[C]onsensual relationships with adults don’t seem like a big deal. Sure, the conflict of interest of sleeping with someone in your class is deserving of discipline, but, really, in a state where you can marry your sister, is it a fireable offense to hookup with a twenty-something attorney-to-be? Obviously, if there were more serious allegations that would be another matter, but so far we’ve only learned of this more benign brand of misconduct.

This commentary, from a regular writer for a website that covers law schools, is so ethically obtuse and legally ignorant that he should be fired. “Not a big deal”? Sexual harassment at law firms is a very big deal as well as a very big problem, and a law professor who flagrantly violates an anti-harassment policy like the prohibition against professors treating the student body as their own personal dating bar is teaching that seeking sex with subordinates is culturally acceptable in the legal profession. It isn’t. It never has been.

The professor’s conflict of interest is the least of his self-created problems. First, there is no valid consent in such cases. The professor has real and perceived control over students’ academic success and legal career viability. This is classic inequality of power that gives a professor implied leverage over a student’s “consent” to sexual relations. Moreover, the knowledge that a professor is having sex with students constitutes third-party sexual harassment. Do other students assume that they are expected to have sex with the professor if he requests it? Is the professor looking at female students as mere sex objects? Are students that provide sexual access more likely to get high grades? What happens to students who say “no”? This creates a hostile environment for study and education. Continue reading

The Indefensible “Nigger” Double Standard

Andrea Quenette, a University of Kansas communications professor, has been on paid leave for four months after a group of her students filed a complaint that she had used the racial epithet nigger in  response to a question in class. She was asked about  her views on the best way to talk about race with  students, and replied that as a white woman, she found it  difficult to relate to minority groups’ challenges because she has not experienced racial discrimination herself.  She added that unlike other campuses where there had been over racist incidents, she “had not seen “nigger” spray painted on walls at KU.”

For saying this, she was subjected to campus-wide humiliation, an interruption in her teaching career and an investigation, of what I cannot imagine. She was talking about the word, she is a communications professor, words are her business, and it is impossible to talk about the word “nigger” seriously without using it (and no, codes like “N-word”  are either the exact same as using the word itself, or politically correct conventions that show just how silly word-o-phobia really is. Take your pick.) Finding offense with her using “nigger” in this context is simply a “gotcha” by race-baiting students. and as nonsensical as the gag in “The Life Of Brian” where the priest who condemns a Hebrew citizen by committing the blasphemy of speaking the name of God, “Jehovah,” is stoned by the crowd because he speaks the forbidden name in order to utter the condemnation. Nevertheless. Professor Quenette, while keeping her clearly worthless job, was sentenced to mandatory cultural competency training, a.k.a. political correctness indoctrination, and to have a second faculty member work with her to ensure that her curriculum include more diversity.

If she had enough sense, courage and integrity to be qualified to teach at the college level, she would have told the school to take its job, its curriculum, its rejection of academic freedom, its craven capitulation to race-bullying and its disgusting treatment of faculty members and shove them all. But no, she’s a good, submissive  social justice zombie who just made a mistake, and it’s time for her to grovel.

Spurred by this miserable marker of how low higher education has sunk, my indispensable issue scout Fred puckishly sent me this, a Washington Post opinion piece from a year ago. The column, by  African American free-lancer Michael Arceneaux, was sparked by an incident I also commented upon a year ago, when Kentucky guard Andrew Harrison muttered “Fuck that nigga”  behind his hand into a live microphone while answering a post-Final Four game news conference question about Wisconsin player Frank Kaminsky, whose heroics had led to Kentucky’s 71-64 victory.  My position on Harrison, then as now, was this: Continue reading

Adam LaRoche Drama Epilogue: A Reflection On Life, Kids, Baseball And Ethics

When last we visited Adam LaRoche a couple of days ago, he was retiring from baseball (and abandoning his 13 million dollar 2016 contract  to play for the Chicago White Sox) because team executive Kenny Williams asked that he not have his 14-year-old son Drake living and traveling with the team, as well as being being perpetually in the clubhouse, as he was all last year. Today LaRoche released a remarkable statement explaining his decision.

Comment of the Day: “Ethic Quiz: ‘Springtime For Hitler’ Ethics”

This most recent  ethics thread commentary from Rick Jones (a.k.a. “Curmie,” who chronicles education fiascos, among other matters, during the year on his own blog) involves the recent kerfuffle over a high school production of “The Producers” having its Nazi decorations stripped away. I confess that I specifically requested Rick’s take on this one, knowing him to be a theater colleague as well as a teacher, and he did not disappoint….except that he uses the British spelling of “theatre.”

Here is Rick’s Comment of the Day on the Ethics Quiz: “Springtime for Hitler” Ethics.

Oh, Jack… You couldn’t just let me have a spring break without feeling compelled to reply to one of your posts, could you?

And… as I suspect you may have been expecting if not hoping, I agree with your arguments but disagree with your conclusion.

First, let me confess to ignorance of the stage version of The Producers. I know the film, of course, but being neither a big musical theatre guy nor made of money, I’ve never actually seen the play. Assuming it to be substantially similar to the film, therefore, is for me (but not for those more informed) a risky proposition.

It is not clear whether the school’s administration formally signed off on the choice of play, but de facto they did: the rights and royalties for a musical will cost—depending on a variety of factors such as venue size, number of performances, and ticket prices—hundreds or (more likely) thousands of dollars, and no high school theatre director can just write a check on a school account for that amount of money. Expenditures of that size need approval.

So here’s where I agree with your point that cultural illiteracy was very much at play from the beginning of this saga. I’m not suggesting that every high school administrator should have seen the movie or the play, but certainly the “Springtime for Hitler” shtick has long since passed into the public consciousness. I was too young (in junior high, perhaps?) to have seen the film on its first run, but I knew about the campy production number long before I actually saw the film when I was in high school or college. Similarly, I know that “I will take what is mine with fire and blood” is a ”Game of Thrones” reference without ever having picked up one of the books or tuned in to the television show. A competent administrator would at the very least have known what s/he was signing off on. Or… you know… asked: that’s an option, apparently.

Ethics Quote Of The Week: Washington Post Sports Columnist Norman Chad On “March Madness”

“People often ask me, “Why do you ignore college basketball?” Really? That’s like asking a vegan, “Why do you ignore cattle farms?…Why wouldn’t I ignore college basketball? They just round up the usual suspects every year, and, believe you me, these people are awfully suspect. The game is rotten at its core; it’s only cheating if you get caught, and if you get caught, you’re only liable if you’re losing.”

—- Sports columnist Norman Chad, on why he doesn’t follow the NCAA basketball tournament.

To which I reply, “Exactly.”

As Chad notes in his column, big-time college basketball is pure dribbling corruption. The players are exploited and tossed aside, few of them graduating and most leaving with little real education. The athletic programs warp school priorities and eat up institution resources that should be devoted to the curriculum,  the typically coaches are paid more than any three faculty members combined, and they teach their charges that cheating pays. Continues Chad in his inimitable style:

But the players don’t bother me – they are like cattle, used for two percent milk and tenderloins until their services are exhausted. It’s the coaches that bother me – the See No Evil Hear No Evil Do No Evil Block/Charge No Evil shim sham flimflam riffraff sitting on the bench in those fine suits with their fat wallets.

Jim Boeheim? A bum. John Calipari? Bum. Rick Pitino? Bum. Roy Williams? Bum. If these fellas are earning big paychecks from institutions of higher learning, institutions of higher learning must be in a different business than they once were.

Boeheim and Co. run the whole shooting match, and no matter what they do, you can’t run ‘em out of town unless they miss March Madness three straight times. Which brings us to Larry Brown. He’s at his third college coaching stop – UCLA, Kansas and now SMU – and he’s three-for-three for NCAA infractions. If there were a Recruiting Violators Anonymous program, he’d be John Calipari’s sponsor!

Ethic Quiz: “Springtime For Hitler” Ethics

In South Orangetown, New York, the school superintendent stepped in and cut the swastikas from Tappan Zee High School’s student production of “The Producers” less than a week before the production. Of course, the Mel Brooks musical satire based on his film “The Producers” employs swastikas on Nazi flags and armbands during its famous campy “Springtime For Hitler” number and at other points in the show. Before someone posted a picture of the swastikas on the stage on a Facebook page, this aspect of “The Producers” had somehow escaped the attention of school administrators.

Some parents were shocked, and complained. After checking out the stage, the superintendent cut the costume details and set dressing.“There is no context in a public high school where a swastika is appropriate,” South Orangetown Superintendent Bob Pritchard told CBS. Pritchard consulted with local rabbis before making his decision.

Rabbis, of course, would be a natural audience for “The Producers.” (Reports that the rabbis suggested a production of “Fiddler on the Roof” instead have not been confirmed.)

The Ethics Alarms Naked Teacher Principle (NTP) states:

A secondary school teacher or administrator (or other role model for children) who allows pictures of himself or herself to be widely publicized, as on the web, showing the teacher naked or engaging in sexually provocative poses, cannot complain when he or she is dismissed by the school as a result. The first formulation of the NTP can be found here.

I suppose I need to circulate this more widely, because some schools apparently are confused, such as Union County High School in South Carolina. In a completely warped and unfair application of the NTP, school district officials in Union County demanded and received the resignation of engineering teacher Leigh Anne Arthur after a student stole her phone, examined its contents and found a semi-nude selfie (intended for her husband’s enjoyment only), which he shared with his classmates.

 The district’s David Eubanks said that the district’s position was that the 13-year teaching veteran was at fault for leaving her phone unlocked on her desk when she went out of the room, and that she had, in effect made the pictures available to her students. He also said that the engineering teacher’s actions may have contributed to the delinquency of a minor.

The technical terms for Eubanks are unethical, unjust and illogical. The kid stole the phone before he knew what was on it. He would have stolen it even if it had been locked. Arthur didn’t make him a delinquent; he was already a delinquent. How far would the school board take their absurd logic? If the kid stole her purse, found a key in an envelope with a bank account number on it, and the student took it to a bank and got into her locked storage box, and in there was the combination to a warehouse storage locker that contained a nude oil painting of her that was painted when she was an artist’s model, and he stole the painting and held an exhibit of it in his garage, charging admission, would the school system fire the teacher, or expel the student for an outrageous invasion of privacy, as well as theft? Cutting The Racial Gordian Knot: What Are The Ethical Implications Of The Terrible Economic Disparity Between Black And White In America?

The question raises the ethical implications to all American citizens and our shared obligation to our nation and its society of a disastrous, crippling problem that poisons our culture. and society: the persistent plight of Black America.

Back when I was a senior in college majoring in American Government and the U.S. Presidency, I took a course  from Professor Thomas Pettigrew, then as now one of the foremost scholars on race, prejudice and public policy. It was about the challenges facing blacks as they tried then to benefit from new legislation and opportunities created by the Civil Rights Act and other policies, such as school busing. I was very impressed by Pettigrew’s even-handed, objective and non-political approach, even though, at my college, political teaching was the rule, not the exception.

I have never left a course so discouraged. Pettigrew, himself a pretty optimistic man, led us into one dead-end after another: black families, education, neighborhoods, political behavior, crime and more, all dysfunctional or suffering. All areas of black society interfered with or blocked improvements, progress, remedies and policy initiatives that showed promise to address racial inequality in other areas.

Late in the course I asked him if he saw any hope that in 50 years, black America would be approaching parity with white America. “I have hope,” he said. “But I honestly don’t see how we get there from here. There is a path, but we haven’t found it.”

It appears that my discouragement then was an accurate reading of the problems ahead.

Last week, these charts from the Brookings Institution’s Social Mobility Memos blog were posted to the web by other sources. They show how deeply the problems I was warned about have failed to improve in 50 years. Here is what they show:

1. Upward mobility is much more unlikely  for black than white Americans. 51% of the black Americans born into the lowest fifth of the earnings distribution remain there at age 40:
