly the people who think the letter above is compassionate and right. (Believing that a coup is in anyone’s interest is also demonstrably nutsy-cuckoo, but that’s another issue.)

3. I am really going to be disappointed if NPR and PBS don’t get zero-ed out of the budget. I may be stuck with biased and incompetent journalism, but I shouldn’t have to pay for it.

In a segment of NPR’s “All Things Considered” this week (Yes, I generally think the show is excellent, but that’s not the point) about the “restorative justice” approach to campus sexual assault, reporter Tovia Smith quoted Columbia University graduate Emma Sulkowiczs, aka “Mattress Girl,” as a “survivor” of rape.

She’s not a survivor; she was a harasser, and Columbia just paid a financial settlement to her victim for permitting her to proclaim him as a rapist when the evidence didn’t back the claim. Columbia doesn’t believe Sulkowiczs was raped, and her accusation has been thoroughly discredited. Why in the world would NPR choose this cruel and discredited woman to profile while discussing actual campus sexual assault, and how could it be ethical journalism to still refer to her as a rape survivor?

Smith’s tweeted response to criticism was as damning as the choice of “Mattress Girl” itself:

A Congress Of Assholes*? Maxine Waters Demolishes Basic Principles Of Ethical Comportment

I’ll spare you the horror of having to watch the entire video above, and display the transcript of Watts Rep. Maxine Waters as she abused Treasury Secretary  Steve Mnuchin at a House Financial Services Committee hearing this week. Waters continued to interrupt Mnuchin as he attempted to answer her hostile cross-examination. Her mantra “reclaiming my time” expressed her ridiculous position that any words from the guest of the committee that didn’t specifically address her questions to her satisfaction was an intrusion on her time for shameless grandstanding. Note the committee chairman’s explanation to Mnuchin that while the rules can direct how testifiers should be treated, they cannot dictate how they will be treated. In other words, if a member is determined to behave like a rude, disrespectful jerk, she will.

Here’s the mind-blowing transcript. It didn’t literally blow my mind, hence no KABOOM! designation, because Waters is such a well-known and beyond a shadow of a doubt hyper-partisan fool and embarrassment to the nation that pretty much nothing she might do or say can shock me sufficiently. Does it not occur to Africa-American majority districts that electing Representatives this incompetent, shrill and offensive is not in their best interest, even though the Democratic Party and the news media bend themselves in half to pretend she isn’t a disgrace.

The Unethical, Un-American, State Travel Bans

Recently various states have decided to punish their fellow members of the United States of America for daring to adopt laws of which they do not approve. The method: bans on government employees traveling to those states on business and the state dime, with the hope that the state’s lead will discourage private travel as well. Why are they doing this? Oh, many reasons, I suppose, all of them insufficient to justify the conduct, which is unethical.

Some of the state legislators who pass these bans, and the governors who sign them, want to place economic sanctions on the other states, even if the effects are limited. After all, they can’t stop the citizens of the states from traveling, only government employees. But pressure is pressure, and the limited measures are an attempt to meddle in the democracy of those other bad states. Another reason is virtue-signalling, as a state seeks to show that it supports a group that is politically strong in that region against another state’s policies that displease it. A third reason is the related motive of grandstanding. Finally, a state might use a travel ban to strike back at another state that is banning state travel there. An eye for an eye, a voucher for a voucher.

Yes, this will end well.

I wish I didn’t have to say this, because I know everyone thinks I pick on liberals, progressives and Democrats, but it’s the Democratic majority states that are using this weapon, especially…well, can you guess? Oh, come on, guess. Yes, the major offender is California. Others are New York, Minnesota, and Washington state.

“Our country has made great strides in dismantling prejudicial laws that have deprived too many of our fellow Americans of their precious rights,” says the public statement of California’s Attorney General Xavier Becerra of California, who has been instrumental in getting the Golden State to limit trips to Alabama, Kansas, Kentucky, Mississippi, North Carolina, South Dakota, Tennessee and Texas. You know, those conservative bad places, where people with sub-normal IQ’s cling to their guns and Bibles. His quote is a classic of arrogant, doctrinaire, narrow-minded, elitist self-righteousness. Ethics Dunce: Attorney General Jeff Sessions

There were many good reasons to oppose Jeff Sessions as President Trump’ nominee to be the next Attorney General. One, which I focused on, was that his nomination foolishly fed into the Democratic slur that Trump and the Republicans were racists. Sessions had been successfully tarred decades ago based on some racially-insensitive comments he had made, and even though tangible evidence of any racial bias was thin, it was foolish for Trump to court a controversy when there were plenty of equally or more qualified candidates. Another reason was that Sessions had been an early supporter of Trump’s candidacy for the GOP nomination, which is signature significance for stupidity, poor judgment or recklessness. Take your pick.

Now Sessions has announced, while speaking at a National District Attorneys Association conference, that the Justice Department will issue new directives to increase the federal government’s use of civil asset forfeiture, an unethical, Constitutionally dubious practice that needs to be cut back or eliminated.

“[W]e hope to issue this week a new directive on asset forfeiture—especially for drug traffickers,” Sessions said. “With care and professionalism, we plan to develop policies to increase forfeitures. No criminal should be allowed to keep the proceeds of their crime. Adoptive forfeitures are appropriate as is sharing with our partners.”

 

Utah’s Republican Senator Mike Lee expressed alarm at Sessions’ announcement yesterday, saying in a statment, “As Justice Thomas has previously said, there are serious constitutional concerns regarding modern civil asset forfeiture practices. The Department has an obligation to consider due process constraints in crafting its civil asset forfeiture policies.” Justice Clarence Thomas’ had written in his dissent in an asset forfeiture case last month that forfeiture operations “frequently target the poor and other groups least able to defend their interests in forfeiture proceedings.” Continue reading →

If Snopes Is Trying To Claw Its Way Back To Credibility And Respect, This Is Certainly A Good Start…

One of the most trafficked posts on Ethics Alarms in 2016 was this one, almost exactly one year ago, in which I described the deterioration of the Snopes “urban legend” website into a partisan, social justice mouthpiece that was spinning for the Democratic Party and Hillary Clinton.  It recieved so many shares that Ethics Alarms was a target of Hillary’s paid online trolls, who wrote almost identical comments with the same talking points. Few posts here have ever resulted in so many banned commenters. Since that post designating Snopes as an Unethical Website, I stopped using the site, as I said I would until it repented and reformed…

With all the misinformation on the web, a trustworthy web site like Snopes used to be is essential. Unfortunately, a site that is the purveyor of falsity cannot also be the antidote for it. I’ll miss Snopes, but until it acknowledges its ethics breach and convinces me that the site’s days of spinning and lying were a short-lived aberration, I won’t be using it again.

Apparently I wasn’t the only one. Snopes’ reputation is thoroughly tarnished. Thus I can’t tell whether today’s sudden counter-partisan effort is born of sincerity or a survival instinct, but it is certainly welcome, and a shock.

The new post is titled,

The Lies of Donald Trump’s Critics, and How They Shape His Many Personas: An in-depth analysis of the false allegations and misleading claims made against the 45th President since his inauguration

I find the article somewhat meandering and scattershot, but it still constitutes an important effort to splash cold water on the anti-Trump fever. That splash should be especially effective because Snopes had established itself as such a reliable ally to those doing the lying Snopes condemns.

To my knowledge, none of the other alleged fact-checking columns have been this direct and this thorough in pointing out the phenomenon that Ethics Alarms has been discussing for more than a year. We shall see if the new entry was just a ruse so Snopes could recover lost readers and start spinning for the Left again with renewed influence. I recommend wariness. Nevertheless, this essay is much needed, and we should give credit where credit is due.

Good morning!

1. It is a matter of constant fascination to me how all of President Trump’s personal lawyers appear to be flaming jerks, whatever their legal skills may be. Here’s an example from this week: Marc Kasowitz, President Trump’s personal attorney on the Russia conspiracy theory investigation, was contacted by a stranger, a retired public relations professional, who had read ProPublica’s unflattering story on Kasowitz. He sent the lawyer an email with the subject line: “Resign Now.’’

Kasowitz used the 30 minutes between 9:30 p.m. and 10 p.m. to bombard the man with threats and epithets, writing such dignified  messages as,

“I’m on you now.  You are fucking with me now Let’s see who you are Watch your back , bitch/”

“Call me.  Don’t be afraid, you piece of shit.  Stand up.  If you don’t call, you’re just afraid.” 

“I already know where you live, I’m on you.  You might as well call me. You will see me. I promise.  Bro.”

Nice.

This isn’t a legal ethics violation, though it almost certainly would be if Kasowitz were addressing an opposing counsel in such a manner. It’s just generally unethical as outrageous, inexcusable, gratuitous incivility, reflecting poorly on him, his profession and his client. A client who was minimally concerned about ethics would fire him.

2. Speaking of a minimal concern for ethics, Trump’s defense of his son’s dumb but legal meeting with the Russian lawyer promising dirt on Hillary included the statement that “most people would have taken that meeting.” Once again, we have evidence that Donald Trump literally doesn’t know what ethics is. Oh, his rationalizations are the same ones the average ethically-retarded citizen uses—this is why he is President. They are still rationalizations. Yes, Mr. President, and most people would accept extra money from an ATM and not tell the bank about it. And most people lie to get out of trouble. And most people do all sorts of unethical things, which doesn’t make them ethical, responsible or appropriate.

He is the President, though, and this is how we will inevitably become a nation of assholes. 

3.  And speaking of assholes, there is Nancy Pelosi. Because a female journalist was blocked from access to the House of Representative by a Sergeant of Arms who properly pointed out that she was wearing a sleeveless dress, always forbidden according to Congress’s dress code, we were suddenly subjected to the false narrative that those mean, sexist Republicans were abusing women again, as well as being typically antediluvian in their ideas about propriety. (Men can’t go sleeveless either, but never mind.) Paul Ryan was the target here, as the Speaker is officially charged with enforcing such rules. The narrative was not really about the dress code, but just part of the over-all “Get Republicans” news media strategy to make the party as unpopular as possible. Yesterday Paul Ryan plausibly said that he wasn’t aware of the rule in question, and was happy to amend it. Then Nancy Pelosi piled on, tweeting, “Glad to see [Speaker Ryan] is updating the dress code for the House Floor. These unwritten rules are in desperate need of updates.”

Pelosi was Speaker for four years, her tenure ending just six years ago. The same rule Ryan is being attacked for was in place during her entire tenure. Why didn’t she fix it herself, dedicated feminist that she is? Her tweet is such obvious hypocrisy that it calls attention to the double standards employed by Democrats, the news media and women. Pelosi could have cheered the change without appearing to duck her own responsibility for their continuation. Instead, she acted as if she was an innocent bystander.

Nancy Pelosi is a major reason the Democratic Party has become a party of assholes. Who but an asshole would tolerate a national leader like this as the face of his or her party in Congress? Are Democrats proud of this woman? Do they endorse her tactics and rhetoric? We have to assume so, don’t we? Continue reading →
