Malik Leigh is an attorney who teaches in Palm Beach Lakes High School’s pre-law academy. He submitted an exam for review, as the school requires of all tests, that included this question:

“If Donald Trump becomes president of the United states, we are:

A.) Screwed

B.) Screwed

C.) Screwed

D.) Screwed behind a really YUGE wall that Mexico pays for.”

In another question on the same test, this lawyer—and I’m still trying to get my mind around that embarrassing fact— asked

“When performing an opening statement, it is best to:

A. Wink at the Judge

B. find the hottest person on the Jury and focus your words on them

C. Speak to them as if they are cordial friends.

D. Treat them like the MORONS they are.”

Leigh was suspended.  The letter he received from Principal Cheryl McKeever announcing the suspension stated that the questions contained “inaccurate content, irrelevant material, unprofessional use of language, inappropriate use of language.” Continue reading

Ethics Dunce: U.S. Supreme Court Justice Sonia Sotomayor

Speaking before an audience at the American Law Institute, U.S. Supreme Court Justice Sonya Sotomayor said that she advocated mandatory pro bono service ( that is, for no compensation) to poor citizens by all lawyers. “If I had my way, I would make pro bono service a requirement,” she said.

“I believe in forced labor.”

This is the quality of thought that we get on the highest court in the land, that must decided our most difficult, controversial and society-molding legal. This is what we end up with when a Justice is appointed in order to check off group identify boxes for “diversity” rather than on the basis of ability.

Sotomayor made the comment at the American Law Institute’s annual meeting in Washington, in response to a question from institute director Richard Revesz about the problem of improving access to low-cost and effective legal services for low-income individuals. I’m pretty sure the “forced labor” comment was delivered as a joke, but it looks terrible in print, and immediately drew a predictable response from conservative pundits. “YOU BELONG TO THE STATE” quipped Instapundit’s Glenn Reynolds.

Screaming At The TV In A Hotel Room…The News Media, GOP, Polls, Trump and Hillary Agree: Lies Don’t Matter!

I was stuck on the road without a laptop this morning, up an hour earlier than I thought I was because the hotel room clock was set an hour ahead (apparently they have double daylight savings time in Boston  now), and found myself watching one segment after another on CNN that had me by turns depressed and furious, with my head exploding repeatedly (I can’t wait to see the cleaning bill.)

1. First, there was a segment about how Hillary Clinton is attacking Bernie Sanders by saying that she supported the auto bailout, and implying that Bernie did not. As the CNN crew pointed out, Bernie opposed the bailout when it was part of the whole economic stimulus package,but voted for it, like Clinton, when it was severed from that bill. In other words, Clinton…and I know this will shock and disillusion many of you…was lying. This lie is the variety called deceit, a Clinton specialty. She doesn’t exactly say that Sanders didn’t vote for the bail-out, but that is the impression her words leave, and are meant to leave.

Get this: the reporter—I can’t find any of this exchange on the web—following Clinton’s campaign said (I am paraphrasing), “It isn’t up to Clinton to explain the nuances of his votes. That’s Sanders’ problem.”

No, you pro-Clinton hack of a lazy and ethics-challenged  parody of a journalist, it’s your problem and our problem, and because you and your Clinton suck-up colleagues won’t inform your viewers that a lie is a lie, it is a really big problem. Sanders did not oppose the auto bail-out, and Clinton, who knows that, is saying otherwise in the patented Bill and Hillary way. It shouldn’t be up to Bernie to try to unravel the deceitful false accusation; he shouldn’t have to deal with it at all, and wouldn’t if he wasn’t running against a shameless liar. I shouldn’t have to keep going on Facebook trying to explain reality to my ignorant friends who believe that Colin Powell’s handful of private e-mails during the Jurassic Period of State Department cyber-security made Hillary’s private server as pure as the ocean breeze, either. Ethics Verdict On George Zimmerman’s Gun Auction: Ick, But Not Unethical

George Zimmerman is auctioning off the 9-millimeter pistol he used to shoot Trayvon Martin on a website called GunBroker.com.

Zimmerman wrote,

“I am honored and humbled to announce the sale of an American Firearm Icon The firearm for sale is the firearm that was used to defend my life and end the brutal attack from Trayvon Martin on 2/26/2012.”

George goes on to say that the proceeds will be used to “fight [Black Lives Matter] violence against Law Enforcement officers” and to “ensure the demise of Angela Corey’s persecution career and Hillary Clinton’s anti-firearm rhetoric.”

Social media is going  nuts with hate, with many comments wishing that someone would buy the gun and shoot Zimmerman with it.

Now hear this:

There is absolutely nothing unethical in any way about Zimmerman selling his property, including the gun that he used to shoot Trayvon Martin.

The gun has historical and cultural significance. Despite its grisly past, someone may want to purchase it.  Booth’s derringer is exhibited at Ford’s Theater, and nobody has ever taken offense at someone purchasing and exhibiting the gun that killed a President and American icon. Continue reading

From The Law vs. Ethics Files: The ‘Be My Guest, Rob My Anti-2nd Amendment Neighbor’ Sign

I can’t seem to find out for certain if anyone has been so vile and foolish as to actually put up the sign shown above. (That photo is obviously fake.) Even if there are genuine photos posted somewhere, I doubt that such a sign would ever be left up for long. I could be wrong.

It’s probably not protected speech, as the sentiment invites violence toward another citizen. It is undoubtedly unethical speech, just like signs that say “My neighbor’s door sticker saying the house has burglar alarms is a bluff” or “The lady next door is beautiful and incapacitated” or “The little girl next door is excessively trusting.”

Yet the sign shown above is sold on line. Selling a sign with a dangerous, hateful and irresponsible message is legal. This one is also completely unethical. I know: it’s a joke.  I don’t care. To sell a sign that you know might cause harm if anyone used it as a sign is still indefensible, especially since we know how many Americans voted for Donald Trump.

In other words, there are a frightening number of hateful, reckless fools out there.

The company selling these abominations is called Zazzle.

Treat the company appropriately.

I’m pretty confident of this designation, and if the previous post hadn’t speculated on the most unethical judge ever, I might have given this the Worst Meme of All Time title. I may yet.

Almost all political memes are misleading, dishonest, irresponsible or so dumb that you want to strangle the Facebook friend who posted it. If anyone sends you the meme explaining how to make a Bernie Sanders glowstick, however, skip the strangling and call the cops on him. This meme is potentially deadly.

As Republican Ethics Heroes And Dunces Board, Dodge Or Drive The Donald Trump Presidential Candidacy Ethics Train Wreck

The Donald Trump Presidential Candidacy Ethics Train Wreck is so deadly that the nation will be forced to board the Hillary Clinton Presidential Candidacy Ethics Train Wreck to survive it, as a broken back, a smashed face and need for multiple organ transplants are still more survivable than a damaged brain and a crushed heart.

Like all political Ethics Train Wrecks, however, it does allow us to learn a great deal about various pundits, politicians and public figures. Here are some early results from the wreckage once known as the Republican Party:

Ethics Heroes: The Bushes (Jeb, George H.W. and George W.) Mitt Romney, House Speaker Paul Ryan, Republican U.S. Senators Lindsay Graham,  Ben Sasse of Nebraska and Jeff Flake of Arizona, Massachusetts Gov. Charlie Baker and Illinois Governor Bruce Rauner;  Conservative columnist Erick Erickson, Republican strategist and operative Mary Mat Weekly Standard founder and editor William Kristol.

There will be more. To reject the apparent nominee of your own party is a nearly unprecedented step for party leaders and ex-Presidents. I can’t find any vaguely similar example since Teddy Roosevelt split the GOP with his Progressive Party in 2012. Sasse has called for a third party alternative. Do We Really Want To Live In A Society Where Tow-Truck Drivers Refuse To Tow The Cars Of Bernie Sanders Supporters?

In Ashville, North Carolina,  tow truck driver Ken Shupe arrived on the scene to find motorist Cassy McWade standing by her accident-disabled vehicle  on Interstate 26. “He goes around back and comes back and says ‘I can’t tow you,” Wade told a reporter. “My first instinct was there must be something wrong with the car. And he says, ‘No, you’re a Bernie supporter.’ And I was like wait, really? And he says, ‘Yes ma’am,’ and just walks away.”

Here’s Shupe’s version:

“Something came over me, I think the Lord came to me, and he just said get in the truck and leave. And when I got in my truck, you know, I was so proud, because I felt like I finally drew a line in the sand and stood up for what I believed.”

A few quick points and then I’ll get to the real issue:

1. Shupe is an utter, virulent, IQ-deficient jerk whose conduct and attitude makes a mockery of whatever faith it is cursed to have him belonging to it, and constitute a blight on the society, community,culture and nation so unfortunate as to be stuck with him.

2. News reports make a big deal out of the fact that McWade is confined to a wheelchair. Ah: the theory is that we are only obligated to help our handicapped neighbors in need, is it? It shouldn’t matter if she was an Olympic medalist in the 50 yard dash. You don’t treat other human beings like that in any society that values human rights and common decency.

3. Shupe’s company is Shupee Max Towing in Traveler’s Rest, South Carolina. Nobody in their right mind should patronize this unAmerican creep, including his own family. This was anti-social,  cruel and objectively horrible behavior toward someone in need, and Shupe needs to be shunned, hard. If he can’t co-exist with others any better than this, he needs to live in a cave somewhere, because he’s not fit for human association.

4. To anticipate an objection: you may ask how it is that I can argue that friendship should outweigh political differences and advocacy of unethical conduct, and yet designate Ken for ignominy and rejection. If Ken were a friend of mine, I can see myself standing by him even after this miserable behavior. But, as Samuel L. Jackson tells John Travolta in “Pulp Fiction,” “We’d have to be talkin’ about one charming motherfucking pig.”

In a way, however, we should be grateful to Ken Shupe, who has provided in short order and timely fashion a near perfect example of the society-wrecking virus being actively spread by irresponsible zealots on both ends of the political spectrum who are determined to divide the nation and the culture as never before. Yes, never before. During the American Civil War, generals on opposite sides of some of the most bloody battles ever fought arranged to meet and exchange pleasantries, because they had been, and remained, friends. “Yo, Barry, You Did It, My Nigga!”

“Yo, Barry, You Did It, My Nigga!” This was “The Nightly Show’s” Larry Wilmore’s final salute to the President of the United States during an alleged comedy routine at the White House Correspondents Dinner.

Here’s what’s wrong with it:

1. The comment was cynically calculated to cause an uproar, even at the cost of embarrassing the President and causing a racial incident. This is neither good hosting, nor ethical citizenship. Wilmore was only aiming at exploiting an opportunity to expand his rating, which aren’t so great.

2. It is disrespectful, no matter how one interprets the word. Barack Obama isn’t “Barack,” “Barry,” “Bro’,” or “Nigga” to Wilborn. He’s “Sir” or Mr. President. His job as M.C. didn’t permit that liberty.

3. It adds to a widespread and societally disruptive belief that Barack Obama is the black community’s President, and the black community has special privileges as a result. It certainly suggests that’s how black America views him. That’s not the legacy the President seeks, and thus the comment was uncomfortable for him.

4. Most white Americans and a lot of black ones do not agree that “nigger” and variations thereof are taboo when uttered by whites but benign when wielded by blacks. Why look, even Al Sharpton objected! “Many of us are against using the N-word period,” Sharpton told the LA Times. “But to say that to the President of the United States in front of the top people in media was at best in poor taste.”  “So we end the WHCD by touting the historical implications of 1st black president… and we use the N-word. Not cool,” tweeted  ABC producer Sarah Thomas, also an African-American.

5. The comment fed the racial divisiveness that has been the hallmark of Obama’s presidency. “Black Twitter,” as it is called, was full of African American celebrities and commentators making it clear that they didn’t care what white people thought. Mediaite’s resident race-baiter Tommy Christopher approvingly cited many of them, including his own.

I wonder who it was who convinced African-Americans that it was either wise, strategic, fair, reasonable or ethical to simultaneously express contempt for the opinions and feelings of whites while demanding hyper-sensitivity from whites about any word, innuendo, opinion or topic that could be considered the least bit uncomfortable for blacks?

6. “Barry” did what, exactly? What is “it”? Massively increasing the national debt? Dangerously dividing the nation? Undermining the rule of law, free speech and the system of checks and balances? Making a mockery of his promise to be transparent? Nurturing the anger, despair and cynicism that led to the rise of Donald Trump?

Barack Obama’s singular and historical accomplishment was being elected the first black President. Yes, he did that, but he did that almost eight years ago, and it’s old news. After that, his job was to be a good, fair, hard-working, effective, unifying and successful President of the United States, and his color was and is irrelevant to those tasks.  He hasn’t been any of those things, so what has he done? Finished his terms? That not a big accomplishment. I guess he created an environment in which a TV personality thought it was appropriate to call him a “Nigga” in public.

He did that, all right.

I’m not applauding.

Unethical Quote Of The Week: President Obama

“Today, I want to update you on some important progress we’ve made to protect our communities from gun violence. As I said in January, these commonsense steps are not going to prevent every tragedy, but what if they prevented even one? We should be doing everything we can to save lives and spare families the pain and unimaginable loss too many Americans have endured.”

—- President Barack Obama, announcing new measures that his administration will pursue to help curb gun violence.

This is at least the second time, related to gun deaths, that President Obama has invoked the logically, practically, philosophically and ethically absurd “if only one life is saved” argument. President Obama isn’t as smart as his blindly loyal supporters think he is, and definitely not as smart as he thinks he is, but he must be smarter than that.

Yet he uses this ridiculous logic anyway. In Obama’s defense, his entire, nauseatingly inept administration has been rationalized on this basis, so it is a mindset that may be set in cement. Obamacare has allowed some Americans to get insurance that they desperately needed, so, the flawed logic goes, the fact that the legislation has also divided the country, caused millions to lose health care plans that they were satisfied with in favor of new plans they can’t afford, caused rates to skyrocket, suppressed hiring and done nothing to lower health care costs doesn’t alter the official conclusion that the policy is a success.

It isn’t just that the ends justify the means; the theory is that a single designated positive result justifies not only the means but other negative results too. True, prematurely withdrawing from Iraq caused the country to collapse and Isis to run amuck, but the United States withdrew, and that’s enough. Yes, the Education Department’s “Dear Colleague Letter” has caused male students to be unjustly tarred with unproved rape accusations, been the target of false charges and have had their educations disrupted without sufficient evidence or due process, but as long as some female sexual assault victims receive fair attention to their complaints that would not have occurred before, this gender-based persecution is acceptable collateral damage. Sure, Obama’s refusal to acknowledge that radical Islam is a terrorist threat have allowed irresponsible immigration and migrant policies to continue despite their existential risks, but what matters is that some, many–just one!—peaceful, law-abiding Muslims not be the victims of bigotry, fear and hate.

Obama’s latest “just one is enough” assertion is a direct call to the most naive, least aware and most cognitively impaired among us. If saving just one life were enough, then automobiles should be made of soft plastic and travel no more than a few miles an hour. Requiring airlines to use only airplanes that don’t fly, like the one pictured above, would surely save at least one life. Ships and boats never launched on water are very safe. Continue reading
