Ethics Villain: Manhattan District Attorney Alvin Bragg, And Other Observations On The Trump Indictment

Last week’s indictment of Donald Trump, engineered by a hard-Left partisan Manhattan D.A. who had made his intentions known when he was running for office, didn’t change any of the ethical calculations here that were recorded when that indictment seemed imminent almost two weeks ago, or in the update, when it appeared that Alvin Bragg might have lost his nerve and decided to be an ethical prosecutor after all, here. I reviewed both posts to see if I would change anything, and I would not, but the final line of the March 18 essay still resonates: “The indictment will remind people of why he won in the first place.” Bragg’s exercise in politically-driven law enforcement will drive far more voters to Trump than it strips away. This makes his actions as politically and pragmatically irresponsible as they seem to be legally and ethically indefensible.

It is necessary to include the caveat “seem to be” because we haven’t seen the indictment yet. Maybe Bragg has legitimate cause (other than “he’s a bad guy and must have done something illegal”) to bring criminal charges against the ex-President, though virtually no unbiased legal analyst with any legitimacy thinks that’s likely. If he does, then his pursuit of Trump may be unwise, and its passion may be fueled by bias, but it is not unethical.

From another perspective, however, even if there were valid and legitimate reasons to charge Trump in this case—and I will be surprised if there are—if there ever were a situation where prosecutorial discretion and restraint were screamingly called for, this is it. The ripples and waves emanating from this indictment and, heaven help us, the arrest and trial will cause so much havoc in our political system, legal precedents, societal divisions, and national discourse that it cannot even be quantified or predicted. They could easily result in Donald Trump being elected again, or arguably worse still, in Joe Biden being re-elected. Whatever happens as a result of Bragg’s conduct, it is certain to be bad for everyone except, maybe, the fanatical Trump Deranged, who have already demonstrated a willingness to destroy the Constitution, the Rules of Law, democratic institutions and ethical standards to get their prey.

The standard issue virtue-signaling woke gibberish above introduces Michigan State University’s “Strategic Plan,” which is more virtue-signaling woke gibberish. You can’t “empower excellence” if you “advance equity,” since equity now means “pay no attention to excellence or actual qualifications and ability, the goal is to make sure everyone gets to the same place.” That requires penalizing excellence, or hobbling it. The strategic plan itself is introduced with this consultant-speak blather: “We envision a Michigan State University that has significantly expanded opportunity and advanced equity, elevated its excellence in ways that attach vital talent and support, and has a vibrant, caring community. Our trajectory is positive, and our will is legendary. We can and will achieve more in the decade ahead.”

Ramalalama-ding-dong! But that’s not what prompts this post.

One of the ways MSU seeks to achieve its goals is by limiting WrongThink through the meticulous constriction of language using the excuse of, you guessed it, “Diversity, Equity and Inclusion.” On the MSU website, this is introduced by this self-contradictory, indeed Orwellian graphic:

Introduction (March 31, 2023)

When I was preparing for yesterday’s final post about the French family fighting to overcome France’s paternalistic government bureaucrats from inflicting the name “Hades” on their infant son, I considered introducing the tale with Johnny Cash’s famous rendition of Shel Silverstein’s “A Boy Named Sue.” But I suspected that I had used the song before, and sure enough I had, in the post that follows, from six years ago.

The main thrust of the essay is the ethical issue touched on in the Hades story as well as others here through the years: the unethical act of giving children weird names. I was surprised, however, to see the post’s prescient and remarkably currently relevant commentary about the transgender insanity that was then no more than a twinkle in the Woke-Deranged mob’s metaphorical eye.

Wow, I nailed it. (Hence my doppleganger Fredo’s appearance in the clip from the Ethics Alarms clip collection.)Too bad only a small cadre of the ethically enlightened and intellectually curious read this blog: forewarned, maybe the current madness that has teachers encouraging fifth grade girls to cut off their breasts and large swathes of society urging momentarily confused boys to call themselves by plural pronouns and “identify” as “non-binary” could have been avoided, or at least minimized. This is my fault, of course; I’m the one who hasn’t figured out how to be an “influencer,” while 21-year-old Kardashians can. I get my self blackballed by NPR by daring to defend Donald Trump on a flaming progressive’s show.

Fredo.

But I digress—sorry. The quote below that struck me was this one:

This is what happens when you let the nose of a flatulent and rude camel into your tent. Those with gender issues should not be abused, beaten, or discriminated against. Agreed. They should have access to medical treatment connected to their condition. Absolutely. They should be able to openly declare their status without fear of reprisals, and people with compassion, manners and ethics shouldn’t teat them like freaks. Got it.

But they do not have leave to re-make the world in their image, and cry foul if the majority draws reasonable lines and says: No. Behave.

Ethics Hero: Avi Silverberg, Whose Pronouns Are “Whatever Lets Me Win”

Avi Silverberg, a Canadian male powerlifting coach, self-identified as a woman last week to participate in the women’s Heroes Classic Powerlifting Meet in Lethbridge, Alberta. (That’s “her” above.) As the current record holder, a transgender male-now-female, looked on, the large, bearded athlete broke the Alberta women’s bench press record. Appropriately, Avi didn’t even try to look like a girl. Priceless.

Silverberg could do this “fair and square” because the truly stupid Canadian Powerlifting Union (CPU) had established a liberal gender self-identification policy (the “Trans Inclusion Policy”) earlier this year, so any male can now compete as a woman as long as he/she feels like a woman on that particular day. “Based on this background and available evidence, the Expert Working Group felt that trans athletes should be able to participate in the gender with which they identify, regardless of whether or not they have undergone hormone therapy,” the policy document reads, deferring to the “inclusivity” guidance from the CCES (The Canadian Centre for Ethics in Sport)

When Ethics Alarms Don’t Ring:

Josselyn Berry, Arizona governor Katie Hobbs’s press secretary, was somehow moved to tweet this…

…just days after a transgender former student went into a Christian school and shot six people dead, including three nine-year-olds. But hey, that should teach anyone who criticizes pro-trans mania to watch what they say, right?

First Berry shuttered her Twitter account, then she resigned.

A few observations:

  • I continue to find it fascinating that the same party that flogs the talking point that conservatives peddle hate and incite violence constantly does things like this. Here, for example, is Minnesota’s Lt. Governor Peggy Flanagan:

Nice! Funny, I would argue that kids need to be protected from adults trying to convince them that they need puberty blockers and other life-altering treatments that should be hidden from their parents, but I wouldn’t use a knife to do it.

  • In addition to the other things wrong with Berry’s tweet, it’s spectacularly bad timing to condemn “transphobia” after a trans individual has gone on a killing spree.
  • This is exactly the kind of tweet Twitter should just leave out there. It’s useful to know what such tweeters are really like, especially when an elected official employs them.

Yes, it’s Alistair Cookie, here for another episode—two, in fact!—of that long-running exhibition loved by the confirmation bias-infected and the unscrupulous alike, “Bad Research Theater”!

Episode I : “The Steam Engines of Galapagos“

The eye-opening scholarly paper “The end of the line: competitive exclusion and the extinction of historical entities” has been published the journal, “Royal Society Open Science.” Bruce Lieberman, professor of ecology & evolutionary biology and senior curator of invertebrate paleontology at the KU Biodiversity Institute & Natural History Museum, uses the history of railroad steam engines history to argue against the merits of “competitive exclusion,” the respected paleontology evolution principle that species can drive other species to extinction through competition.

Working with former KU postdoctoral researcher Luke Strotz, now of Northwest University in Xi’an, China, Lieberman found that the fossil record lacks the detailed data verifying competitive exclusion found in the history of steam engines. Well, I don’t know about you, but I’m convinced!

Many years ago, as a boy trying to bring in distant baseball broadcasts at night on my transister radio, I stumbled across a rural evangelist who was ranting about the godlessness of evolution. “Evolution says that if you put a six cylinder engine in your garage and let it sit there for a million years or so, when you come back and check on it, it will have become an eight cylinder engine!” he said, chuckling heartily. I thought that was the dumbest thing I had heard to that point in my life, and it still is in the top five. Little did I suspect that his idea of comparing mechanical objects with live organisms would be adopted decades later by actual scientists.

Incompetent Punditry, Irresponsible Paper: The Boston Globe Publishes An Op-Ed Called “DEI Denial Is The Modern Day Lynching”

It really did.

There may have been equally dumb headlines and op-ed pieces, but I can’t imagine what a worse one would be. This is what I get for being a Red Sox fan: the Boston Globe used to have the best baseball coverage in the U.S. back when I was still in Boston, so I return to it periodically when the baseball season looms. This was my reward: an example of deranged, arrogant, dissent-demonizing wokism that should never have been published, and wouldn’t be by a responsible newspaper, if there were such a thing any more.

Criticizing the cynical Diversity/Equity/Inclusion fad that was one of the many mutations of policy and logic to ooze out of the George Floyd Freakout is the equivalent of murdering innocent black men in the Deep South! Of course! What a brilliant analogy! Or perhaps it is more like…let’s see… making a Nash Rambler model out of clubroot and old Silly Putty?

The author of this brain-rotting garbage is Ya’Ke Smith , an associate professor of film at the University of Texas at Austin. Doesn’t that background just scream out: “public policy expert”? The silly rant signals repeatedly that it is just passionate woke nonsense unhinged to facts. For example, he writes, “the execution of George Floyd in Minneapolis.” That’s signature significance: no honest writer or one who cares at all about facts, history, law and reality would write that. Floyd was not by any measure intentionally killed, so he cannot have been “executed.” If I wasn’t obligated to cover terrible punditry and journalism ethics here, I wouldn’t finish reading an essay that characterized Floyd’s death that way. Anyone who would do that is a liar or an idiot, or both.

Unethical Quote Of The Month: 65 Professors And 558 Other Faculty Members And Students Of Washington & Lee University

“We ask that the University prevent Matt Walsh from speaking on our campus and that the University live out its Statement of Commitment to Diversity by taking action to protect its minority students from future harmful events.”

—623 Washington & Lee signatories, including 65 professors and law professors, of an online petition to block a conservative speaker from appearing on campus

Displaying either ignorance or contempt for the core American ethical principle of freedom of speech, 623 members of the Washington & Lee University community, mostly students and faculty members but with a few others mixed in, maybe cafeteria workers or something, have signed an online petition insisting that conservative political commentator and author Matt Walsh be prevented from speaking at the Virginia campus on March 30, on the currently controversial topic of “What is a woman.” Walsh has been a deliberately inflammatory critic of the current extremist, indeed brain-melting phenomenon of transsexual madness, which has reached such heights (or depths) that the last confirmed Justice on the U.S. Supreme Court professed an inability to define “woman.” Walsh stars in online documentary film “What Is a Woman?” created by the conservative website, The Daily Wire.

What is so disturbing about the petition, which is reproduced in its entirety below, is the anti-democratic logic and ideology it displays, though all of this is now familiar to anyone following the descent of the American Left into aspiring totalitarianism. The position one whole side of the American political spectrum has now almost completely accepted as legitimate is that dissent from its obviously virtuous and correct cant (they are on the “right side of history,” after all) is the equivalent of violence and causes permanent “harm” to member of its constituency or society in general. The petition justifies its existence by providing frightening proof of many horrible truths, among them that the U.S.’s institutions of higher learning now indoctrinate their students into anti-democratic philosophies. NPR Wonders If Transgender Athletes Have A Physical Advantage Over Female Competitors

Huh! Good question, NPR! It’s a mystery! A real head-scratcher! Oh if only there were some convincing evidence that going through puberty as a male confers some kind of advantage for trans female athletes! When will we have such information?

Oh, I almost forgot: “Nah, there’s no mainstream news media bias!” Also: “We pay taxes to support this crap???”

The World Athletics Council, the governing body for international track and field, announced last week that it will bar transgender women athletes from competing in events with everyday, normal, biological women who have been so from birth. This isn’t rocket science. What is ridiculous is that so many organizations are so devoted in their loyalty to Woke World that they are still in denial. That’s trans Ivy League swimming cheat Lia Thomas above with one of the little women who finished second to her during the past year’s contests, and no, they are not standing on platforms.

The “Shizzle My Nizzle” Saga

There are a lot of angles that I was tempted to apply to this Weird Tale from The Great Stupid about a longtime, popular talking head for a Jackson, Miss. news broadcast. It is obviously a “when ethics alarms don’t ring” story, for example. It could be used as evidence of persistent racial insensitivity in Mississippi, or the South, or the nation. The episode might be cited as more evidence that public apologies are usually meaningless, and that after-the-fact trainings for employees who utter words that suggest they have, let’s say, racial, gender and ethnic biases are window dressing and just about useless.

However, I’m going to cite the episode as an example of how broadcast journalists are hired more for their non-intellectual assets than any genuine talent in analysis and reporting, and also to illustrate how incomprehensible the current rules are regarding who can say what during The Great Stupid.

Barbie Bassett (above) was a popular news anchor, weather lady and a traffic reporter for WLBT, an NBC affiliate in Jackson, Mississippi. The former beauty queen—beauty queens are innately talented as journalists, did you know that?—has been a fixture at the station for 23 years, but hasn’t been seen on the air since March 8 though the station hasn’t make any official announcement. She has apparently been sacked, since her image and any traces of her have been purged from the station’s website.

Bassett’s demise was triggered when she participated in a segment on a new variety of wine from Snoop Dogg’s Snoop Cali Blanc wine collection. (Now there’s news the public has a right to know!) Barbie was chattering away and quoted Snoop’s trademark gibberish, “Fo’ shizzle, my nizzle!” “Nizzle” is Snoop for “nigga.” Even though the rapper is featured in national TV ads for a couple of products and treated as a cute and harmless celebrity, white people aren’t allowed to say “nizzle,” though heaven knows why they would want to.
