It looks as if New England Patriots head coach Bill Belichick cheated…again. If the NFL cared about such mundane matters as integrity, fairness, honesty and ethics, it would take the kind of appropriate action any other organization is obligated to take when the evidence shows that a high-performing member of the organization is a rotten apple: throw him out, or at least discipline him and his team severely.

The Destructive, Useful, Unethical Presumption of Bigotry, Part 2: The Oscar “Snub”

For the second time in nearly two decades, and for the first time since 1998, the Oscars will be awarded to only white acting nominees. This, then, if you listen to the caterwauling race-baiters, is because Hollywood is racist. The Academy’s voters just hid it well since 1998, that’s all. Does that make any sense to you?

There are few more infuriating and transparently illogical examples of an unfair slapping down of the race card than looking for bigotry in the notoriously arbitrary, bias-soaked, essentially meaningless choices for “best” in the various Academy Award movie-making categories. Yet the race card sharks were up to the task.  Naturally, the authority on the subject was Al Sharpton, he whose own performance quality on his MSNBC TV show is so amateurish that it would be shut out in any community theater awards.

“In the time of Staten Island and Ferguson, to have one of the most shutout Oscar nights in recent memory is something that is incongruous,” Sharpton told The Daily News. Wait, what??? Incongruous is the assertion that the nominations for film-making excellence should be influenced in any way by how many blacks are killed resisting arrest. Anyone who finds that to be a logical argument for why more black actors should have been nominated for Oscars is useless to any rational discussion of the issue. I want a show of hands. Ethics Alarms Mail Call: Mt. Holyoke Ditches “The Vagina Monologues” As “Non-Inclusive,” and the Misuse of Kindness

VaginaI’m an ethicist who often writes on college controversies, and I make no secret about my double life in professional theater, so it figures that my inbox would include more than one query about Mt. Holyoke College’s decision to end its annual student performance of Eve Enlser’s “The Vagina Monologues” on the grounds that it is now admitting women without vaginas—I know, it’s confusing–who would feel excluded from what was supposed to be an inclusive experience and statement for the all-women’s school.

From Campus Reform:

The annual production of the play is part of a country-wide tradition to perform Eve Ensler’s Vagina Monologues on Valentine’s Day to raise awareness about gender-based violence and usually coincides with the V-Day campaign. The proceeds are donated to sexual assault prevention organizations or women’s rights organizations. This year, however, Mount Holyoke’s Project Theatre Board is defying tradition by permanently retiring the play. In a school-wide email from the Theatre Board, a representative from the group, Erin Murphy, explained the problems with the play and the reasoning behind its discontinuation.

“At its core, the show offers an extremely narrow perspective on what it means to be a woman…Gender is a wide and varied experience, one that cannot simply be reduced to biological or anatomical distinctions, and many of us who have participated in the show have grown increasingly uncomfortable presenting material that is inherently reductionist and exclusive,” the email, obtained by Campus Reform, said.

Replacing the play will be Mount Holyoke’s own version that will be trans-inclusive and fix the “problems” supposedly perpetuated by Ensler. Murphy also claims that there are problems with race, class, and “other identities” within the play. The new production, comprised of students’ monologues, will be performed in a fashion reminiscent of the feminist classic. The program will be performed alongside the College’s Peer Health Educators, an on-campus student-led group that provides education and workshops for students, including a workshop on how to use sex toys properly.

Mamoru Samuragochi, the composer sometimes known as “The Japanese Beethoven” because he composed critically acclaimed works despite being deaf, was exposed as double fraud: he didn’t compose the works that made him Japan’s most popular classical composer, and he isn’t even really deaf!  Samuragochi hired a musical ghostwriter named Takashi Niigaki to compose more than twenty compositions for Samuragochi since 1996.

Unethical Artist Of The Year

Performance artist Maximo Caminero, who  walked into the Pérez Art Museum in Miami, entered a special exhibit of sixteen ancient Chinese vases painted over in bright colors by celebrated Chinese dissident artist Ai Weiwei, picked up one of them, and immediately after a security guard instructed him not to touch the exhibit, allowed the vase to fall from his hands, shattering into bits. Caminero admitted that smashing the pottery, which was valued at a million dollars,  was intentional, and was his protest against in support of local artists like himself whose work is not exhibited at the museum while the art of international artists like Weiwei is.

Unethical Veterinarian Of The Year

Fort Worth, Texas veterinarian Lou Tierce lost his license for five years as a result of, among other transgressions, his telling the owners of a Leonburger (it’s a very big dog) that their pet was terminally ill and had to be euthanized, then secretly keeping the dog alive in a small cage so he could use Sid’s blood for transfusions to Dr. Tierce’s other canine patients. Eventually an assistant at the clinic blew the whistle and alerted Sid’s owners, who rescued their dog and sicced the law on the worst veterinarian since Dean Jones menaced Beethoven.

Dr. Nancy Snyderman, NBC’s medical expert, endangered the public by defying a voluntary quarantine for possible Ebola exposure,  because she just couldn’t bear to be without her favorite soup.

Integrity and leadership are not the same thing, Mayor…

New York City Mayor Bill de Blasio’s relations with his own police force could not be worse, and this is not in the best interest of the citizens both the mayor and the police are duty-bound to serve. Can the rift be repaired?

This week de Blasio ruled out one avenue of peace: he said he would not apologize for his remarks following the Eric Garner grand jury decision not to bring charges against the officer who appeared to precipitate the unarmed black man’s death by using a choke-hold. The mayor said…

“You can’t apologize for your fundamental beliefs. The things that I have said were based on my beliefs, the truth as I know it. Can we do a better job communicating, and listening, and deepening an understanding of what our officers need? Yes.”

Fascinating.

I can’t think of a better example of a dilemma where the most ethical conduct is still irresponsible leadership, and thus, from the perspective of a leader’s obligations, unethical.

From an isolated perspective, de Blasio is asserting his integrity. “I could apologize and help smooth over my toxic relationship with the police, but that would require me to be insincere, and I’m not going to do that,” he is saying. He is saying that his constituents can trust him to be straight and honest, and if that means that he must pay a political price, he will pay it. This is admirable, on a human level. Praiseworthy…in a vacuum.

De Blasio, however, doesn’t have the luxury of being ethical in a vacuum. He is the mayor of a city with a lot of problems, controversies, obstacles to effective governance and people in need. The context of all of his words and actions must be his duties to address those issues, and his integrity, in this case, must be subordinate to getting the job he was elected to do done. Going far afield from the post it followed, the Comment of the Day from texaggo4 examines the tricky question of whether militant, radical or extremist Muslims can be fairly regarded as representative of the faith. Taking off from a comment by Penn (in the blocks), tex examines various ways of analyzing the problem, in a long and fascinating exposition. Here is his Comment of the Day on the post “Pop Quiz: The Bottom of the Slippery Slope.”

“Which brings me an item I almost ran yesterday re the specious anti-free-speech posts some people were making and/or agreeing with. I thought Beth had pretty much covered the subject but … no. As (self-confessed) Christian writer and psychiatrist M. Scott Peck – Lt. Col. who served as the U.S. Army’s Assistant Chief Psychiatry and Neurology Consultant to the Surgeon General of the Army – explained, “(T)there are different stages of spiritual maturity. Fundamentalism – whether it be Muslim, Christian, Jewish or Hindu fundamentalism – is an immature stage of development.

‘Indeed, a Christian fundamentalist who kills others in the name of religion is much more similar to a Muslim – or Jewish, Hindu or Buddhist – fundamentalist who kills others in the name of his religion than to a Christian who peacefully fights for justice and truth, helps the poor, or serves to bring hope to the downtrodden.’

If we can’t agree to differentiating fundamentalists (extremists by definition) from (comparatively) rational folks, we will continue to have straw man arguments that lump every one together under a label that is useless for discussion.”

I’ve read some of Peck’s works. Pretty good. But I think he’s inaccurate on the characterization of “Fundamentalism”. He’s fallen for the same trap in mislabeling that the main stream media uses. Certainly spiritual immaturity involves a great deal of emotionalism, which typically manifests in anger, when a person’s beliefs are challenged. Anger, which can lead to violence, is best described as “Militancy”, not “Fundamentalism”.

The Special Needs Student, the Compassionate Teacher and the “Awww!” Factor (UPDATED)

Regular readers here are familiar with the “Ick Factor,” the common phenomenon where a situation that causes an emotional response of revulsion, disgust or fear is labelled unethical when there is nothing unethical about it. Many kinds of conduct are icky, but still on the right side of ethics, if only one can put aside the gag reflex. The reverse of the Ick Factor is the less common “Awww!” Factor, where particular conduct seems loving, caring and nice, but is in fact unethical in one or more respects. Such is the case of New York City special needs teacher Debra Fisher.

In October, Fisher was suspended when e-mails were discovered on the school computer system showing that she had been spending school time raising funds for a special project on behalf of Aaron Phillip, a thirteen year old special needs student who is an aspiring animator with his own blog. The project’s goal was to raise $15,000 for a nonprofit devoted to developing Aaron’s talent, an organization called “This Ability Not Disability” founded and administered by Fisher.

The problem was that while her efforts on behalf of the student were supported by the school, Fisher, an occupational therapist at Public School 333 with nine years of service, did not have permission to perform them during school hours. Thus she was suspended for six weeks. Now she is suing the school system for back pay, telling reporters, “I’m just trying to fight for what I believe is right.”

If she believes she is right, then she shouldn’t be working at the school at all, because she is in fact dead wrong.

2014 Conflicts of Interest of the Year

  • Conflicted Elected Official: Philadelphia State Senator LeAnna Washington. This is always an entertaining category. Washington was convicted of using her tax-payer financed staff to organize a yearly campaign fundraiser around her birthday party. When one staffer complained that this was illegal, she reportedly replied, according to his grand jury testimony:

“I am the fucking senator, I do what the fuck I want, and ain’t nobody going to change me. I have been doing it like this for 17 years. So stop trying to change me.”

  • Conflicted Journalist: CNN sent Jay Carney, fresh off his assignment as President Obama’s official spokesman, defender and spinmeister, to cover his ex-boss’s speech.
  • Conflicted  “Non-partisan” Watchdog: CREW. The Center For Responsibility and Ethics in Washington and its chief, Melanie Sloan, finally came clean (after falsely claiming non-profit status as a non-partisan organization for years) by making David Brock, head of the openly partisan, foaming-at-the-mouth anti-Republican media watchdog Media Matters its Chairman of the Board, essentially merging the two groups.
  • Appearance of Impropriety Award: Rep. Steve Scalise (R-La), Republican Whip. It is not certain yet whether Scalise knowingly spoke to a group of white supremacists in 20o2, inadvertently spoke to the group, or just spoke to another group meeting in the same venue before the David Duke-affiliated group of racists started comparing sheets. It isn’t even clear that Scalise knows, but everyone should agree that it looks awful no matter how you categorize it, making the fiasco a classic appearance of impropriety situation. If the Republicans were smart, they would dump him.

Ethically Clueless Voters of the Year

New York’s 11th Congressional District, which contains Staten Island and parts of Brooklyn. These alert and ethical citizens sent back to Washington thuggish and crooked Rep. Michael Grimm (R), then facing a 20-count indictment by federal authorities for fraud, federal tax evasion, and perjury, having earlier distinguished himself by threatening to kill a reporter and being recorded doing so.

Wendy Davis, Democratic candidate for Texas Governor, offered an ad attacking her wheelchair- bound opponent that 1) appealed to bias against the disabled 2) misrepresented the duties of a state attorney general 3) misrepresented the facts of the cases the ad referred to and  4)  deceived the public regarding the ethical duties of lawyers, which Davis, a lawyer, presumably understands. On Saturday night, the New England Patriots ran a series of plays that exploited the complicated receiver eligibility rules, confusing the Baltimore Ravens and officials, and allowing the Pats, who were trailing badly, to get back into the game. They eventually won in a thriller.

Ravens head coach John Harbaugh was so upset during the sequence that he drew an unsportsmanlike conduct penalty. Later, he stopped just short of calling new England coach Bill Belichick a cheater. “[I]t’s a substitution type of a trick type of a thing,” Harbaugh told reporters after the game. “So they don’t give you the opportunity, they don’t give you the chance to make the proper substitutions and things like that. It’s not something that anybody’s ever done before. The league will look at that type of thing and I’m sure that they’ll make some adjustments and things like that.”  Indeed, the NFL will investigate whether the officiating crew gave the Ravens proper notice that an eligible Patriots player would be ineligible for a given play.

(Awarded to the unethical public figure whose prominence, popularity and success most corrupts the public’s ethical values)

Janay Palmer Rice, beloved punching bag of NFL star Ray Rice, who was caught on camera smooching with her man shortly after being cold-cocked by him in a hotel elevator, married him, and has repeatedly defended her husband, prompting confused female pundits to defend her. She is not only the embodiment of Rationalization #42. The Hillary Inoculation, or “If he/she doesn’t care, why should anyone else?”, she is also a good bet to get some young women killed by giving them a role model who stands for standing by your abusive man with the hard right hook.

Double Standard Of The Year

In a year of double standards, the treatment of soccer star (and accused child abuser) Hope Solo by her sport, feminists, the media and the public takes the prize. The standard, as I understand it, is that big, strong female athletes can beat up smaller, weaker family members with impunity, and it’s no big deal, but when a male athlete does the same, he is scum. Got it.

Uncivil U.S. Official of the Year

Victoria Nuland, Assistant Secretary of State for European and Eurasian Affairs and the top American diplomat in Europe, was caught saying in a viral Youtube video saying “Fuck the EU.”  Now that’s diplomatic. Of course, she wasn’t fired, because she works for the Obama Administration

First Lady Michelle Obama, who helped her husband make the U.S. look weak and ineffectual (he needs no help), by engaging in this ridiculous effort at hashtag diplomacy. Those kidnapped girls were never found, and Boko Haram, the Nigerian terrorist group that took them, I learned today, just killed a reported 2000 more victims. Time for another sad picture, Michelle!

Most Unethical Sports League

The NFL, last year’s winner, was even more unethical this year, with the Ray Rice and Adrian Peterson fiascos, Commissioner Roger Goodell showing no innate instinct for right and wrong and both the league and its teams making up rules and policies according to talk show calls, polls and wet fingers in the air. Meanwhile, it’s still making billions paying young men to lobotomize themselves. What a great sport.

Sports Cheat of the Year

Alex Rodriguez, suspended Yankee star, had denied, denied, denied, threatened to sue Major League Baseball and the union, and insisted that he had not, as an investigation had determined, used performance enhancing drugs supplied by Biogenesis. Then, just as his season-long suspension was lifted, it was revealed that A-Rod had, under oath, admitted using steroids from 2010 to 2012.

She didn’t do anything unethical; she just advocates ethics rules that would eliminate the core of legal ethics, proving that she doesn’t understand her own profession.

Unethical Judge of the Year

Wade McCree, the handsome devil pictured above (he circulated this selfie), who, presiding over a felony child-support case, conducted a secret sexual relationship with the woman seeking support from the defendant. This was just the latest of his embarrassments.  Runner up: Texas District Judge Jeanine Howard, who handed down a stunningly lenient sentence of probation and 250 hours of community service at a rape crisis center for a man who confessed raping a 14-year old girl at her school.

 

Unethical National Broadcast Journalist Of The Year

CNN’s Carol Costello. She was biased, smug and incompetent all year long, but reached her nadir when she gleefully played a recording of Bristol Palin explaining to police how she had been assaulted, saying to her viewers, “You can thank me later.” She refused to apologize on the air, or to Palin.
